Oksana Grigorieva Will Sue Mel Gibson

Oksana Grigorieva will file a lawsuit against Mel Gibson alleging -- among other things -- battery, emotional distress and defamation ... TMZ has learned.

Sources tell us Oksana has hired Martin Garbus and Daniel Horowitz  ... two formidable lawyers who have been around the block in celebrity cases. Garbus has defended Robert Redford, Al Pacino, and Spike Lee -- and both he and Horowitz rank among America's top litigators.

We're told Garbus and Horowitz will represent almost all things Oksana -- they will be her reps in connection with the domestic violence investigation as well as the extortion probe.

In addition to the civil suit, we're told Garbus and Horowitz will represent Oksana in her music career -- specifically, they will challenge Gibson, who they claim is blocking the release of Oksana's music.

As for the civil battery case against Gibson -- sources tell us the plan is to file it by the end of the year.

Good point...the civil litigation case(not criminal) could drag on. There is a stop-loss $$ figure that attorneys must also take into consideration if working on any type of contingency fees. That's when the word, "settlement," rears it's head.

ok, let's say she takes Mel to court and for some stupid reason the lawsuit goes against Mel. A judgement is normally given in an amount and the attorney fees come out of that judgement right. No payment is needed until the court decides if it wins or loses, right? If she loses then SHE will have to pay the attorneys, or will they only collect if they win?

So now she's falling back on plan B and trying once more for the civil suit to encompass the alleged beatings, the character defamations related to the recordings and all her emotional distress suffered over the months. And, too, a flanking attack going for the music.

Honestly, I think this was the plan all along. She just got side tracked by a lawyer that told her she should try for a criminal case first to bolster her story.

I agree. An attorney on another board said that when she did not hand the tapes over to LE as proof of abuse that it was clear what their real purpose was - civil suit and looking for the big payout. SIckening.

That is why I believe she is bluffing. Even if Mr. Gibson does not have to pay her Lawyers, it would cost him a fortune to pay his own lawyers. Therefore gambling that paying her off would be cheaper than going through the legalsystem.

And who knows, she might have made a no cure / no pay deal.
Is this possible? I mean, come on, by the end of the year?
