Oksana Investigation: Extortion vs. Negotiation

The L.A. County Sheriff's Department is focusing on a central issue in the Oksana Grigorieva/Mel Gibson extortion investigation -- What constitutes negotiation, and what is extortion?

L.A. County Sheriff's Department spokesperson Steve Whitmore tells TMZ his Department is several weeks away from wrapping up its investigation.  As Whitmore put it, "One of the challenges investigators are facing is what is considered a legal negotiating tactic and what constitutes extortion."

TMZ has learned ... the L.A. County Sheriff's Department is combing over key pieces of evidence in the Oksana Grigorieva extortion investigation ... and law enforcement sources tell us the focus is on Oksana's iPhone, as well as text messages and emails between Mel and Oksana.

Whitmore would not discuss specific evidence in the investigation, but did say investigators are conducting forensic analysis of the items.

And Whitmore says there are two attorneys whom investigators still want to interview, and there have been scheduling problems.  TMZ knows the lawyers are Eric George and Sonia Lee, who share a practice and represented Oksana in the mediation in which Mel agreed to pay a total of $15 million in return for the tapes and other evidence.

We've learned George -- who has been out of the country -- will be back in L.A. later this week and is eager to speak with investigators.  We understand Lee is also willing to sit for an interview.

And, we're told the only person who is the target of the investigation is Oksana.

What is wrong with the LAPD????? It's been clear to me all along OG is guilty of extortion, I could go on and on but you all have done an excellant job of investigative work. Kudo's to all. If you/we /me can figure it out and see things plain as day....why can't they determine betwen negotiations vs extortions?They need to fry her fast..esp with every PRIVATE detail of their relationship she was cruel and heartless to reveal!!!!!!!!!!!!!!! Honestly... I couldn't bring myself to read those PRIVATE and Intimit letters revealed...Felt profoundly guilty of invading someones privacy. I would be mortified it that happened to me

Pissed off.

Horowitz claims that this attorney, his partner, the other attorneys and the retired judges involved in mediation commited a crime by coming up with an agreement that would destroy criminal evidence, even though there was no criminal case pending.

Yeah...I'd say he's probably is primed and full of piss and vinegar!

Thought so. Convenient Horowitz came out with this with Eric George out of the country. I will still hold my breath tho. These guys are adversarial in court but a lot of them are like a club when they are headed out the courtroom door after the verdict has been read. The George civil suit bugs me.

For the sake of argument let's say everything in the above is true. Here's the thing though - - in this case, Oksana will walk away penniless. At this juncture, Mel will not give her a f**king farthing. And on that score, Gloria does a better job. So why didn't Oksana go to Gloria in the first place?

How can this be taken seriousy, she makes this up as she goes along! When one lie doesn't add up, she makes up another.

She has publicly proven time and time again that she will try anything, say anything, publish anything in order to destroy, rape and pillage MG.

She has been scorned by the public, because anyone can see that she is a blatant opportunist and a liar. Her word is worthless, even sworn notarized do***ents are not respected by her. She has no respect for our legal system! When one smarmy lowdown filthy ploy doesn't work, she tries another one.

She fires PR people and lawyers, or they resign. How many is it now? (But look, she has one that will dance for her now)! And when he isn't promoting her tell-all voyeuristic stories, he shamelessly tries to promote her CD. He also trys in vain to restore her public image. (BTW, restored to what? She started out with a disgusting public image. Show us a time when it was good)!

She sits on her droopy ass all day, with no job, dependent on the man that she is hellbent on destroying. And she gets away with all of this.

It looks like there is something very fishy going on here. Particularly if the DA takes her allegations against MG seriously. It all comes down to what his action will be, and I hope he sees how she and her changing stories stink!

Or does the DA, like Gloria Allred, have a personal vendetta against MG, otherwise, why would a he entertain any information given to him by a woman who has been publicly exposed by her lawyer and her own written words, for the crime as an extortionist.

Isn't that the same as a confession of her guilt? Like: "Hi everyone, look, look, look, here's where I extorted him". We've all seen this printed in black and white.

We "THE PEOPLE", have seen all of this played out publicly! So what's the delay Mr.DA? We are wanting to know what you are doing about this?

The public has been watching this very closely because it has been shoved in our faces by one Oksana G., who shamelessly goes against the law by publishing things she was told not to. And she continuously comes out with more outrageous lies, and no authority stops her. Why isn't she in jail right now for breaking the gag order? Isn't she in contempt of court?

Why didn't she report her outrageous accusations at the time? Instead, she makes anything up about him at regular intervals, in order to keep this thing going.

Her accusations are concocted out of the world of delusion that she lives in, and then she says" Ohhhh, I didn't tell you this before, but etc. Etc. Etc". We see from the start that this whole story has been one sided and that Oksa is being allowed by the authorities and the press to hang MG out to dry. Where is the justice in this?

Why why why is this criminal Oksa, allowed to get away with this? Is our legal system corrupt?

Awful awful thought, but lately it comes to my mind that People have a breaking point, you know, the point where you just can't go on and it's rock bottom? Could Oksana push Mel over the edge with all these leaks to the public, the "love" letters, emails, tapes etc., and Mel would end his own life or resort to a drunken stupor and die in a car crash? God, I hope nothing tragic of this nature comes as a result of this. People would really hate her if something like that happens. If it were me in Mel's place, and I had screwed up like he has, and someone like Oksana was gnawing at my life like a rat, I just don't know how much I could take mentally.

Gene, I think Mle is now a very tragic figure and he is isolated, a pharia, a figure of ridicule and won't recover unles he fights and prevails or rehabs bk self in a way thatbthe public and his professional community gives him a second chance. He did wrong by losing his cool, his words are unacceptable. I understand how people can privately lose it, but he is to be better than that . . .she is bad, bad, diabolical really in the way she destroyed the career of her baby's father. A Shakespearan tragedy for sure. I do have to say that he was so proud, arrogant even in his religion that it is almost divine the pwrfect and absolute way in which Oaska destroyed him. Brillianr talent cut down. I hope he recovers, gains humility and seeks atonenment. That little girl needs him.

Daniel Horowitz, one of Oksana's lawyers, tells TMZ, Dan O'Malley (pictured above) is now on board to advise his team on domestic violence issues. Specifically, Horowitz says O'Malley will "hook up people in the domestic violence community to help Oksana," as well as "interface with the L.A. County District Attorney regarding the Mel Gibson domestic violence investigation."

But here's the deal. If O'Malley wins the election for D.A. of Contra Costa County in November, he must resign.

Still, in this case -- 5 weeks of O'Malley could be better than no weeks of O'Malley."


Trying to win through intimidation? The paperwork alone will stall this case. Hey O'Malley -- -- how do your Contra Costa County voters feel about this?
