Betty Ford Staffer Fired For Talking to TMZ

Dawn Holland, the woman who told TMZ Lindsay Lohan hurt her bad, was fired 30 minutes ago by Betty Ford officials.

Holland tells us a honcho from B.F. told her she violated patient confidentiality and was therefore terminated from her job as a chemical dependency tech, which paid $1,784.74 a month.

Holland says she told the official, "I didn't feel you had my back. When you placed me on administrative leave you were investigating me, and 9 times out of 10 that means the employee will be fired."

Holland says the official responded, "We wanted you to keep this quiet."

As for why Holland spoke with TMZ, she says, "The story was already way out there in the open before I spoke.  If Lindsay is allowed to say, 'Fire that bitch,' I should be able to defend myself."

Wrong. Lindsay Lohan didnt sign a contract with her employer agreeing to confidentiality rules. They did the right thing, and I think her bandaged hand is about as real as Andy Kaufman's neck brace.

LINDSAY JUST SAID IT BECAUSE SHE IS NOT BEING HELD TO A DIFFERENT STANDARD AS A STATE LICENSED CAREGIVER WOULD BE.

SOMEONE WILL UNDOUBTEDLY LET THE STATE KNOW ABOUT THIS UN-PROFESSIONAL EMPLOYEE AND HER TREAYMENT OF PATIENT'S AND THEIR RIGHTS TO PRIVACY, ETC.

PATIENT'S MANY TIMES DO INAPPROPRIATE THINGS AND THERE ARE CONSEQUENCES FOR THEIR BEHAVIOR BUT THIS WOMAN WAS JUDGE, AND JURY, IT SEEMS.

Now this INCIDENT (it seems) leaves Betty Ford OPEN FOR A LAWSUIT BY LINDSAY.

The staffer is correct. The story was out there widely reported with LL stating "fire the bitch."

While I agree with BF that they MUST be able to keep confidentiality, I also can understand why Dawn got tired of taking the hit from a drunken and law breaking charmer like LL.

I do believe the staffer's story on what took place. It's quintessential LL and the way she rolls.

I agree the employee was wrong for disclosing confidential information, but there is no reason to name call, using the n**ger word, affirmation action and black bitch. It's o.k. to be a fan of Linsay Lohan yet you are taking this too far by the insults. Lindsay Lohan needs to be held accountable for her actions as well as the Betty Ford Clinic. If you cared so much about Lindsay, the anger would be directed at BFC for enabling Lindsay and not protecting her from access to alcohol while on their watch. Someone from the facility should have chaperoned the outing she was on. Please redirect your anger and do not insult others.

Perhaps BF should explain why they are allowing LL to be this disruptive and discredit them. She has made the entire BF agency look stupid.

Is anyone going to tell this spoiled drug addict she needs to behave while in their charge? Perhaps they should ask the judge himself to clarify she can get tested at any time, not just when Dina okays it.

This entire event is so wrong. It's clear what took place and this poor tech took the hit for it. SHAME ON BF! My opinion of them has dropped in the toilet. I'm going to email them and tell them to be careful or Lindsay will make them all fools.

Rehab is a joke already. Thousand of kids have been sent to rehab without cause and over 100 have died while participating in various rehab programs.

Remember ABC "Brat Camp"?

If I had a child with a drug abuse problem, I wouldn't know whether continued addiction or a rehab process would be the most dangerous choice.

In this case it is good that they let her go.

Dawn has every right to pursue charges against LL and she SHOULD. If they decline to charge her, then file a cause of action against LL. If you cannot get the police to cooperate because she's a celeb and they don't want that can opened, then hit her in her bank account.

All of the above is an appropriate remedy. Let's hope the police do the right thing. Man up and charge LL.

Why didn't BF protect their employee from a patient with a history of substance abuse?

I'd say Dawn has a cause of action against LL and BF for failing to protect her while she performed the duties of her job!

We heard nothing from BF. Not one word. Very poor judgment on their part. A side of this they will undoubtedly regret soon.

On the surface, it seems she violated HIPAA. The degree of the violation is subjective. She may not have knowingly violated HIPAA. She may have been under the mistaken belief that the wide-spread knowlege of Lindsay's stay at BF and her ongoing drug/alcohol problems as well as Lindsay's alleged assault charges, exempted Lindsay's HIPAA rights. If I were on the jury, I'd give her the lowest fine possible, as I don't believe she has been fully trained on HIPAA and there are extenuating cir***stances brought about by the patient.

Lindsay is now looking at a potential defamation charge as well as an assault charge. She could also be put in violation of her probation, regardless of what this empoyee allegedly did or didn't do in regard to HIPAA. Shame on BF for not running interference for this employee and their failure to help her navigate this unfortunate event while in their employ. They totally failed her when it comes to protecting herself from the media. She should have been told not to discuss the issues with the press and WHY!

Bottom line is any judgements will probably be a wash because both subjects are probably in the wrong.

BTW- It will be interesting to see how tha "pay" issue is revealed. Also, the worker is in a WC situation and HIPAA does not apply in regard to her injury.

For starters, I'm quite sure that Ms. Holland was introduced to HIPPA guidelines as part of her orientation when Betty Ford initially hired her. No one representing Lindsay Lohan or Betty Ford granted her permission to publicly discuss any aspects related to Lindsay Lohan as a Betty Ford patient. I can understand her being as "MAD AS H.E.L.L" but she had no way of knowing exactly what the Betty Ford administrators were going to report to the court regarding Lindsay Lohan's actual progress. As a health care employee, Ms. Holland doesn't have the right to arbitrarily disclose any information about a patient's medical condition unless she's been given permission to do so or legally compelled by the courts. Although Lindsay and her father were publicly discussing the incident, Ms. Holland didn't do herself any favors by engaging the media. After all of this "hoopla" dies down, she going to have to seek employment and her public disclosures have really diminished her prospects of being hired by another health care provider. She should have been more patient and discussed her options with an attorney, the ACLU or EEOC before speaking to anyone.
