Gets New Lawyer

Oksana Grigorieva has a new lawyer -- #42 by our count -- but she also has a sick feeling in her stomach.

New York attorney Marty Garbus just got approval by an L.A. County Superior Court judge to appear on Oksana's behalf.  He joins attorney Dan Horowitz.

Now for the sick feeling ... Oksana is on her way to a law office for part 4 of her ongoing deposition in the Mel Gibson custody war.  But we're told she feels like crap and may have to pull the plug on the depo.

If she goes home sick, she can get a few pointers from "The People's Court."

Also, on that same video, Horowitz states that OG did not really read the 4 page agreement she signed, nor the other agreement that he states he cannot talk about. I wonder if that's the cohabitation agreement or the custody agreement?

Just caught your messages as I was about to sign off. Maybe this is silly, but I sort of remember that the cohabitation agreement implies that talking about the agreement at all is a breach of its confidentiality on the part of its signees.

Would the attorney for one of them also be kept from discussing it publicly?

Of course, the cohabitation agreement contains language asserting that each party has discussed it thoroughly with their respective counsel, but I suppose Ox would maintain she didn't read it . . . although she dam.ned well seems to understand it on the tapes she made.

I will have to listen to the Horowitz TMZ Live tomorrow.

Midwesterner--I really don't know about the attorneys talking about the cohabitation agreement. It's an interesting point you bring up. Either Horowitz was talking about the cohabitation agreement or the custody agreement, because he stated on that video he could not talk about 'the other agreement.'

Here's an idea: the judge should put the names of all of Oksana's lawyers on a piece of paper and place them into a fishbowl then have security pull one name out of the bowl at random. This becomes Oksana's permanent counsel. All other legal information submitted by other attorneys to court is tossed out. Mel only pays for one attorney and the others have to sue Oksana. This cuts down on court time and expended resources by the state...

I reviewed the May 2010 mediated custody agreement per TMZ. Mel Gibson's legal team did an excellent job protecting his interests. Strict confidentiality was agreed upon by both parties. She gave Mel Gibson the right to "sue her in the ground", if she breached this agreement. If "Ole Greedy" makes any attempt to broker book/movie deals, this provision will certainly be an obstacle. Furthermore, Mel Gibson is a person who makes a living from his public persona and obtaining the necessary releases from him to mention his name or use his likeness probably won't be forthcoming. If Ole Greedy is planning on making a living trashing Mel Gibson, she's going to have a mighty "tough row to hoe" in which she may actually lose her "meal ticket" child. Judge Gordon is obligated to make rulings that are in the best interests of Lucia -- not her "TRIFLING", "GOLD DIGGING" mother. This woman has seriously breached their custody agreement and at some point, she has to live with the consequences whether SHE CAN ACTUALLY GRASP REALITY OR NOT! When you make your BED HARD, YOU HAVE TO LAY IN IT, PERIOD!

The anti-SLAPP you were talking about is mentioned in the McMillan v. Plummer case!!! Since Horowitz and Garbus lost this case, they are going to use the Plummer angle this time for OG. They talk about setting aside the release and voiding it. We got it! Read it!

Terry McMillan is the one of the nation’s best loved authors. Her runaway hit, "How Stella Got Her Groove Back" was a best selling novel and movie. Unfortunately, her husband, Jonathan Plummer decided to inform her that he was attracted only to men and wanted a divorce and a substantial marital settlement. Terry McMillan refused to pay. The case then ended up in the media with brutal attacks against Terry McMillan as she was falsely portrayed as being insensitive to her husband’s "coming out". In truth, gay or straight, it is unfair to marry someone if your love and sexual interest is not with them. To make this point, Terry McMillan sued Plummer asserting that the media campaign was intended to inflict emotional distress and to extort more money from the divorce than he would otherwise have been entitled to. With the recent high profile cases of Britney Spears, Paul McCartney and Christie Brinkley (and perhaps Madonna) in the news, the importance of celebrity privacy during divorce is an important topic. The McMillan case pits these privacy rights against Plummer’s rights to First Amendment speech. Where the courts will draw the line is uncertain. Thanks fuddy. We can talk here until the cows come home, and I believe our posting does have a good effect, but so much is totally out of our control; that's why we have to remember that the outcome is in God's hands.

Garbus HAS to sign on as an attorney for the Child Custody part of this if he wants to get paid!! Mel is NOT responsible to pay for any of Oinky's attorney fees except for the Child Custody case. Oinky doesn't have any money to pay her legal counsel for DV or Extortion cases. Any one's thoughts??

Someone said earlier something to the effect of - if Horroditz claims Garbus as an advisor then Garbus will be paid.

I agree, it's not right that Mel is expected to foot the bill for Ox's fickle and vengeful behaviour. I don't quite get the Californian legal system. There should be a ceiling on the amount of lowers she is permitted. She is making a mockery of the system. No?

They were the #1 tour of 2010! Beat out U2 and AC/DC. Took in over $200 million and they are still going.
