Suspected in Jewelry Theft

Lindsay Lohan has just turned a super-expensive piece of jewelry over to cops that landed her in the middle of a police investigation ... law enforcement sources tell TMZ.

Law enforcement sources tell TMZ ... last week the owner of an L.A. store filed a police report, claiming a $2,500 necklace was stolen from her business. We're told the store surveillance video shows Lindsay in the store, wearing the necklace before it disappeared, although it's unclear if the video actually shows Lindsay walking out of the store with the jewelry.

Cops got a warrant to search Lindsay's home, but last night -- before the warrant could be served -- one of Lindsay's associates turned the piece over to the cops.

Mind you, turning in stolen property doesn't make it right, so the owner can continue to press the case... so Lindsay -- who is still on probation -- is not out of the woods.

The only news surrounding Lohan is bad news. Does she ever do anything right, or anything good, anything for someone beyond herself? I'm beginning to think she may be just a vain, self-centered shallow shell of a person.

Did you take it home with you and not return it till there was a search warrant for your requested for your home? Every picture you see of Lindsay she is wearing different jewelry. She didn't notice that she had a high end piece of jewelry she didn't pay for? Seriously, come on.....

Firstly, it could have been a misunderstanding, so let's not judge anyone without ANY of the facts here. Secondly, yeah, I don't believe it's a misunderstanding any more than any of the rest of the people here. Thirdly, used to be a big Lindsay fan, she WAS a great little actress as a child, but she went off the deep end with drinking and drugs and things seem to go missing around her too. If she did this, AFTER being let off again with rehab etc, then there is no helping her at all and one day in the not too distant future she is going to be appearing in the "in memorium" section of the Oscars. Why can't parents of child actors BE parents to their kids? So many of them are failed actors themselves and push their kids into it at a young age, and then the kids get good and overshadow the parents, but what happened to saying NO, even if the kid is rich and famous. No, you can't attend an adult style party at 14 without me at your side the whole time. No, you can't go to bars, even if it is claimed you won't be served alcohol. No, you DO have to be home by a certain curfew. Shame on Lindsay's parents for allowing this downward spiral to START at such an early age, and shame on Lindsay now, since she is an adult, for continuing it, no matter how much help is thrown her way. No more lifelines for her, send her to jail for at least a year and be done with it, she doesn't deserve any more sympathy from any of us, she's used it all up and thrown it back in all our faces. She needs jail time, it will be like a bucket of icy water to the face, and she needs to be in with the general populace of women and to talk to them and maybe she'll get a clue from them, because most of them are in dire cir***stances that she will never know, they didn't get put in jail for being a trivial, privileged loser.

A necklace is usually clasped around the neck. Kind of hard to say oops didn't know I was wearing it. Then un-clasp the necklace and take it off the neck and still not no you have the necklace and leave the store.

Lo-han behold (my little pun) an "associate" returns the necklace. My God it's a miracle.

The store does not have a case. If the store had knowledge of Lindsay with the property as she was exiting it is up the store to retain the item. The store will claim that they are the rightful owner of items in their store however they relinquish ownership of items to their customers.

They allowed her to leave the premises with the items therefore she is allowed to keep them, that's the law. Even if when she is at a later time questioned by the police she does not have to surrender any items the store had given her previously.

Whatever arrangement the store made with the police to secure items that the store claims does not render Lindsay guilty of any crimes.

The store should have approached Lindsay while she was exiting the store if they believed she was stealing.

The store owner could have planted the item on Lindsay's person and made this entire thing up for publicity.

Lindsay could win a civil suit against the store for liability and defamation.

The police could also be sued by Lindsay for wrongful detaining when they were questionning Lindsay concerning this event. They do not have the right to illegally question anyone without proof.

This would be a VERY easy case for Lindsay's lawyers to win, the law makes it very clear on this particular subject. They let her leave the store with the item(s), they were gifting her the items.

Did they plant the items on her? Were they aware of where their property was at all times? If they were aware why did not they not do something? It sounds very fishy, there's no telling what that store owner was up to, the police should NOT have interfered at ALL. All the police did was open themselves up for a civil suit. The officer in charge will probably lose his job.

Lindsay can sue the store, the county sheriff (or whomever), more specifically the arresting officer and of course the his superior officer.
