Lindsay Lohan: I Was So Damn Busy ...

Lindsay Lohan has an uncomplicated excuse for not returning the necklace that triggered a felony grand theft charge -- she was very, very busy.


According to the police report obtained by TMZ, Lindsay's assistant gave cops this story: "Ms. Lohan was in possession of the necklace and wanted to give the necklace back to the store the day after she took it from the store, but she was very busy."

As TMZ already reported, Lindsay was tipped off that a search warrant had been issued and then had her assistant make a beeline for the police station before the warrant could be executed.

Lindsay's assistant told cops ... before going to the police station she tried returning the necklace to the jewelry store, but no one there picked up the phone.

Interesting note from cops:  "There was no description of the stolen necklace give to Ms. Lohan, yet she gave the exact necklace in question to her assistant to return."

The Jeweller knew before Lindsay left the store that Lindsay had the necklace. There was consent by the Jeweller because he did not ask Lindsay to remove the necklace and give it back. This supports Lindsay's version that it was loaned. The jeweller has zero credibility because he after he had viewed the store's surveillance video falsely reported to Police that Lindsay tried to put the necklace into a box,in order to prove an intent on part of Lindsay to steal. Making a false police report is a felony.Lindsay is not taking the stand at trial if there is one.How can jury possibly believe Jeweller and would find Lindsay not guilty.

The DA cannot prove two elements of theft(1) intent on part of Lindsay to permanerntly deprive Jeweller of the necklace,there is no surreptitious conduct, the item was promptly returned whether Police gave any description of the necklace or not(2) that the Jeweller did not give consent for item to be taken out of the store.

The DA does not have a case to prove beyond reasonable doubt. Its such a waste of time and taxpayer's money.

Nicole (Dina) thinks that if it goes to jury there will be enough "reasonable doubt" not to convict Lindsay. Did Nicole ever think that most of the people in LA are so sick of the Lohan family that they will not even consider "reasonable doubt" and find her guilty just to get rid of the whole freakin' family? Hell, if the Lohan's don't play by the rules, why should a jury? I hope to God I'm on that jury! Who, me? Never heard of the Lohan's (smirk)
