How Lindsay Could Go To Jail Without a Trial

Lindsay Lohan could go to jail for more than a year for allegedly stealing that necklace ... and it could happen without a jury, without a trial .... without grand theft charges even being pursued.

After doing some investigating, we discovered the D.A. could drop the felony grand theft case completely.  But that wouldn't end Lindsay's legal woes -- not by a long shot.

Prosecutor Danette Meyers could go back to court and ask the judge to violate Lindsay's DUI probation ... on grounds she stole the necklace.

The judge in the probation case could then hold a hearing -- without a jury -- to determine if Lindsay did indeed pilfer the jewelry. 

Now here's the big problem for Lindsay.  In a criminal case, the D.A. must prove guilt beyond a reasonable doubt -- in other words, convincing a jury that there's a 98 to 99% chance that she did the deed.

But in a probation violation case, all the judge has to decide is that it's more likely than not that she stole the jewelry -- in other words, that there's a 50.1% chance she did it.

Sources connected with the D.A.'s office tell us ... prosecutors believe they could ask for more than 1 year in jail if the judge decides Lindsay violated her probation.

And one final piece of bad news. It's very possible if the D.A. dismissed the grand theft case, the probation violation matter would go back to Judge Elden Fox in Beverly Hills, who has totally lost patience with Lindsay.

Another day, another dollar -- but not for Lindsay Lohan!

The Mean Girls actress was stiffed by an ATM machine in Beverly Hills on Thursday afternoon after three of her credit cards were denied, leaving the machine with an error message.


"Lindsay was at a pharmacy and tried to take money out of the ATM with three different cards," an eyewitness told RadarOnline.com exclusively.

"Finally she asked for help after the screen flashed to 'call for service' and she realized it was broken."

One eyewitness told RadarOnline.com the starlet was left cashless, despite calling out to the clerk to call for service and have it fixed.

Leaving the question: ATM malfunction, or insufficient funds?

According to the clerk at the pharmacy, the ATM was working perfectly fine all day, until Lindsay got her hands on it.

"The machine has been working fine all day," the clerk told RadarOnline.com.

Regardless of whether you are convicted at trial if you are on probation even a new arrest nevermind a new charge can get your probation violated.
It is completely up to the Judge and Lindsay manages to anger every single Judge that she has.

Four years after the disastrous box office implosion of I Know Who Killed Me, the film’s director, Chris Siverton, is pretty much sick and tired of sitting in career hell. Now, Siverton has decided to tell the world just how sh*tty Lindsay Lohan’s on-set (and, more importantly, the fact that she often wasn’t even on the set at all) behaviour has ruined his own reputation as a filmmaker. In his defense, Siverton had a decent reputation (he won critical raves with his previous effort, The Lost) before crossing ill-fated paths with Lohan, who couldn’t even bother to show herself for the film’s climactic scene. So, they cut/pasted her face onto another actress’ body. Seriously:

"Lohan, who actually played the two lead roles, built a veritable skyscraper of trouble on the set, with numerous stints in rehab and other breakdowns. A shoot that was supposed to take a little more than a month lasted four months. “Most days we wouldn’t know what happened [with her],” Sivertson recalls. “We just found out that day.” Forget quality cinema — it was a Herculean challenge just to get the film made. “At some point it became -how can I complete the movie.’ That was my one and only goal: not to have it fall apart.” (Sivertson’s general tenor, it should be noted, was that he sincerely liked Lohan and working with her and doesn’t want to point fingers at anyone but himself for the final product.)

For his climactic scene, in which Lohan’s characters figure prominently, Sivertson didn’t have the star on set. He tried to postpone the shoot but finally couldn’t delay it anymore. So he located his inner MacGyver: He shot the scene with a body double and then grafted on Lohan’s face in post-production.

Okay, that’s kind of creepy, but it partially explains why the climax was so disjointed and made absolutely no sense at all. Then again, I couldn’t pull a coherent story out of the entire damn movie. However, I will say that the movie’s most entertaining scene occurs much earlier and features Lohan, as the “stripper twin,” getting ready to go onstage for some lusty exotic dance — but then her finger just falls off (she sort of freaks out and then shrugs before sticking her finger/hand into a glove and just dances anyway) — was just amazing in its sheer disregard for, uh, reality. Yet I digress.

It’s worth noting (yet again) that Siverton wasn’t the first filmmaker to feel the ***ulative inertia of La Lohan. Previously, Lohan had been called out (quite publicly as “irresponsible and unprofessional” during the filming of Georgia Rule, according to the notorious studio letter archived at The Smoking Gun) for clubbing all night and then failing to show up on the set due to “exhaustion” and “dehydration.” Naturally, mother/manager Dina Lohan — who took the perspective that a 19-year old shouldn’t be scolded by anyone and simply allowed to do whatever she pleases — jumped to an unyielding defense of her daughter. Five years later, Dina continues to refers to 23-year old Lindsay as a “child.” Insanity of the Lohan family aside, when a “child” or, in this case, a young adult is set to earn an above-average paycheck, I’d say that the bar of expected behaviour should be well above average as well. In other words, Lohan blew it in a huge way, and there’s just no coming back. Unfortunately, she probably took Siverton with her as well. Good times, mates.

I thought Dina was on 20/20, and yeah, she was a joke. She didn't mention that SHE was the one who took her kid out drinking when she was only 15. She didn't mention that she dumped her off alone in Hollywood at age 17. She is still lying. "I grew up in this business. That's all I know." Really? You were a perfume salelady for God's sake. You were NEVER a Rockette. You were never an actress. You never taught dance. you were never a Wall Street analysist You are as delusional as your daughter and that's why Lindsay will never change.

Dina made her go to AA in 06 and put her in rehab in January 2007.
She even tried to put her in rehab again in 08 and was punched in the face by Lindsay according to the Radar Online tapes.
Around February/March in 2009 when Lindsay was missing her alcohol ed classes and the arrest warrant which was later quashed was issued.
Her family again tried to force her to go to rehab but the rehab place wouldn't accept her as she wasn't serious about recovery and would have been disruptive to the other patients.

So yes Dina could have done so much more but i think she tried to help Lindsay as best she could while still trying to maintain their mother/daughter relationship

Dear Harvey,

I see your high school dropouts who wrote this story still don't understand easy legal concepts. In a trial, it's "guilt beyond a resonable doubt". In a hearing like the one described here, the legal standard is "the preponderance of evidence". And, if her probation is violated, the judge who will sit in judgement WILL be Judge Fox; that's how things work in the LA court system. I know you gave up any association with the law years ago, but you should know that...
