Mel Gibson Strikes Plea Deal -- NO JAIL TIME

Mel Gibson has struck an agreement with prosecutors and has made a plea deal in his looming criminal case ... sources connected with the L.A. County District Attorney tell TMZ ... and Mel will not get jail time.

Our sources say Mel will appear in court Friday and will plead no contest to simple battery -- a lesser charge than corporal injury on a spouse. 

As we first reported, Mel had been agonizing over the impending criminal charge -- related to the January 6, 2010 blowout with Oksana Grigorieva -- worried that a prolonged court fight would be a strain on his family, particularly his children.  We're told ... even though Mel believed he could win the case -- he struck the deal to protect his loved ones.

We're told the deal involves counseling but NO JAIL TIME.

When contacted for a response, Mel's lawyer, Blair Berk, released the following statement to TMZ:  "I know from almost 20 years as a criminal defense lawyer that sometimes justice can come for a client at too high a personal price.  That is particularly so for Mel, whose right to due process can only be exercised in this case with an enormous media circus attached."

Berk goes on, "Mel's priority throughout all of this has been that the best interests of his young daughter Lucia and the rest of his children be put first in any decisions made.  It is with only that in mind that he asked me to approach the District Attorney with a proposal that would bring all of this to an immediate end."

And apparently Alexander's recollection didn't involve punching, choking or a gun or else the DA would never have gone for a simple battery plea deal.

But then, we knew that or else DFCS would never have endorced Mr. Mel's custody rights.

Hypothetical Questions, Questions, Questions!

Have we had clues about OG being a LIAR, OG being the EXTORTIONIST, OG being a Sociopath, OG being DILLUSIONAL, a Planner, a Manipulator etc. etc.? (There is only so much cyberspace)!

How did those tapes make it out there? Did OG ignore the order to turn all of the tapes over to the court? OBVIOUSLY. Did OG sell those tapes? IF she sold them, had she planned on selling them from the time she made them? Is it possible OG was paid A LOT of money for the tapes?

Does a person have to go to a lot of trouble to make tapes like that? Would it have taken an incredible amount of collaborative planning with deliberate (care) to make those tapes?
Were there thoughts of making lots of money, by either Extorting MG with the tapes, or by the sale of those tapes to a disreputable news outlet, or both, before,during or after she recorded those tapes?

How many people helped her make those tapes? Did anyone act on her behalf to negotiate a tape sale?

Does anyone ever think about how creepy and malevolent it was to make those tapes over who knows how long a period of time, and how EVIL it was to edit them? Does anyone consider these actions to be PREMEDITATED (Malice Aforethought)?

Does EG know the details of a possible Oksana tape sale? Did someone help and advise her on how to sell her illegal tapes? Could there have been an untraceable negotiation made for the tape sale? If there was money made from the tape sale, could the money from the sale have been deposited off shore, to keep it hidden? Is that possible?

Why would EG bother suing someone who claims to be struggling for money?

Does he know something about her finances that we don't know? If she sold her tapes, who could have helped her negotiate her tape sales? Does EG know who did? And for how much?

Ohhhhhhhhhh the questions.

Good luck to you, Mel. I'll be watching your new movie when it's released and anything you act in or produce in the future. I'm hoping this chapter for you has ended. About Oksana - the more we learned about her, the more it became apparent why you lost your temper with her. Whether the court system finds her guilty of anything or not may be irrelevant as she will never be respected by anyone who has a work ethic and personal intregrity.

Plea bargains are offered to many "regular" people. This would have been a no jail time penalty in Colorado even IF he would have pled guilty to the original charge. Lighten up, guys. Legally smart strategic deal and no, it won't make the custody case more difficult. The courts look at the big picture, not a minor bump... I see 50-50 parenting time and joint decision making with alternative dispute resolution ordered if the parties cannot agree on a decision. Neither party has been on his or her best behavior.

Well, I'm not in Mel's shoes to tell him what to do. It has been a long fight and the grifter banks on wearing him out.

I do feel though that TMZ is not telling it all...Based on the anxiety over at ROL with the KH postings, I feel that there is something in the pipeline against the OX. I hope that I am right and that she's charged with something while Mel takes on this plea deal.

I think he did the right thing. Why subject himself to the media circus. Enough that the Ox was given a platform to spew her garbage. Why would anyone want to subject themselves to that all over again. There was never any justice to what was going on. There was only a total disregard for the law.

As for the poster that says the rich celebs get off easy.....in this case, I disagree. It is because of his celeb status that the Ox got away with all that she did. If it wasn't for his celebrity this thing would have been wrapped up a year ago. The Ox and her 43 lawyers would never have been allowed to proceed as they did.
