Sue Me, I'll Sue You!

Mel Gibson will sue Oksana Grigorieva for extortion if she dares sue him ... this according to sources close to Gibson.

As TMZ first reported, Oksana still plans to file a lawsuit against Mel, alleging battery, emotional distress and defamation.

But sources close to Gibson tell us he will wage legal war if Oksana files -- and will NOT settle out of court. In fact, we're told Mel will gladly file his own lawsuit against the woman he says put a $15 million price tag on the tapes in return for keeping them secret.

Looks like this battle has just begun.

He took a plea deal to make sure it would not go to court and embarrass him. (forget the children excuse he likes to fabricate like he did for why he beat up Oksana)

What an interesting legal theory!

They sentenced him for the crime.

The sentence for him would likely have been about the same if he had gone to court, and he would have been found guilty for a misdemeanor.

The only difference is he avoided having testimony and evidence about him publicly.

In other words, he ran away, and proved he cannot deal with that.

He also avoided it being admitted as evidence already for later suits.

He will settle.

As of today, from the limited information we have, my bets are that Eric George and the retired judges are safe because they would not go along with extortion. The ones who could really be sweating right now are the Manley-Fried attorneys over the June-July period. The Oxtortionist may be personally judgment-proof, but the the MF attorneys could be in serious trouble.

The DA knew they didn't have a winning case in court.

He protected his children from their fear he'd go to jail. I remind you all about OJ Simpson. He was acquitted of murder in the criminal trial and proven guilty in the civil trial. The reverse will happen for Mel. You have a lessor standard to prove in civil court. Hope he opts for jury trial.

That's why the retired judges were there: to make sure everything was on the level. EG had another atty. there in his place.

If OG and DH claim foul play during the mediation, then they have to include the judges. Not wise.

Actually, one of the angles that is bothering me today is Gloria Allred's 'open letter' on ROL that would make children involved separate parties to a domestic argument.

Is she trying to create a separate legal action for children, and whomever has custody of those children, to sue on their behalf?

So, she has emerged from her crypt and put targets on every child? The deliberate endangering of children by every two-bit gypsy scammer who is going to grab a child and wave it in the middle of an argument for secondary civil actions -- for a large cut of settlement money?

She must really want those trust funds. Her new legal extortion angle -- now that her stable of hookers has been exposed.

Mel could move to have the court barred for the sake of the minor child. He could settle but if he does he could also demand as part of the settlement that she start supporting herself and get out of his house. There's alot against Oksana. Such as her behavior. Why didn't she get out of his house he he told her to leave? She forced herself on a foreign business trip where she wasn't wanted. He provided and accepted free room and board. (That would ease anyone's stress) She reneged on the settlement agreement and moved on to obtain more money ($20,000.00 child support a month vs. $5,000.00) She gave out copies of the tape. Whether or not she used a liason for Radaronline, she gave the tapes to someone other than her lawyer. There's no defamation regarding "extortion" because Mel's attorney actted on good faith based on legal advice from a criminal attorney. There's no demafation on the "gold digger" because if she hadn't tape recorded Mel saying it and thereafter released the tapes none of us would have heard of it. And she hasn't supported herself since, at least, she lived in David Forster's house.

And yes, counter suing is a tactic; but you better have something to back it up for it to work.

Finally, I don't believe Mel will have to pay her lawyer because it wouldn't be a family matter. I she loses the bill's on her. If she win's most lawyers charge 40%.
