Lindsay Necklace Case -- No Contest Plea Tomorrow

Lindsay Lohan will officially plead no contest to misdemeanor theft tomorrow -- TMZ has learned -- but Lindsay won't be showing up in court.

Sources connected with Lindsay tell TMZ ... Lindsay wants to show up for the plea, but the cost and craziness associated with a Lindsay Lohan appearance is just too much -- what with extra Sheriff's deputies, court disruption, etc.

So Lindsay's lawyer, Shawn Holley, will appear before Judge Stephanie Sautner to enter the plea.

TMZ broke the story ... Lindsay will plead no contest, and in such cases it's routine a defendant can serve the sentence with an electronic monitoring device at home, rather than doing jail time.

As we first reported ... both Sheriff's Department and the Probation Department sources tell us ... Lindsay would be eligible to serve her 120-day jail sentence with electronic monitoring at home.

Judge Sautner has made it clear ... she's treating Lindsay like any other defendant, so it's likely the judge will allow her the electronic monitoring option.

And, a defendant who serves time at home with an monitoring bracelet gets the same time off for good behavior and jail overcrowding as someone who serves time in the pokey.  And we're told 120 days translates into 14 DAYS.   So 14 days with a bracelet and she'll be off the hook with the necklace!

TMZ will be in court tomorrow.

If she was admitting guilt she would be pleading guilty. She is pleading no contest with presumably no further punishment as part of the plea deal as she was already punished for a VOP due to this incident. She is just disposing of the case.

None of our comments matter. That includes the asses that stick up for Lohan. The California justice system is a freaking joke. She'll be back making movies but I, for one, will never pay any money to see anything she is in. Even if my favorite actor was in it I wouldn't. I know that one person doesn't mean much but it makes me feel better. **** that little tramp. She will get hers in the end. Just wait.

If she lets her lawyer plead in court for her, its a no contest plea, not a guilty one.
That allows her to say that she is still innocent, but recognises that she probably would be found guilty even though she "isn't" and that she wants to put this behind her and go on with her career.
Also it should prevent her from being sued in civil court by Kamofie.

Plus if she gets anymore jail time, she can just bail out of that too. Or serve a week maybe.

Wish she would take it to court , she really needed be cleared of this altogether. That will not happen with a plea . It is like the DUI's , that deal did not work out to well for her . 4 years later and she is still in the mess except it is getting worse each year. She would have done better just doing the time . She can not take any more probation or it will never end. Linbdsay is just too easy a target for people to take advantage of and you can bet there is another vulture out there that
will .

"No Contest" means criminally guilty. The only difference between Guilty and No Contest is that is she plead guilty that could be used to convict her immediately in a civil suit.

With a no contest plea, if the victim filed a civil suit they would have to prove her guilt with eveidenc not her admission in court.

Good for her. In cases like this I think it would be fairer to celebrities for TMZ to put a story in further context, such as quantifying how routine it is. As it happens I trust TMZ when they say something is routine because I've heard Harvey and Jason talk about it on TMZ Live. So I've nothing against the story and think it's probably accurate.

But when you say something is routine, without figures, people are always going to call "celebrity justice" and they're only really going to be convinced it's not celebrity justice with figures that apply to other people. I don't know enough about the availability of court statistics in California, but I'd have thought the internet is the ideal medium. It'd be extra work for TMZ though.

Poor Nicole, the consistent fan and defender of LL, gets verbally beat up all the time for pointing out that this isn't celebrity justice, just the way the California court system works, and there'd be less of that sort of thing is TMZ linked to figures or included light statistics.

It didn't work out well because of that crazy July 6th sentence otherwise Lindsay's probation would have been terminated last year as she completed everything.
Now that it has been reduced to a misdemeanor she can get a reasonable plea deal. She has already been punished for the probation violation and has no chance of winning that appeal so pleading out is a smart decision.

well we will see tomorrow harvey has been wrong a bunch. and Nicole has some great points but has been wrong too. remember she said this would never go to court. and she would be off probation. she is still hanging on by a thread. hate to say it but it is only time before she screws up again. I do believe she should have to pay back the court system. If she is so worried about cost be a regular person and hire security. all you fups have cost millions. and your not worth it
