Big Blow to Defense In MJ Manslaughter Trial

The judge in the Michael Jackson manslaughter trial just undercut a big part of the defense, by ruling 16 hours of rehearsal footage for the "This Is It" tour doesn't show MJ to be in poor health.

Dr. Conrad Murray's lawyers wanted the outtakes to prove Jackson was very ill in the days before his death.  The argument goes -- he was already dying, so Dr. Murray can't be held responsible for his death.

But Judge Michael Pastor ruled ... the outtakes were valuable to Sony Pictures -- which objected to turning over the footage -- and the video did not show MJ in poor health.

If the hours of video show a healthy Michael, it undercuts a major line of defense for Murray.

I saw the movie. MJ did not appear ill. If he was ill, it would have showed up in the movie video footage. The movie showed him practice the day before he died and he gave an outstanding performance.

LOS ANGELES - Jurors in the Michael Jackson manslaughter case will no*****ch previously unseen footage from the singer's final rehearsals to determine the state of his health before his death, a judge ruled Monday.

Superior Court Judge Michael Pastor SIDED WITH A DEFENSE ATTORNEY FOR DR. CONRAD MURRAY who said last week that more than 100 hours of rehearsal footage that was condensed into the film "This Is It" did not show the singer in poor health.

Pastor also agreed with attorneys for Sony Pictures Entertainment that the clips have significant value and should not be publicly shown without a good reason.

"There is absolutely nothing in those materials that could have been of assistance to the defense," Pastor said.

The judge reviewed several hours of the footage last week then canceled plans to travel to Sony Studios over the weekend to finish watching the rest of the film that attorneys wanted to use during the upcoming trial of Murray.

Sony filed a motion Friday citing comments by defense attorney J. Michael Flanagan calling the review of the footage a "big waste of time."

Murray's attorneys wanted to show jurors four hours of film, while prosecutors wanted to show up to 12 hours.

Deputy District Attorney David Walgren said the footage "demonstrated that Michael Jackson was optimistic, engaged, confident, physically well."

Pastor, who has ruled that snippets of the theatrical version of "This Is It" can be shown at trial, said it was unnecessary to show other clips.

"There are materials which I viewed which I would regard as extremely valuable to Sony," the judge said.

The footage could be used later for extended versions of "This Is It."

Pastor warned Flanagan about speaking publicly about the case, scolding the veteran attorney for discussing evidence during a radio interview that won't be presented to jurors.

Jury selection is scheduled to begin on Sept. 8.

Murray has pleaded not guilty to involuntary manslaughter.

Prosecutors accuse him of giving Jackson a lethal dose of the anesthetic propofol and other sedatives in the bedroom of his rented mansion days before he was scheduled to travel to London for a series of comeback concerts.

Defense attorneys have said Murray did not give Jackson anything that should have killed him.

Seems to me that Michael didn’t go to the rehearsals when he wasn’t feeling well. I would imagine when he was at rehearsals he wasn’t conspicuously unwell – he would have been back in his element; shining and in control. Creating, dancing, singing, mentoring – it’s likely he wouldn’t have compromised his reputation. He was slim, he forgot to eat at times due to the excitement of the upcoming show, he wasn’t sleeping properly obviously, he likely was stressed and he had a few ailments that were already diagnosed as well as age-related aches and pains. But was he at death’s door? Not likely, at least that’s not what the autopsy results revealed.

Facts. Conrad Murray was given a job; he performed poorly and had questionable procedures. I don’t know about the conspiracy theories, scapegoat stuff but, bottom line, Conrad Murray was there, he failed his patient due to his own negligence, and the patient died.

RIP Michael Jackson. We are quieter now, but we’re still awaiting justice.

Seriously? why are people so shocked he died? Watch interviews of the man. He wasn't drug free. He asked a Doctor to do what he wanted and because he was a celeb the Doctor did it. Who would say no to him?? MJ killed himself in my mind.

And HE USED TO GIVE WINE TO KIDS DONT FORGET he even said it in interviews.

I like his music but he was no saint. I dont know why people put their heads in the sand.

The prosecution is going to have to prove that Murray gave the fatal dose that killed him. It doesn't matter if Murray gave Michael propofol a million times. What matters is who administered the fatal dose. No one can say that Murray forced MJ to take the benzos either.

I've said it before - I have no idea whether the prosecution has enough evidence. I plan on watching the trial when it happens and deciding then.

But the prosecution is going to have to prove that the deadly dose was administered by Murray.

Thus far, nothing that has been released yet has proven that to me.

I will say it is pretty comical to see people say "justice for Michael". He was the one seeking out drugs, remember? He was doctor shopping and sought out someone to indulge his drug addictions.

Do you think Michael would have wanted you to go after all his drug providers? WTF with the "justice for Michael".. that makes me laugh.

Let's get real here - if it wasn't Murray that MJ conned into being his personal drug mill, then it would have been some other sap.

Murray didn't force MJ to do drugs. MJ was addicted.

Spare me w/the "Justice for Michael" rhetoric - it is pathetic.
