Molestation Evidence in Manslaughter Trial

Prosecutors in the Dr. Conrad Murray manslaughter case want to block all testimony related to allegations that Michael Jackson molested children.

According to court docs obtained by TMZ ... prosecutors want Judge Michael Pastor to bar Steve Robel -- a key Santa Barbara County Sheriff's investigator in the 2005 MJ molestation trial -- from testifying  in Murray's defense.  Robel is on the defense witness list.

In fact, prosecutors want all references to alleged molestation barred from Murray's trial, on grounds it has nothing to do with MJ's death and would merely inflame the jury.

And, prosecutors have also asked the judge to block the testimony of a number of doctors who treated Michael Jackson but were not involved in caring for MJ on the day of his death.

This is a huge motion that could have a profound impact on the case.  As TMZ first reported, the defense will argue that dozens of doctors had addicted MJ to prescription meds -- including Propofol -- and they are largely responsible for the condition Michael was in the day he died.

Judge Pastor has not ruled on the motions.

What in the WORLD does a TRUMPED UP Molestation Case have to do with what Murray gave Michael on June 25, 2009? ZERO, ZILCH, NADA!!
This is exactly why Chernoff and Company were trying so hard to withhold their Witness list. Because they KNEW they had a bunch of people on there who had NO BEARING on this case. And yes folks, whether you love or hate Michael, the LAW doesn't change to cater to your IDIOTIC ideals.....
SO as much as it may break some people's COLD, LITTLE hearts, the Defense should NOT be allowed to trot out every doctor who ever treated Michael for a cold or cleaned his teeth...C'mon now!
If the defense is allowed to parade these past doctors on the premise that they got Michael addicted to meds, they will need to provide HARD EVIDENCE to support that theory. Because believe it or not, you don't get to TRASH someone's LIFE based on RANK TABLOID GOSSIP!! Not sure how people are able to CONVENIENTLY overlook the FACT that the CORONER stated Michael's body showed NO SIGNS OF DRUG ABUSE, and the only meds found in his system were the ones MURRAY gave him--PROPOFOL and BENZOS....
And for the record, there is NO PROOF that Michael was ever given the Propofol and Benzos prior to June 25. We have only Murray's word that he administered those meds to Michael and based on the fact that he LIED TO 3 crucial entities after Michael's death--the EMT's, the UCLA staff, and the LAPD--I'll let you do the math on how much his word is worth....
Bottom line, Murray's lawyers apparently have NOTHING to defend their client with, so they've reverted to type with 2 lines of Defense:
-Blame the Victim on the premise that he HAD to have asked for it by "doctor shopping". Of course, that means most of America is guilty since the average person has a Medicine cabinet chocked full of meds, but noone accuses them of asking to be killed. With this line of defense, you have to remember that there's NO PROOF to support the idea that Michael had ever taken the Meds that killed him in the weeks prior to his death....and NO, it doesn't count that he had been given Propofol for Dental Procedures YEARS ago....REACHING.....
-Blame the Doctors on the premise that they continuously kept him hooked on Meds for their own Monetary gain. Again, you would have to subpoena ALL of their records, then have a Medical team review the Meds versus what they were prescribed for. Thing is, Michael had several conditions that have been clearly do***ented in his book, Moonwalk, and in the Coroner's Report--Lupus, Vitiligo, MINOR inflammation of the lung, and knee and lower back injuries from the past. Anyone who has had any of these issues know that although they're not life-threatening, they do require Meds from time to time. So when the fingers are being pointed at the doctors, all of that has to be taken into consideration which is why I doubt Pastor will want to deal with it. The only doctor who I can somewhat understand being questioned is Klein--not because I think he killed Michael, but because Michael was going to him for facial restoration which does require Meds. But I wouldn't open that can of worms if I were the defense.....
Remember, Klein and all of the doctors on the defense's list were cleared by the DEA, so if the FEDS couldn't find anything......
The thing most people fail to remember about this case is the fact that you can't change the game simply because it's Michael Jackson: as any other Homicide, you have to look at the CAUSE OF DEATH--ACUTE PROPOFOL INTOXICATION--and the people who had access to Michael and that Medication, which in this case is MURRAY!
He even admitted in his deposition to the LAPD that he administered the Propofol that night, but then he later claimed he only administered 25 mgs of it and didn't give Michael anything that should've killed him. Yeah I REALLY believe that. Just like I believe that he only had a TRUCKLOAD of Propofol FED-x'ed to his Hootchie's house in Santa Monica in the weeks leading up to Michael's death. why would he need so much if all he was giving him was 25 mgs per night? And why would he need it shipped to his Hootchie's house, if he was able to store it in that little closet the Police found it in?
Anyone with HALF a brain can figure out that Murray is guilty and his house of CHRONIC, HABITUAL LIES are going to implode on him for sure unless the Jury allows itself to be side-tracked by all of the LAME smoke and mirrors the Defense wants to throw in their path. I just hope Judge Pastor blocks their efforts by passing the Prosecutions' motions. If he DOES allow the testimony of past Doctor's, it still doesn't change the fact that Murray was the ONLY doctor at Holmby on June 25, and he's the ONLY doctor who gave Michael Propofol and Benzos that day....CASE CLOSED.....

after all, mj was desperate to show love to killer boys in the juvenile detention center. how would propofol want to meet its next victim? one victim craved the danger.... another victim will suffer the consequence of worshipping the crime inviter...

And it's going to be televised worldwide. This seems like a horrible, nightmarish invasion of one's privacy, even if you're dead.

Jackson molestation evidence ruled irrelevant to Conrad Murray trial

Los Angeles (CNN) -- Michael Jackson's sexual molestation trial is "no-go territory" for defense lawyers in the trial of Dr. Conrad Murray, a judge ruled Monday.

Los Angeles County Superior Court Judge Michael Pastor, however, rejected the prosecution's request that he not allow testimony from several doctors who treated Jackson in the months and years before his death.

Murray is charged with involuntary manslaughter in the June 25, 2009, death of Jackson, who would have turned 53 Monday.

The defense wanted to have a Santa Barbara County, California, detective testify about drugs found at Jackson's Neverland estate during a search related to the sex charge.

"In particular, it is relevant to the defense that Michael Jackson possessed both propofol and Demerol in his residence as early as 2003," the defense said in a motion filed Monday.

Los Angeles County Deputy District Attorney David Walgren argued testimony about drugs Jackson possessed in 2003 "has absolutely nothing to do with the standard of medical care" Murray gave Jackson the day he died on June 25, 2009.

Bringing up anything about the molestation trial, which ended with Jackson's acquittal, would be "character assassination on the victim," Walgren said.

Defense lawyer Ed Chernoff, in a hearing Monday afternoon, assured the judge that he did not intend to question the detective about the sex charge, but only about drugs he found in his search.

"In particular, it is relevant to the defense that Michael Jackson possessed both propofol and Demerol in his residence as early as 2003," the defense said.

Murray's defense lawyers want to argue that Jackson was addicted to the painkiller Demerol and was undergoing withdrawal from the drug when he died, Chernoff said. He said he expects the prosecution will say he "merely liked Demerol" and was not addicted.

Jackson's "past drug adictions, use desires, possessions" is relevant, Chernoff said in court.

Pastor ruled that the events were too far in the past for this trial and could mislead the jury.

"Anything having to do with the year 2003, any incident with Neverland, Santa Barbara, medical doctors, fundamentally is irrelevant," Pastor said. "It proves absolutely nothing with regard to the year 2009."

Pastor ruled that Beverly Hills dermatologist Dr. Arnold Klein could not be called to testify about giving Jackson Demerol shots. Testimony about Jackson's visits to Klein's office in the days before his death could lead the jury "down the path of prescribing to Dr. Klein some sort of criminal culpabilty in the death of Mr. Jackson."

However, Klein's medical records can be used in the trial, he ruled.

Two of Klein's office employees also cannot be called as witnesses, he ruled.

Prosecutors in the trial of Murray, Jackson's last doctor, had asked the judge to exclude or limit the testimony of 26 witnesses Murray's lawyers said they might call.

Pastor has indicated he would keep the trial limited to what happened the last several days of Jackson's life. His decisions on the prosecution's request to limit witnesses indicate how tightly the judge will limit the defense arguments.

Other witnesses the judge said the defense could not call include John Branca, the lawyer who became executor of Jackson's estate after his death. Nothing about Jackson's finances can be considered, he said.

The Los Angeles coroner has ruled that Jackson's death, which occurred June 25, 2009, was caused by an overdose of the surgical anesthetic propofol, combined with other drugs.

Prosecutors have accused Murray of having a role in the overdose. Jury selection is scheduled to begin on September 8, with opening statements expected to be heard on September 27. Lawyers estimate the trial will conclude in early November.

I don't know where that $125 million figure came from. MJ had a payment due of over $200 mil I think around Dec 2009 just on the ATV catalogue alone. Plus plenty of other debts. I believe the $400+ mil figure is the accurate one.

I agree Marie. That's why I was shocked when the judge announced his decision to televise. There's just too much personal info involved in this case. If it were a civil trial, it would be a different story. But this smacks of using MJ as "entertainment," and I condemn it.

Perhaps the only bright spot is that, unlike the 2005 trial, the public will get the facts firsthand instead of distortions and half-truths via the prism of the media, and people will feel that the jury verdict is just, instead of forever harboring doubts about it.
