Sue Capitol for Royalties

1118_alvin_chipmunks_NBC_exTalk about a squirrel chipmunk trying to a get a nut -- the creators of Alvin and the Chipmunks have sued Capitol Records for 4 years of royalties on the high-pitched hitmakers' songs.

In the lawsuit, Bagdasarian Productions -- the people who created Alvin and Co. back in 1958 -- say they conducted an audit of royalty payments made to them between 2005 and 2009 ... and their results showed the 'munks were getting shafted.

Bagdasarian Prods. say they own all the Chipmunk's performances -- including classics like "On Top of Old Smokey," "Polly Wolly Doodle," and "Swing Low Sweet Chariot."

According to the suit, they're supposed to be paid about .09 for each song that's reproduced or distributed -- OR about .02 per minute of playing time. It all adds up.

Bagdasarian is demanding a full accounting and damages for breach of contract.

This can all be traced to EMI! Former owner: Guy Hands, (Great name.), was found out to have been dipping into the company cookiejar. The Chipmunks have every right like any other performing artist to sue! Their songs have been pressed out non-stop since 1958. This Christmas.. It won't be Chestnuts, that The chipmunks will be roasting on an open fire! Get ready to pay Capitol!

Record companies cheating? How could that be? Wait a minute..I thought all the money collected by the record companies was used for promoting the record, paying executive salaries, paying overhead, paying the bookies, and buying drugs, but never heard the money actually went to the bands or artists.

Ross Bagdasarian Jr. is no fool!He studied Law in College. When he brought back The Chipmunks.It was a labor of love, to his late father. That's his family's legacy, and he will make sure they get their due. They are American Icons and should be protected like any other property. Univesal and Fox Studios found out the hard way. When they tried to double cross Alvin!!!!

Which party pays for this if it turns out that the first accounting was right? Probably the Plaintiff Chipmunks, but until then the Defendant Record Company will have to foot the bill for a mutually agreed to forensic accounting firm. The costs for this and the possibility of owing more may induce a quick settlement offer from Defendant Record Company. THIS IS LEGAL FLEECING IN A RECESSION ECONOMY.
