'90210' Co-Star Stole

$200,000 from Me!

has declared war on a former "90210" co-star who allegedly screwed him out of $200,000 ... and the accused happens to be the mother of his 9-year-old kid.

B.A.G. has filed a lawsuit against Vanessa Marcil-Giovinazzo -- the chick who played Donna's troublemaking cousin on the show -- claiming he let her BORROW a ton of money back when they were dating ... but she NEVER paid him back.

In the lawsuit, filed in L.A. County Superior Court, Green claims he fired off check after check after check to Vanessa ... but insisted "the monies were not gifts" and she promised to pay him back.

Green claims in 2000 -- BEFORE he knocked up Vanessa -- he loaned her up to $50,000 at a time ... and in total, lent her more than $200,000.

In the docs, Green says each time he loaned her money, he and Vanessa agreed that she would pay back the money "promptly" whenever he asked for it. Green says he came calling in November 2011 ... but she refuses to fork over the dough.

Green is demanding all of his cash back -- plus additional unspecified damages.

Calls to Vanessa's rep have not been returned.

According to California Code of Civil Procedure § 337, the statute of limitations for debt related to a written contract is four years, and an oral contract is two years from the date of breach.
I think 11 years is a bit past the statute. Does Green even have a lawyer to advise him?

She supposedly "Borrows" the money repeatedly and he keeps writing "check after check"? Sounds like the judge will just render him DUMBASS WALKING.

Also sounds like someone smoked a lot of weed and got creative as to how to make some quick cash. What's the matter BAG? Your career tanked and Megan Fox didn't turn out to be the meal ticket you hoped for??

I see this kind of cases on Judge Judy all the time (obviously not as big as this money). And she always throws them out. Why? Once you sleep with the partner, the loan is forgiven. The fact he admits that he gave her the money before they dated is just laughable.

Poor Brian....he may have to lick his wounds on this one. According to California Statute of Limitations (SOL) for debt collection this lawsuit seems kinda 'null and void' as California's debt collection laws state that all states have time barred debt laws including California in which creditors have from 2 to 4 years to file a lawsuit to collect on a debt. Two years without a written contract and 4 years with a written contract. If a written contract was used, Mr. Green may be able to recover if he filed something and was awarded a judgment some years ago. He can try to collect the debt for 10 years with the possibility of a renewal request. However the debt appears to be 12 years old as it was taken out in 2000. I guess trying to humiliate Ms. Marcil publicly is one way to reach an amicable agreement but it appears to be a stretch to me. If Mr. Green hasn't sued her before or tried harder to get the money in a more timely manner...why do it now? Isn't it time to let go and move on?

Good luck on this one Brian....statute of limitations (SOL) on debt collection in the State of California is 4 years on a written agreement and 2 years on a verbal. The debt was incurred in 2000, that's nearly 12 years old. Good luck! No matter how famous you are, statute of limitations limits you on how long you can go after someone for a debt. Just because you're Brian Austin Green, doesn't give you a right to rewrite the laws. If you let Ms. Marcil 'screw'(literally) you out of nearly $200,000 dollars and didn't pursue the matter in a court of law in a timely manner....no harm, no foul....kiss it goodbye!

people are so stupid you think he would have asked for advice from someone who handles his money or his banker before forking over even $1,000. Let this be a lesson to people dont ever give your significant other a good amount of money with out talking to someone first and especially a girlfriend.

Why is everyone so quick to say Brian can't pay child support that's why he's suing her? If anyone verified anything they would know that Brian has primary custody of their son and doesn't pay her any child support. He's also made 60 million from BH90210 I doubt this is a money issue.
