Felony Charge

Russell Brand claims he was provoked by the paparazzi last Monday when he grabbed a photog's cell phone and threw it through a window -- and he's going to use provocation to fight any charge that might be filed against him ... sources close to Brand tell TMZ.

Brand was arrested Thursday for a felony, since the value of the window and the iPhone exceeded the $500 minimum for the crime.

Brand has hired a high-powered New Orleans lawyer -- Robert Glass. We're told if Brand is officially charged with the felony, Glass will argue that the damages were less than $500 -- Russell paid $240 to fix the window, and we're told Russell will claim damage to the iPhone was minor.

Brand is free on $5,000 bond.

Hope this makes celebs think twice before having such temper tantrums. Paps are very annoying but dealing with them is the price of fame. There are classier ways. Most celebs manage it.

And yes, if you smash windows and try to destroy a several hundred dollar phone, there are consequences in the real world. Surprising that he wasn't more careful since he's deportable and has broken the law before. That's why he had some trouble getting into Canada.

The man appears to be consistent - he always looks like an unkempt smelly little wheezer.

If you're going to add him to the prison population (prior to deportation), could you at least first run him through a carwash and perhaps a de-lousing tank?

A couple of things.

He threw the phone through the window of a law firm, where somebody was working. He had no thought of hurting someone. It's just lucky the glass did not cut someone.

An old building in New Orleans could have very well had the original glass. A 240 dollar replacement is not the same kind of glass. He was lucky, especially considering it was a law firm, that the owners did not push for historically accurate glass. Not that he could not afford it, but it could have easily put it over the line of felony.

He's an A@@. Why isn't he England's problem?
