Spike Lee is taking major heat for jumping into the Trayvon Martin controversy by retweeting the wrong George Zimmerman's home address. Great way to start a lynch mob, right? Now, Spike's screw up is sparking an Internet race war ... and tension in the TMZ newsroom.

Florida Statute, Title XLVI, Section 776.013, (3) defines “Justifiable use of (deadly) Force” as “A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.”

Primarily, Zimmerman was engaged in unlawful activity. Florida Statute Title XLVI, Section 843.08 states “A person who falsely assumes or pretends to be sheriff… or watchman… and takes upon himself or herself to act as such… commits a felony of the third degree…” Zimmerman was at the time of the incident allegedly not a commissioned watchman and was representing himself as such prior to and at the time he pursued Martin.

Arguably, Zimmerman also neglected to stand down despite issuance of such advice from the Florida Bureau of EMS dispatch that represents the Florida Police Department. Title XLVI, Section 843.06 states “Whoever, being required in the name of the state by any officer of the Florida Highway Patrol, police officer, … or watchman, neglects or refuses to assist him or her in the execution of his or her office in a criminal case, or in the preservation of the peace… shall be guilty of a misdemeanor of the second degree.” Zimmerman neglected to heed the advice of a representative from the Florida Bureau of EMS failure to stand down from a do***ented instance of investigation constitutes Obstructing Justice. When he called 911 the incident officially became a matter of Law Enforcement jurisdiction.

The second argument calls into question the authority of a Florida Bureau of EMS dispatch representative and if their instruction constitutes a requirement, but it does not discount the fact that they are commissioned by the State of Florida and were the beginning point of contact for a police investigation in which Zimmerman subsequently interfered by disregarding to prior advice to halt his illegal pursuit of Martin.

Martin allegedly expressed to a third party via telephone at the time of the incident that he was “being followed” which causes reason to believe that it was actually Martin who “held a reasonable fear of imminent peril of death or great bodily harm” as required by Title XLVI, Section 776.013 (1). Zimmerman could have had no reasonable fear of death of bodily harm from Martin if Zimmerman had remained in his vehicle. Martin, not being the one who was acting unlawfully at that time therefore would have had justification to “stand his ground” after Zimmerman exited his vehicle and began pursuit. The statute does not designate specific time or distance limitations on the use of deadly force in such situations. This instigation of pursuit is corroborated by Zimmerman’s alleged admission that he had momentarily lost track of Martin after Zimmerman had exited his vehicle. It is important to note that Martin did not initiate the altercation by entering or threatening the vehicle that Zimmerman was occupying. It may therefore be deduced that Zimmerman did instigate the attack by initially pursuing Martin thus giving Martin reason to presume that an attack by Zimmerman was imminent making Zimmerman guilty of threatening and attacking Martin.

Unfortunately, we do not have the official testimony to review but if what is coming out from major media publications is remotely true, Zimmerman is defiantly the unlawful attacker and Martin was the innocent victim. Whether or not the exception to the Castle Doctrine applies is irrelevant because Zimmerman was clearly the perpetrator of the event that caused the death of Martin.

Wow. I couldn't believe Raquel's comments around 28:40 about Spike Lee and Zimmerman. Who is she, and where did she grow up? I saw no understanding by her of the situation or due process - only the fact that Zimmerman is guilty (according to her) and it's OK for a mob to dole out vigilante justice. I was shocked when you asked "do you want someone to shoot him?" and Raquel replied "hey, I mean, whatever it calls for." Can you really continue employing this ignorant racist hater?

Just wondering, is it ok for members of your staff to condone lynching? I come to your site and watch your show for light entertainment. Imagine my surprise when I watched TMZ live the other day and saw a member of your staff, a woman who consistently makes racist comments and gets a pass because she is African American, say she thought lynching George Zimmerman was an acceptable response to the Trayvon Martin killing. Sans complete evidence, or anything resembling that silly concept of "rule of law." While the hosts of the show quickly said they didn't condone this, I'm wondering what disciplinary steps were taken. If a white person, or even worse, a conservative white person had made those comments about a black person I have no doubt they would have been fired very publicly and swiftly. Please let me know what disciplinary steps were taken, as I am very interested. If your wondering if anyone was offended, yes. Yes I was.
