The drummer for the Grammy nominated band OneRepublic will not be prosecuted for allegedly attacking his ex-girlfriend and destroying her cabinets in a late night rampage back in May ... TMZ has learned.

Edward Ray Fisher was arrested on May 15 -- while sporting a bloody gash in the center of his forehead -- after his ex says he busted through a door in her home and pushed her through her cabinets.

Fisher was facing charges for  destruction of private property, disturbing the peace and assault.

But now, the Denver City Attorney tells us there is NOT enough evidence to prove he committed a crime -- so the City Attorney is urging the judge to dismiss the case ... which a judge will do as soon as he or she gets the paperwork.

Hours after the initial incident, the alleged victim insisted the relationship was dead -- it's unclear if that's still true.

This is really disgusting. Not that a guy was going to be prosecuted for DV, but the fact that in Denver if your sex happens to be of the Male persuasion and the police are called to the scene for ANY sort of disturbance involving two persons whom at ANY time were involved in a relationship or lived together it's an automatic arrest. The truly disgusting part is it's also an AUTOMATIC prosecution in Denver because it's a huge political soapbox to prosecute males for DV irregardless of whom was actually guilty in the situation the man or the woman or both. The ONLY reason this guy is not being prosecuted is because he can afford an attorney. If he weren't famous his a$$ would be going to court or to trial... worse yet if he were broke and were given a public defender they would automatically tell him to plead guilty if it were his first offense, claiming guilt or innocence doesn't really matter in these types of situations and he'd make it easier for everyone involved by pleaing guilty and taking the punishment involved in DV, which includes being listed on a registry for DV, I.E. cannot purchase or own firearms EVER again, pay for an attend a DV class and paying approx $1000.00 in fines to the city along with possible jail time. The whole DV system in Colorado is a joke and is highly biased against men. This guy probably has no idea just how lucky is is today!
