0816_mitt_romney_letter_launchMitt Romney's been engaging in illegal activity -- playing the rock tune "Panic Switch" on the campaign trail without permission from the band Silversun Pickups -- this according to the band which fired off a cease and desist letter to the candidate today.

According to the band's frontman Brian Aubert, Romney has been using their 2009 hit ... even though no one ever asked them for permission, but it's pretty clear he wouldn't have gotten it even if he asked.

Aubert says, "We don't like people going behind our backs, using our music without asking, and we don't like the Romney campaign. We're nice, approachable people. We won't bite. Unless you're Mitt Romney!"

TMZ obtained a copy of the cease and desist, in which the band points out this also happened in 2008 ... when Sen. John McCain was sued by Jackson Browne for using "Running on Empty" without permission.

According to the letter, Republicans promised to "respect and uphold the rights of artists and to obtain permissions" after that debacle.

Aubert also says Romney's a victim of irony ... because "he is inadvertently playing a song that describes his whole campaign."

Leftist Silversun Pickups made a lot of money from republican or independant leaning consumers . Can this reckless Leftist Music Group (Silversun) Dictate their Ideals to their own consumers through lawsuits ?

The Attack Against Mitt Romney (from Leftist Silversun Pickups Sounds) to be a Reckless Attack or Claim based (Maybe) on their left leaning Ideals.

If a Music Group does Not want a Political Party or Movement to be played at events (from conservative ,free market capitalism ORliberal collective, socialist events) The Music Group SHOULD Put On their Record Label or Album a Disclaimer that 'more or less' Reads "This Music Group .... does Not Support this Ideal...", Therefore It Would Be Fair For ALL PARTIES Involved (This Music Group and The Party or Ideal)..

The Consumer then can make a decision to Buy the Album and the Music Group has the Right to Discredit that Political Party or Ideal from Using their Music.

Its illegal to use other people's work without their permission. Period. Believe it or not, not everyone's life goal revolves around making money. Perhaps being associated with someone like Mitt isnt something they want regardless of money, and who can blame them. There is something to be said for taste and principles.

Not period. Compulsory license. Look it up. All the Romney campaign has to do is purchase a compulsory license, and they are cleared to use it however they wish, regardless of band permission.
