Anka Gets 50% of Publishing Rights

10/12/2009 8:50 PM PDT BY TMZ STAFF

Paul AnkaMichael Jackson's estate just got a partner it didn't bank on -- because we've just learned Paul Anka is now a 50% partner in the publishing rights to "This Is It."

Anka will get other profits as well, but the publishing rights are usually the big ticket item, and sources say Michael Jackson's estate has agreed Anka gets 50%.

It's amazing ... when Paul Anka woke up this morning he had no idea he'd get the same cut as Jackson's estate. Sadly for Sony ... they didn't know either.

I just saw the clip where Paul Anka says that Michael stole the song and that McClain said no wonder the song was so good, that's because it's not the type of song that Michael would write. WTF!!!! Why is he being trashed???? First of all, Michael isn't here to give the other side of the story as to why he took the tapes. Second of all, this is more of a lounge song, not a brilliant MJ song. Anka is happy to get some publicity in his advanced age.

You guys don't know much about the music business, Sony or Paul Anka for that matter.

Anka rightfully owns half that song and should be paid accordingly. Its not greed, and its not all about the money. Its about getting credit for HIS creativity and what is rightfully his.
Glad the estate cleared that up fast.

PS- for those that asked. Paul Anka was a 50's teen idol had a few hit songs of his own and has had a very long successful career as a songwriter and performer. He wrote, "My Way' that Frank Sinatra wnet on to sing and make his own hit.

How is this Sony's fault? Michael said the song was his and must have had it published under his own name. How are they suppose to know who wrote the song if no one told them. If the song was published by Jackson he claimed he wrote the song and therefore, he ( his estate) owned it.

Also- If you think Micahel wasn't greedy and didn't care about money- ask Paul McCartney if he would agree. Michael was just as greedy as all the rest of them. But who could blame him- Janet was the only other member of the family that had a full time job.

Randy Jackson gave this song to John Mclain to hand over to Sony, apparently he found it in a box, saw This Is It and thought $$$$. John Mclain tried to get MJ back with his bros in 01/02' when he was assisting MJs manager at that time. MJ obviously wouldnt agree to ever do anything with his bros again. Mclain being a friend of Randy got the deal for the bros to sing backup on the Sony released single.

This is interesting. So Randy gave the song to McClain? May I ask where do you know it from?

I totally agree, but he doesn't have to trash Michael in the process. Very disrespectful.

Oooooooo....I hear laughter in the rain
Walking hand & hand with the one I love
Oooooooo....How I love the rainy days
And the happy way, I feel inside.

Sorry, just felt the urge to belt out some Paul Anka there! :)

There is more here than just the songwriting royalty. It sounds like Sony didn't even have the rights to publish this song, and never got publishing clearance from Anka. Also sounds like Paul was the producer on the original track. Glad he got it all cleared up and is getting what he is due....and didn't end up like John Landis, who before Michael's death, was owed over $10 million dollars in royalties on the Thriller video as 50% co-owner, and is probably owed millions more now after his death. Hopefully he'll finally get paid from the estate.

Duh Sony, you stupid morons!!! No way you didn't realize this would happen! You did this on purpose for the publicity, didn't you? And dug Michael's name through the mud in the process? SHAME ON YOU! Branca, McClain, don't tell me you were that stupid! Have you been in the Entertainment industry this long to claim that you didn't know and Sony had "no idea" and then the fans figured it out in 10 minutes? Please! We weren't born yesterday!

ok

3. Why should the Jackson estate have to pay for Sony and Branca's screw up? Let Sony and Branca pay Anka, they're the ones that were greedy and did this song.
If MIchael were alive, he would not have allowed this to happen.
I don't believe for a minute Michael would "steal" a song, the guy was brilliant.
Plus, Anka, why didn't you keep this matter private? Again, another person dragging Michael's name through the mud to make a dime

A lot of Michael's song were co-written or not written by him at all....if you're only going to be purchasing songs that were written by Michael alone, your collection is not going to be very large.

Miss U MJ

I think we can all agree that Michael would not have approved this song for release, he was too much of a perfectionist with his final products, he never wanted to disappoint his fans. Also, he would not have done a song with his brothers. It pains me to imagine what he would have thought of this song being released in this raw form. I would almost say that Sony in a bad way is paying MJ back for what they consider misdeeds by MJ, ie, leaving Sony, but then on the other hand they want to make a profit off of him, so no. But I do believe that MJ did not know this would be released. I think when the truth does come out about Sony, AEG and their involvement with Murray and all of the other wrongdoers, it will vindicate all of MJ's supporters. There is something, like Michael said, very evil about Sony, etc.

Sorry, but RANDY gave this song to McClain? If this is true and Randy did not check out the song (nor did McClain, Branca, or Sony) then SHAME ON ALL OF THEM! Branca was working for Michael when he collaborated on this song with Anka! WTH????????????????????????????????? Michael must be looking down from heaven and shaking his head in shame and disgust. At ALL OF THEM! How moronic can you get? You'll never convince me that nobody had a clue this would be the outcome. NEVER!

9. Sadly, for Sony---are you kidding me? This shows how greedy Sony is. They screwed up big time, they should pay for this.
Why does the Jackson estate have to pay, Branca screwed up royally, he knew MJ did this song during Thriller.
Let Sony and Branca pay Anka, leave the Jacksons out of this, they had nothing to do with it.
GREAT JOB SONY-----AGAIN i NEEDED A GOOD LAUGH
