Anka Gets 50% of Publishing Rights

10/12/2009 8:50 PM PDT BY TMZ STAFF

Paul AnkaMichael Jackson's estate just got a partner it didn't bank on -- because we've just learned Paul Anka is now a 50% partner in the publishing rights to "This Is It."

Anka will get other profits as well, but the publishing rights are usually the big ticket item, and sources say Michael Jackson's estate has agreed Anka gets 50%.

It's amazing ... when Paul Anka woke up this morning he had no idea he'd get the same cut as Jackson's estate. Sadly for Sony ... they didn't know either.

How exactly is the estate screwed? Saying that the estate and Michael got screwed is like if I went into a store, gave them $1.00 to purchase something for 50 cents and they gave me back 75 cents change, and called me back before I got out the door to give them the mistaken 25 cents back. It would be warped thinking if I think I got screwed out of 25 cents that was never mine in the first place.

46. I'm confused about something. If Sony released this song & is the one responsible for screwing up; haven't they actually cost the 'Jackson' estate money. Won't they get 50% less royalties because of this than they would have had this been only MJ's song. So hasn't Sony once again screwed Michael Jackson?

Good evening janala14 and all,

I agree with you janala14, Sony once again! Michael hated Sony. Thanks for the clip before of the Thriller speech where Michael tells of the hatred he had for Sony and Mattolla. They used him and threatened him, hence we are where we are now. Michael does not deserve this and I am sick of the vultures that always seem to hover around him at the most oppotunistic time.

Love and justice for MJ

56. You guys don't know much about the music business, Sony or Paul Anka for that matter.

Anka rightfully owns half that song and should be paid accordingly. Its not greed, and its not all about the money. Its about getting credit for HIS creativity and what is rightfully his.
Glad the estate cleared that up fast.

PS- for those that asked. Paul Anka was a 50's teen idol had a few hit songs of his own and has had a very long successful career as a songwriter and performer. He wrote, "My Way' that Frank Sinatra wnet on to sing and make his own hit.

How is this Sony's fault? Michael said the song was his and must have had it published under his own name. How are they suppose to know who wrote the song if no one told them. If the song was published by Jackson he claimed he wrote the song and therefore, he ( his estate) owned it.

Also- If you think Micahel wasn't greedy and didn't care about money- ask Paul McCartney if he would agree. Michael was just as greedy as all the rest of them. But who could blame him- Janet was the only other member of the family that had a full time job.

YOUR RIGHT!! I don't know much about the music business so could you just simplify this PLEASE & say who is responsible for this mess? "WHO"?? If MJ had it published under his name them would it be Michael? Who's fault is it if not Sony. Just a simple answer if this can be answered simply? As I read the posts, it seems everyone has a different take on this.

22. They did not need this song for the cd or the movie. They could have used any other song. It was not going to be part of the O2 concerts. Branca and McClain just cost the estate a boatload of money by their mistake.

Posted at 8:13PM on Oct 12th 2009 by Anne

branca and mcclain didnnt cost the estate a damn cent jackson took the song from anka they paid an outstanding debt out of the estate a debt owed to anka a debt like any other debt
and it also put money in the jackson bros pockets

Hey janala14, did you see the video I posted at #52 with MJ speaking before throngs of his fans about Sony and "devilish" Matolla? This is about as mad as we have seen MJ, makes me chuckle when he uses that term! For all that have not seen it, here it is:

Michael understood about publishing rights obviouusly. He owned alot of them. So if he was here - he would have known he wrote the song with someone else. I think the story goes the Jackson Family knew of the song and the song was completed but perhaps didn't know it was co-wrote with someone else. Michael would have wanted Anka to have the acknowledgement and the $$. Right is Right.

That's funny. Paul Anka tours 35 weeks out of the year to sold out audiences. Could have retired on the money he made from My Way alone, never mind all the other great classics he has written for himself, other artists, films and tv, and is still around and out there after 50 years, still making and writing music and is one of the most respected entertainers in the industry. He doesn't need Michael Jackson publicity. And if Michael took the tapes when he wasn't suppose to, why is it trashing to tell the truth?

50. I just saw the clip where Paul Anka says that Michael stole the song and that McClain said no wonder the song was so good, that's because it's not the type of song that Michael would write. WTF!!!! Why is he being trashed???? First of all, Michael isn't here to give the other side of the story as to why he took the tapes. Second of all, this is more of a lounge song, not a brilliant MJ song. Anka is happy to get some publicity in his advanced age.

28. Just wait till Michaels mom gets ahold of this LOL there is gonna be a lot of stuff coming out from the Jackson camp. I bet she goes to court again to have a certain lawyer removed from the estate and replaced with her.......this is far from over.

30. What's really sad is that Michael trusted Branca and Branca screwed up BIG time for the Jackson estate. To be fair, since the Jackson's had nothing to do with this, Branca should pay 25% out of his pocket and Sony pay the rest.
This shows you what greed does to a person/company.
Plus, this was only a demo, MJ would have never approved this song this way, he would have perfected it and also put Anka's name on there.
Sony was in such a big hurry to start watching those dollars come in, but as Michael sings hehehehehehehehe.

It is simply unbelievable! Once again Sony ready to Michael, even after he no longer here with us. If it's music was stored for so long is because Michael did not want to launch. Sony, even after the death of Michael does things that he would not like. This song was "found" and he talks THIS IS IT decided to launch the wave of the movie. Surely who should pay for 50% of the rights is Sony, as the rush did not examine whether the music was just Michael. How much incompetence!

I'm afraid Anne is right. Anka should have recorded it it he wanted it. This was not Michaels mistake, he did not put this out in the public. Sony, MJ's brother & who else did. They knew, therefore the payoff should come out of Sony, not MJ's estate. Are you telling us that every F@#% up that Sony makes from now on the Estate has to pay, I think NOT. Sony, retract this song and give it to Anka, Michael would have beed mortified to have this out there for his fans to hear. We love anything with MJ's voice on it, but we have so much respect for him that we would not buy or listen to something that he would not want us to listen to.

Much love for MJ

39. Paul had the estate by the ____ because the cds are already made the movie is already made. They had no recourse but to give him whatever he wanted and shut him up before he made any more negative publicity. It should NEVER have been released. It is Branca and McClains fault not Sony unless they created the song as employees of Sony istead of employees of the estate. McClain produced the song for Sony. Branca was responsible for the copyright checking. I wonder if you can sue the trustees of your estate for messing up>
