Dr. Murray's Defense - Jackson Killed Himself

TMZ has learned Dr. Conrad Murray's legal defense is that Michael Jackson gave himself the fatal dose of Propofol.

Multiple sources familiar with the strategy tell TMZ the defense argument goes like this:

- At around 10:50 AM, Dr. Murray gave Jackson 25 mg of Propofol from a 20 ml bottle -- that's only about 1/8 of the bottle.

- The dose Dr. Murray administered would keep someone asleep for only 5 to 10 minutes, but the Propofol, along with the Ativan and Versed that was already in MJ's system, had a synergistic effect that put Jackson to sleep for a longer period of time.

- For the next hour, Dr. Murray stayed in the room and was on the phone for much of the time. Dr. Murray didn't leave the room to make the calls because MJ liked activity in the room, regularly sleeping with the lights on and cartoons blaring on the TV.

- At around noon, Dr. Murray left the room for approximately two minutes to go to the bathroom. While he was gone, the defense believes Jackson suddenly awakened and was frustrated he had spent nearly 9 hours trying in vain to sleep. The defense theory -- Jackson took the 20 ml bottle of Propofol and self-injected the remaining contents through the IV, causing a massive overdose that stopped his heart.

- Dr. Murray walked back in the room and saw Jackson with his eyes open and pupils dilated. Dr. Murray dropped the phone (he was speaking with his girlfriend) and began administering CPR.

The defense will argue Michael Jackson was a long-time Propofol addict -- something TMZ first reported shortly after the singer's death. As one source said, Jackson liked the sensation of Propofol being administered by IV, adding, "Michael liked to push it."

L.A. County Coroner's investigators took a picture in the room, showing an empty Propofol bottle on the floor, underneath the nightstand by Jackson's bed. The defense will argue Jackson grabbed the bottle from the nightstand, injected himself and then dropped the bottle.

Remember, law enforcement believes Dr. Murray hid bottles of Propofol before paramedics arrived. The defense will argue ... if Dr. Murray was really hiding Propofol, he would have removed the empty bottle under the nightstand that caused Jackson's death.

Ed Chernoff, Murray's attorney, could not be reached for comment.

WHO THE HELL CARES WHAT Dr. DEATH says? The autopsy report says: "Lethal amount of propofol administered by ANOTHER. It was very explicit, noting that MJ could NOT have injected himself considering the fact that the drip was placed in his leg, by his shin. You haters do all the wishful thinking you want that MJ killed himself. With all the drugs prescribed to him by numerous doctors, he could have done this years ago if he wanted to, he did not need the propofol. There's no way Murray will get away with this, try as he may. He is such a COWARD!!

So the Propofol bottle on the floor under the night stand has MJ's fingerprints on it?

The jury will reject the premise that MJ was a hopelessly addicted and/or suicidal drug fiend, but they might buy that he could have nonetheless accidentally killed himself. Impaired by the other stuff in him, he screwed up the dosage when he was awakened by the sound of silence.

The apparent fault in Doc Murray's defense is that if Doc Murray honestly believed that the Propofol had not caused MJ's demise, then it was the other stuff. If there was so much other stuff in MJ to cause him to die, then how could he have awakened to give himself the fatal dose of Propofol?

The resolution is that Murray didn't realize MJ had self-administered the last 175ml of Propofol. That explains why the bottle under the night stand was missed during the initial cleaning of the scene. It explains why Murray concluded the other stuff did it -- it wasn't any of the Propofol bottles Murray saw and it wasn't any of the Propofol he had given MJ.

Of course, Michael was an erratic quantity as are many creative types. His baby-dangling and his alleged sexual misconduct were extreme though, and jeopardized his popularity and therefore his earning potential. MJ had huge earning potential and huge debts, and he was the biggest obstacle to his own success. That means there is a murder motive, and Doc Murray was not the only person who had access to MJ.

Gone too soon    

I feel SO sorry for the children, having to read the news the days to come. They will hear that their beloved Dad might have taken his own life, which would be extremely upsetting for any child.

I guess the court might be calling Prince as a witness?
Is that possible? (I am not from US so I don´t know about your laws).

I hope and pray the children will be shielded as much as possible. Stand strong, Paris, Prince and Blanket. Remember that thousands and thousands of people are on your side!!

So, before steppimg out murray left syringe+big bottle of propofol om the nightstand for Michael, just in case he needed some
more? Propofol has to be discarded immediately after you have drawn some from the bottle. You are not to draw more than 1 time
from 1 bottle or ampul.That is why it comes in many different sizes ampules & bottles sealed by rubber and in at least 3 different strengts.In my (not the US) pdr=physicians desk reference there are 8(sic) pages of instructions and warnings on propofol.murray should have dicarded any bottle or ampul immediately, propofol doed not contain any bactericidal stuff, so using ampul or bottle more than 1x ,you risk injecting germs into blood.A dr is also obliged not to leave any drugs lying around and
in reach of potential misuse.--Also it would have been difficult for Michael to do this so quickly-he had one catheter for his urine + bag for it attached to the bedside, and more than one catheter,i recall reading(but you have to check with autopsy reports desciption of body as first observed)that he had iv´s femorally bilaterally + one in ons side of neck.Anyway there were many obstacles in his way. Also something was said that the femoral iv may have been changed,this conclusion because of propofol amounts neat the enty of iv, something like that.
And why then not immediately call, scream for help if he thoght Micael had done this.Why wait til he has exhausted all other strategies ;the troot,i did nothing wrong, infusing as much as possible confusion..well this is last resort for him ..the more confusion infusd the more difficulties for the defence and why not tell the paramedics & hospital staff about this major mishap re the propofol.Why then totally deny the propofol??Why not tell about it immediately and act appropriately? Then,maybe with proper CPR Michaels life could have been saved. Propofol is not toxic per se, the danger is in "stops breathing" something that is easily corrected in a hospital setting. Note that the same amounts of propofol are used in major surgery and pt´s do not die from it.
Why wait til the day before 1st trial date to tell when you should have told and reacted immediately?

Some of these comments are freaky - positively chilling. Michael would never cause his family such terrible emotional pain by faking his death. These hoax stories happen after EVERY big celebrity death. It's quite predictable.

Can everyone keep an open mind. Innocent until proven guilty !!!
I realize that there seems to be some extraorinary circumstances and what I read so far seems to point to Dr Murray's not been innocent, however in Oprah Winfrey's interview with Janet Jackson; it was mentioned that Michael was depressed.............
I watched 'This Is It' twice and I was really spooked by some of those shots as Michael looked really emaciated, almost dying on his feet. In other shots during the film, he appeared like his old self full energy and healthy looking.
I think there is a lot more to this than meets the eye. I would be very surprised if Michael killed himself as he lived and loved his children, family, music and his fans.
However, if he was suffering from depression and anxiety and had a drug problem then that unfortunately can indicate other reasons in his death. BUT Dr Murray had a duty of care and Michael shouldn't of been left for a minute.
I do miss Michael Jackson and it is a huge loss to the world. I only hope that the truth will prevail oneday.

What utter BS... there's NO WAY this happened. Murray and his team are clutching at straws. Murray just seems unable to tell the truth and keeps on digging a deeper and deeper hole for himself. Why does he lie all the time? The truth will all come out in court and Murray will be proven to be the desperate liar he is. I can't believe his defence team are all so stupid as to believe what he says. Yes Michael had a serious problem but that doesn't alter THE FACT, THE FACT that Murray killed him.
