Mel Gibson Custody War -- No Decision

11/23/2010 9:30 AM PST BY TMZ STAFF

The judge in the Mel Gibson/Oksana Grigorieva custody battle royale will not make any decision on changing custody ... until December at the earliest.

Mel Gibson Custody Battle
The hearing is over for the day and no decision has been reached.

Oksana was on the stand for a good part of the day, as well as her mother.  We do not believe Mel testified.

Oksana was grilled about going to the media to tell her story ... and whether she felt that was in the best interest of Lucia.

As we first reported, Mel (pictured above leaving court) wants to strip Oksana of custody and overnights with the baby.  He also wants a monitor for visitation between Oksana and Lucia.  Mel wants the new order for 6 months.

112010_oksana_grigorieva_videoJudge Scott Gordon will pick up testimony sometime in December.

Why wait until Dec? Why not finish hearing evidence tomorrow, next week even? No reason to wait so long. :(

Sam--the dockets are scheduled in advance. It could be that the dockets are full, attorneys also have other cases and they may be in court/trial, holidays are coming up, perhaps some court personnel are taking vacation.

just saw the video of Oxy, Mom, and DH leaving court. She didn't look too happy, but then, maybe she was just tired. It's been a long day.

Um does anyone know if Jimmy the sound guy was there today? he was under subpoena, and so was the "facialist" and so was Eric George. Were any of them there?

Question..How is the mother in this country legally? Unless Oxymoron is a citizen..could she sponsor her mother into this country?

Not 100% sure of this but I vaguely recall reading that since she is a witness in a litigation, the court can order her visa extended for the duration of the length of the trial.

havent read the comments but there was so much on their docket with 12 items (according to NY times) that I figured this would be set aside. At least he didn't say no and we know how hard this is to do too, courts side with the mom in most cases.

#53 Something is up!

The judge is waiting for
extortion charges to be filed,
it will be a no brainer for him
to decide who should get Lucia.

Ok$a in jail,
Lucia with Mel -
PRICELESS!

LOL, poor Sam. I feel your pain.

But LA is a big honking place with lots of other people on Judge Gordon's docket.

Dammit.

Curious LOL!! No, never Judge Gordon do anything other than sit on this case of massive media grabbing headlines - you shock me lol!! Tie him to the seat, even when Mel and OG aren't there lol!!
Even though I hoped Mel would get custody today I knew in my heart the Judge was going to wait to make his decision - I worry that in December if she's not arrested for the extortion and if she's kept her mouth shut (well no interviews, lawyer's need paying!) he'll only give 50/50 custody!! Oooh, I'm getting too logical for tmz lol!!

I'm willing to bet in her twisted mind she got away with going against the judges orders and will believe she can continue on this course despite her council telling her otherwise

I had a feeling that Judge Horowitz wasn't going to make any decisions today.

Oh I'm sorry, I meant Judge Gordon...
