'Top Chef' Star's Baby Daddy:

I Want Custody!

The baby daddy of "Top Chef" star Padma Lakshmi has filed legal papers to wrestle custody away from her ... TMZ has learned.

Adam Dell -- brother of the computer king -- filed papers today in a Manhattan court.  Under an out-of-court agreement, Adam has visitation rights to see his 11 month old daughter, Krishna Thea Lakshmi, 9 days a month. 

That agreement, sources say,  is in effect until February 20, when Krishna turns 1.  Both Adam and Padma were discussing a custody arrangement after Krishna's birthday, but the negotiations recently fell apart.

Sources tell us ... Adam is still furious over the name Padma chose for the baby.  We're told two days after Krishna was born, Adam went to the hospital and launched into a 4-hour tirade over the name.

Adam, who had an intermittent relationship with Padma, was also complaining he was only allowed to see the baby 7 hours a week, though sources connected with Padma say she has never denied him a day of visitation.

Sources connected with Padma tell TMZ ... she feels "bullied" by Adam and wants to handle this in private, for the sake of the baby.  We're told Padma -- who is not receiving child support -- has made it clear to Adam she wants nothing to do with him other than raising the baby, and feels this is Adam's way of forcing a relationship.

I find it very annoying with people saying she knowingly got knocked up as she had a condition that wouldn't allow her to have a child so don't really blame her in not wanting to share especially as he's not even paying child support. Completely stupid arguing about the babys name too its already done get over it.

My father-in-law was from India, and he wanted to name my daughter Karishma which means miracle. He was happy with the name "Maya" which is common in India.

let's play devil's advocate for a moment...

she's in a relationship with dell, abet a very short one from all reports... now she has an illness which makes her getting preggers all but impossible, but that doesn't leave him off the hook for protection (you sleep with everyone someone has slept with before, everytime you sleep with them, condoms are just common sense).
the relationship ends, clearly from her reaction, there was something about him that she didn't like, since she wants nothing to do with him, other than what she has too.
oops, she finds out against the odds she's preggers, and she has the baby.
he shows up after the time to name the baby at the hospital(usually as someone said, you're required to name the baby before you leave which is 24 to 48 hours after a birth without complications), two to four days after your child's birth does not make you look like you care... and yelling for four hours at a hospital, makes you look like an idiot.
my children are named for their heritage, i believe in that, but it's my personal opinion.
they have an agreement, he gets nine days a month, that's a lot when it comes to a baby less than a year old! she doesn't get child support(so much for being a golddigger).
now the baby is turning one, sure i think he should get more time, if he didn't have more than what most have already.

What is wrong with all you people? Just because you are a sperm donor does not automatically give you the right to name your kid, and especially have the kid have your last name. That kid is going to be with the mother 99% percent of the time, why shouldnt the kid have her last name? He is just trying to control her, and she should ensure that he has absolutely no rights, and his rights as a father are stripped.

After hearing these women say that receive no child support, only to find out they have been, only not the outrageous amount to splurge on themselves...I don't believe them. It's the law you have to let the child's father see his kids, unless he is harming them, it is better for the child...better that mom accepts this and gets along for the sake of the child.
Again, does TMZ take money from publicists to spin a story a certain way for the sake of a star? It seems TMZ, ROL and various other sites take the word of stars and their mouth pieces without checking the facts...time after time. $$$ spins a story to the public every time or whatever drives the hits and copie$, eh?

to all of you idiots complaining about padma's kid's name: parents of any ethnicity can name their kids whatever they want, regardless of the ethnicity! if padma wanted to give her kid a full "western" name or a full "indian" name, that's her choice! who obligated parents to name half-white kids with combined "western" and "ethnic" names? and why do you care??

and for you guys who think the kid will be teased mercilessly in school for her name, padma definitely won't be sending her kid to school with your kids who, if they're anything like you, are ignorant and xenophobic!

For all the comments about him not showing up for birth--- has it occurred to anyone he could only doso if told it was happening? They were not together at the end of her pregnancy. He would not know her every movement unless SHE cooperated in giving it to him.

Maybe they had agreed to a different name, and that was his upset... (like, maybe, A GIRL'S NAME)...maybe it was the fact that HIS child does not bear his last name which is common practice.

They have a current agreement- so obviously at some point she knew he wanted to be in the baby's life. I think it's SICK that so many are ok just discounting whether he should be in the child's life.

None of us know, yet one more case of ppl posting as if they know every detail.
