Cops: Wrestler Was 'Belligerent,' Arrest Was Warranted

3/7/2011 6:15 PM PST BY TMZ STAFF

A rep for the Columbus PD tells TMZ they feel they had every right to arrest former WWE wrestler Shad Gaspard this weekend ... saying the video TMZ posted earlier doesn't tell the whole story.

0307_shad_mugshot
As TMZ previously reported, Gaspard was popped by Columbus PD for allegedly jaywalking and the video of his arrest shows three officers pinning him down while he, and several onlookers, tried to tell them he did nothing wrong.

Sgt. Rich Weiner, a rep for the Columbus PD, tells TMZ the police report says Gaspard was observed by an officer walking in the roadway and obstructing traffic. He says Gaspard ignored an officer's request to get out of the street and refused to provide the officer with ID when asked several times.

Sgt. Weiner says, according to the report, the officer then tried to arrest Gaspard, but he "broke free from the officers as they attempted to take him into custody."

The video we posted begins sometime after that, which Weiner says "does not show the events which led to Mr. Gaspard being put on the ground and being placed in handcuffs."

Anyone who seriously believes the cops are at fault is a complete idiot. They would not have arrested him if he did what they told him to do, which was to stop obstructing traffic and present I.D. The fool only has himself to blame and pulling the race card only makes him look worse.

you don't like the police and the police don't like you. When does it end. And for you couch lawyers, If someone is breaking the law such as jaywalking or obstructing traffic, HE DOES!!!!!! have to show ID. And that is covered by the United States Supreme Court. Maybe he covering up something. Pretty strange we only see part of a video. A few people HE was with saying he didn't do anything wrong. The video shows him resisting arrest. And in this country your not allowed to resist arrest. EVEN if you think your in the right. Look it up couch lawyers. I think he was over zealous because he thinks because he is famous he can do what he wants. Maybe he wanted to make a scene and use his skin color to justify his actions. All your posts only shows Liberals are morons and this country is going downhill because of them. You praise this clown but none of you were even there. Way to go you monday morning couch lawyers. The cops did nothing wrong and should be given a medal for dealing with this jerk and the jerks who post comments on her. Oh by the way, how did that liberal governor and president work out so far for California and THE USA?

When you break the law YOU DO have to provide I.D... Use your brains before you speak, please.

I am going to make an assumption you are a LEO, maybe new, who is on some power trip. But there isn't even a law that you have to carry ID if you are not driving or boarding a lane, or have a reason to have ID on you.

My comment, that you think you were so right about, was in response to this general comment:

Ask yourselves this, whey didn't he just produce his ID. If he had, he may have been on his marry way. But no, just another person that thinks the law gives citizens the right to do what they want. Sorry, but your all wrong when you say the police were in the wrong.

We do not have to show our ID or papers in the USA while we are walking on a public street, there are still some freedoms we have.

As a matter of fact, In Hiibel v. Sixth Judicial District Court of Nevada, the Supreme Court upheld state laws requiring citizens to disclose their identity to police when officers have reasonable suspicion to believe criminal activity may be taking place. They do not have to show ID, only identify themselves, and there has to be criminal activity taking place. Also, if you have time to spare you and you don't feel you were not doing anything at all, you don't even have to talk, they can arrest you but they have to prove their charges while you can contact an attorney.

You're wrong, he does not have to show ID, he can just give his name, or he can remain silent and call an attorney. There is no law saying we have to carry ID in the USA.

The video does not show him resisting arrest. I will assume you are a cop on both a power trip and with pretty thin skin.

Are you serious? Who the hell gets in trouble for Jaywalking any more? Is this something police really need to be concerning their selves with? This is so lame. It was more than clear in the video no one resisted "Arrest". Who cares if he didnt show ID to police (If that happened). He was Jaywalking. Shouldnt even be a law.

Ok Danielle, you really want to nitpick wording here. OK, Fine. Whether he is required to give ID or Identify himself, He didn't want to do either. He was advised that he was under arrest and failed to comply with the officers commands. That young one, IS ILLEGAL!!!!!! As for me being on some power trip, you’re a moron. This is a post. Where is the trip other than in your pot smoking head? Thin Skin? I will tell something little one, I have been called more names than you would imagine and I have still found that People like you are the whiners of the world. You’re just now making the assumption that I'm an LEO. Well Gee Whiz what was your first dang clue. And since you posted the Nevada Case, I would like for you to know that only proves my point. He failed to give his name or show any ID. Case Closed. Oh and by the way, it is illegal in all 50 states to walk in the street when there is a sidewald available. And that was what the officers were enforcing here. An idiot deciding to walk in the street instead of walking on a sidewalk. When you grow up, you may figure out that there are bad people in the world. And they are arrested for doing those bad things. For you see that's called Law Enforcement. Now go tuck yourself back in and let the grown ups talk.

Thank God for Cameras on Cell phones. Now police cannot abuse their authority nearly as much as they once did.

poster #11, you are incorrect. The only time a cop can demand you stop and talk to them is if you are driving. If you are walking down the street and a cop calls you over, you have every right to tell him "no thank you" and move along. If they decide to arrest you for that, any judge would throw it out anyways, which is likely to happen here as jaywalking is not a common crime for arrest. Their bs excuse is funny though, because you can clearly hear him talking and he sounds FAR from belligerent..just the usual bs from the cops to keep them from having to fess up that they made a serious mistake.

i am watching this video and thinking honestly this looks like they wish they could find some way to get the guy filming to go away because they've really buggered the situation, and blown a simple situation completely out of control....True we don't see what happened before the 4 police officers are on top of him but a bunch of people who did are there saying he didnt do anything wrong has to send up a few red flags even with the people defending the officers. This is another stain on law enforcement in general in the eyes of regular "untrained" people- would those cops do that to me? a 25 year old white woman for jay walking across a 2 lane street that looks as ordinary as any street in my town? No.

ANYTIME I COME IN CONTACT WITH POLICE I KNOW AT ANY MOMENT IT CAN BECOME A LIFE AND DEATH SITUATION .THE COPS ARE LIKE MCDONALDS WORKERS ,THE DEAL WITH SO MANY A-HOLES THAT THEY THINK ALL CITIZENS ARE AGAINST THEM .MINORITIES AND YOUNG PEOPLE ARE SUBJECT TO UNWARRANTED HARASMENT AND TREATMENT.WHEN SOME PEOPLE COME UNDER THIS TYPE OF MISTREATMENT THEY REACT IN FEAR .HOW MANY PEOPLE IN YOUR FAMILY HAVE BEEN FORCED TO LAY IN THE DIRT FOR JAY WALKING OR LITTERING
