Mel Gibson Strikes Plea Deal -- NO JAIL TIME

3/10/2011 7:15 AM PST BY TMZ STAFF

Mel Gibson has struck an agreement with prosecutors and has made a plea deal in his looming criminal case ... sources connected with the L.A. County District Attorney tell TMZ ... and Mel will not get jail time.

Our sources say Mel will appear in court Friday and will plead no contest to simple battery -- a lesser charge than corporal injury on a spouse.

As we first reported, Mel had been agonizing over the impending criminal charge -- related to the January 6, 2010 blowout with Oksana Grigorieva -- worried that a prolonged court fight would be a strain on his family, particularly his children.  We're told ... even though Mel believed he could win the case -- he struck the deal to protect his loved ones.

We're told the deal involves counseling but NO JAIL TIME.

When contacted for a response, Mel's lawyer, Blair Berk, released the following statement to TMZ:  "I know from almost 20 years as a criminal defense lawyer that sometimes justice can come for a client at too high a personal price.  That is particularly so for Mel, whose right to due process can only be exercised in this case with an enormous media circus attached."

Berk goes on, "Mel's priority throughout all of this has been that the best interests of his young daughter Lucia and the rest of his children be put first in any decisions made.  It is with only that in mind that he asked me to approach the District Attorney with a proposal that would bring all of this to an immediate end."

Sorry but I have to disagree Mel! That was not a wise choice in the long run! I wish you would have fought. I know it's been a long, hard road but principle is principle. Now you've lost.

I agree. This is a far cry from the gun toting maniac who had blood pratically everywhere.

I actually feel sorry for Mel. Clearly he has his life issues, but I just can't help but think that living with Ox had a detrimental affect on his sanity. She is poison in human flesh and that HAS to rub off on you.

("Rich people don't take pleas for nothing...he did it!")

DUH, he's already said that. He's being charged for the slap he admitted to moron. The time he slapped her because she was a raving lunatic shaking their daughter Lucia about. THAT is what he's being charged for...not everything else she claimed he did. Go back and read everything. The simple fact that he admitted to that slap and explained why he did it is why he's simply being charged with battery. Slapping someone for any reason is still considered battery. If the D.A. had thought he had done more than that, like she had claimed, it would have been a much stiffer charge that would NOT have been a misdemeanor.

Why not make a plea on a misdemeanor? There's no jail time and it puts an end to her claims of violence from him. He's already in counseling...and the judge is likely to allow that to serve as any counseling he requires. In my view...she DIDN'T win.

Sociopaths are Sad

All sounds true but, in this case...with this misogynistic bigot, so glad it happened to him. Ox obviously played him and, maybe he didn't deserve it this time, but he has deserved FAR WORSE many other times and skated free. Mel has been known as an anti-semitic misogynistic douche who feels superior to black people for YEARS....everyone in Hollywood has known this for YEARS but no one could stop him b/c he was so powerful. Now he is finally feeling the backlash.

Similar to how the get those Mafia people for things OTHER than their really bad crimes. The get Mafia s*** on tax evasion not murder...but at least they get them!!

Here's what I find ironic....at 1am TMZ posts the story about Mel's agonizing over whether or not to fight this in court. 7.5 hours later TMZ posts a story that MG struck a plea deal. Way to get 6hours worth of hits.

Personally, I feel ALL of this was decided DAYS if not weeks ago....and NO "official" statements have been made until now. Conveniently when MG and the DA are both out of town.

I'm sorry to say this *AND IT"S NOT BEING SAID TO STIR THE POT* but I really have a hard time accepting the fact that MG was concerned about how this will impact his children (ALL OF THEM). That concern, in my opinion, comes a bit too late. Mel should have thought about how his actions would impact the family BEFORE he got involved with this woman.

Sadly, if he doesn't fight, its a HUGE WIN for Oksana.
