Fat Lady Hasn't Sung In Lindsay Lohan Theft Case!

Bulletin!!!! Lindsay Lohan's plea deal may not be dead after all.

TMZ has learned ... Lindsay will get a continuance in court Thursday so she can have more time to mull over the judge's offer -- which POSITIVELY involves jail time.

As we reported, no deal was struck Wednesday during a meeting in chambers with Judge Keith Schwartz, Shawn Holley and Danette Meyers.

Judge Schwartz previously made it clear ... if Lindsay didn't cop a plea Thursday morning he'd send the case out to a trial judge.

But we've learned the judge is now allowing Lindsay more time to mull over his offer.

The fact that Lindsay is actually thinking about accepting Judge Schwartz' offer is a huge step -- because she has been adamant up to this point that she will NOT go back to jail.

Lindsay tells TMZ, "I am ready for court tomorrow, and I believe that the truth will prevail through all of this."

Forget everything and everyone else. In Lindsay's mind, she did not steal the necklace. She knows if she goes with the plea bargain, she will go to jail, but... in her mind... she did not steal the necklace. So... she does not want to go to jail. She is asking herself why the assistant did not admit she did not do the paperwork. In her mind, she is asking why the jeweler is going for publicity and money about something they all know she did not do.
Now... in our minds, we should recognize that the jeweler is profiting off Lindsay, simply because... they can. Anyone can cry wolf and the world will believe them because they add Lindsay Lohan as the criminal. It's all money. NOW, they are going to auction off the necklace for an 'undisclosed charity'.... bahaha hahahaha.... do we, in our right minds, even for a second believe any money they get from the sale of THAT necklace is going anywhere but in their pockets? Same as the money from the tape... they had to sell it, because 'enquiring minds wanted to know' and that means... well... why the hell not... it's Lindsay.
Now... can you see that Lindsay is just a little tired of the feeding frenzy/media circus... same as the rest of the world.
I mean really... we have Charlie Sheen going off the rails. Lindsay is so... 10AM.
People! Really????

Not to mention the people voting have not had the ENTIRE case presented to them. You know minor details like EVIDENCE and TESTIMONY. (And no John, the voices in your head do not count as testimony.)

I'm betting FooL and John Smith vote once a minute to skew the results. These results are meaningless.

And let's not forget the person who has profited the MOST off of FooL selling her baby pictures to GMA, selling stories about her daily, raking 30 cents of every dollar she has ever made.

Yes the biggest parasite of the all- her manager. (I refuse to call that ditz a mother- she doesn't know the meaning of the word.)

I'm sorry but this case is bull****. She took the necklace but lets face it, thats what celebs do all the time. Did they know she took it, YES. Did they ask for it back, YES. Did she answer the call in true celeb fashion, YES, only when she was pushed. They all do it. Lets face it, celebs have better things on their minds, like keeping us out there TMZing them. I truly believe it was one of many items she just didn't remember. She's trying to be clean and sober. This is her number one priority. Her mind is not on whether this bauble was loaned to her or she walked out with it with the intent to steal it. Frankly if that was the case don't you think she would have covered her tracks better. Get with the program DA your're drumming up charges where you shouldn't be. Don't you have something better to spend your time on?????????????

To rule in a court of law that she stole the necklace is to say that you are sure beyond a reasonable doubt that the store did not loan her the jewelry, that Lindsay did not understand or think that the store was loaning her the jewelry and that Lindsay's motive was to steal the jewelry and not give it back.

She is being charged with stealing the necklace, not with borrowing it. How is the store going to prove that they did not tell Lindsay or her friend/assistant there that Lindsay could borrow the necklace?

Lindsay does not have to prove her innocence. The prosecutor has to prove her guilt. I don't see how the prosecutor can do it. It doesn't matter what anyone says that Lindsay has stolen before, if anything. What matters is that Lindsay has never been convicted of stealing anything before. If Lindsay has a competent attorney and the judge is objective, I don't see how Lindsay can lose this case.

Lindsay may have tried to steal it which would have been a really irrational act. But the prosecutor's case is weak and not provable beyond a reasonable doubt.

The question is can Lindsay get parole on her probation violation if this goes to trial? And can Lindsay afford to pay her lawyer to defend her if it goes to trial or will she have to get a public defender?

You know....I was thinking maybe she was innocent and really did just forget it was around her neck, until Entertainment Tonight mentioned that "5 days later, this picture was taken of Lindsey, wearing the necklace". Suddenly I realized....the "accident" happened, but 5 days later, Lindsey was in her house getting dressed and thought to herself, "hey, think I'll put on this necklace (that doesn't belong to me), and wear it today!". Then, someone took the picture of her wearing it. She made a conscious effort to WEAR that necklace 5 days after she had left the store.

Add that to the fact that she walked out of that bar that one time with that gorgeous huge fur coat that wasn't hers. I mean, did she have one just like it? No, she didn't even use that defense, she just settled out of court.

She's a thief.

Why isn't the clerk getting blammed for anything...in the video she CLEARLY can see she has the damn necklace on..she is trained to keep an eye on the merch at all times. I dont even work there and i can see that she had the damn thing on..it took them all that time to find out the merch in gone..i think they let her have it and they are just pissed cuz she dodnt promote them like she should have....

Kelly, you have no idea what repercussions the clerk has faced because a thief walked in and stole something from under her nose. She could very well be taking heat for it - it's a private matter between her and her bosses. What is not private, however, is that Sticky Fingers stands accused of stealing the necklace and is going to face HER OWN consequences for having done so (or so it appears). The clerk did nothing criminally wrong, unlike Duck Lips.

That might be the case. Maybe Lindsay or her assistant agreed to borrow or be given the jewelry as a gift in return for promoting the store. When the store found out that Lindsay hadn't promoted the store, and didn't return the jewelry, they concocted this "theft story" because they were too embarrassed to admit a celebrity had fooled them.

Then, we know that when the store got the jewelry back that they didn't want the State to prosecute Lindsay for the theft. Of course, they didn't. Because there was no theft. There was a non-completion of a verbal contract by Lindsay. Once the necklace was returned, the contract was extinguished. The store was satisfied. Lindsay was satisfied. But the prosecutor wanted to teach Lindsay a lesson because of Lindsay skating on other issues in the past, so she pressed charges.

It's possible.

Maybe the store should donate the $35,000-$40,000 it got for the store security tape to the State to pay part of the costs California has had to pay for police, prosecutors, judges, etc. for this mess.
