looks like he put his hand on her first...you should never touch a person who appears to be under the influence as they may see it as an attack and swing back it's common sense. So this lawsuit should be thrown out. This man was very agrressive going after her so if nobody was around he would have hurt her. I am not saying she had any right to swing at him but she probably thought when he touched her that he was crossing the line you just don't touch somebody you do not know.

You guys assume a lot from an unclear video. I guess as long as you say "appears" and "allegedly", then it's okay. TMZ sucks.
