Brooke Mueller -- How to Juggle Parenting and Rehab

It's a safe bet ... Brooke Mueller didn't get any tips from Dr. Spock on being an engaged parent and a rehab patient ... but she's figured it out to the satisfaction of the custody judge.

Sources tell TMZ ... Brooke's most recent rehab -- for drug use -- is only part time.  She's an outpatient by day, and a mommy at night. 

Brooke's arrangement was good enough for the custody judge, who ruled she was still able to take care of her twins per the custody agreement she struck with Charlie Sheen -- with a little help from a small army of nannies, of course.

The judge did make one change in the agreement -- both Brooke and Charlie must now submit to random drug testing once a week -- more frequently than before.

uh, aren't the twins mostly ASLEEP at night??? how effective is her parenting when they are asleep?? and how effective is rehab for her if it's 'part time'?? she's been in and out of rehabs since her teen years.....

how many more denials to take a drug test and her going off the rails will it take for charlie to finally get his boys back?? charlie needs a new attorney and he needs to appeal this!

Charlie needs to start acting like he should in public to convince a judge that he's a serious, sober parent:

* Quit cussing out and cussing about the children's mother in front of his audiences

* Quit partying every night, sometimes all night, and having all his exploits recorded in the press

* Start acting like a 'clean' person and quit glorifying the drugs in every single show

* Start attending an accredited rehabilitation facility instead of claiming that he "blinked" his eyes and was "cured." Judges don't take too much stock in miracle cures, y'know?

Moments like these make me happy about being a family lawyer. It is very hard to separate personal judgments and emotions from what really is to the best interest of the child.

I think the judge was absolutely right with what he did, even though I was pulling for Charlie. Those children are better off with grandma and nannies while he is on tour. Period.

Going on tour, in that environment and with that kind of flight schedule is extremely hard even on an adult, let alone children. As long as the children are safe at home right now, then they should remain there until Charlie's situation becomes more stable than Brooke's.

A lot of you are making groundless assumptions here. Separate your hate from your logic.

That doesn't make sense to me.

Only in Hollywood I guess...

WHY MORE DRUGTESTS AT ALL? Brooke´s failed drugtest didn´t matter to the judge so why more tests??? Until Charlie fails one so he can be punished? Double standard in my opinion!

When someone goes to rehab, they SHOULD lose their kids TEMPORARILY, until they clean themselves up. Common sense.

uh, charlie has had CLEAN drug tests.....he's not trying to pawn stuff in a pawn shop and back on drugs like brooke....

if he wants to talk about his time doing drugs, why not? he's an ENTERTAINER...how many entertainers with past drug problems have written memoirs discussing their drug usage????

why does he have to go 'rehab'?? rehabs are filled with 12 step programs and he's against them....if he is clean and sober--and his drug tests show that he is, whatever HE is doing is working way better than whatever brooke is doing....

brooke is back on drugs and hanging out with paris hilton, who has her own coke arrest....

Charlie should have kept it cool. now he cannot screw up himself. no more grace periods chuckles my good man!

It wont be long before charlie starts refusing the drug tests himself or its off to rehab for him too. or maybe not and that will show how much he really cares for the situation instead of calling brooke out on it all the time.

And that tiger blood, nothing but a system cleanser (i wonder for whatever for?)

As opposed to the "common sense" that says that someone can "blink" their eyes and be "cured" WITHOUT having attended an accredited rehabilitation facility? That makes NO sense at all, much less "common sense."

What judge in his right mind is simply going to accept that Sheen has dealt with the underlying issues of his addiction, will stay clean and sober, and hand the kids over just because he "blinked?" Without some sort of ACCREDITED evaluation process, the judge isn't going to buy it.

@Nancy, absolutely. What people fail to take in to account is that a family judge MUST have at least 10 years of family law experience, as a lawyer, before being called to the bench.

He'll have more than enough experience, precedents and cases to determine what a fair ruling should be. Of course, he's not perfect but people should give the judge deference and the benefit of the doubt that he made a reasonable decision.

Didnt he just destroy a hotel room and do a bunch of drugs and got fired from a job paying millions of dollors because he was out of control with drugs and hookers
charles manson would make a better father to those kids than sheen would

Once again, THIS IS WHAT A JUDGE LOOKS AT:

- Don’t make threats. With the rise of domestic violence, the courts rightly have little tolerance for even the threat of violence, either against the spouse or children. Sheen’s history of public threats left the court cautious to ignore him again.

- Watch what you say. Calling your two girlfriends “Goddesses” or your employer rude or vulgar names only raises suspicion of the courts or court-appointed professionals regarding your mental stability.

- If you have a substance abuse problem, seek professional help. If a counselor or therapists advises you to enter rehab, follow their advise. If a counselor suggests parenting courses, take them.

- Watch your private life. If your life becomes a party – especially one witnessed by your children – people may question your fitness as a responsible parent.

How many of these things is Charlie doing RIGHT??? Notice it doesn't say a thing about "staying clean." It talks about rehabilitation programs - ways to DEMONSTRATE that one is going to STAY clean.

It does not matter, Charlie could keep passing the tests and Brooke can keep failing them and the result would be the same.

Brooke would keep custody and Charlie would get nothing which is completely wrong.
