Lindsay to Plead No Contest to Theft

Lindsay Lohan will plead no contest to the misdemeanor theft charge she faces over that pesky necklace ... sources connected with the case tell TMZ.

We're told Lindsay is committed to what she told Jay Leno this week -- that she wants to accept responsibility and move on with her life.

So Lindsay and her lawyer, Shawn Holley, will go back to Judge Stephanie Sautner as early as next week to enter the plea. 

Lindsay has already been sentenced to 120 days in jail for the probation violation, along with 480 hours of community service. Sources tell us Lindsay and her lawyer are banking on Judge Sautner not adding additional time on the theft charge. In other words, when Lindsay serves her 120-day sentence, that would be the end of it.  And sources familiar with the case say that would be a routine disposition.

L.A. County Sheriff's spokesperson Steve Whitmore tells TMZ his rough calculation is that Lindsay would serve three weeks, although there are variables to that.

We're also told the L.A. County District Attorney is inclined to give the case to the L.A. City Attorney, since the D.A. typically prosecutes felonies and the case is now a misdemeanor.  But now that Lindsay will plead no contest, it doesn't make a lot of sense for the D.A. to kick the case to the City Attorney.

Holley could not be reached for comment.

Stump on p. 6: "Alexis Neiers got 6 months for felony theft and served 30 days so if Lindsay has to do 20 days for the probation violation another 30 days for the theft would be fair even with it having been reduced to a misdemeanor."

Not so sure that Neiers' sentence is a good indicator of the possibilities for Lindsay. Alexis was much younger (18 or 19?) and this was her first arrest, plus I'm sure she was singing her little heart out to give all the details about her friends' activities in order to get herself off the hook. That's why her sentence was so unusually light for such a felony. Lindsay is much older and is not a first-time offender. Repeat offenders like Lindsay can expect stiffer sentences.

Plus unlike Alexis, Lindsay wasn't drunk as a skunk, upchucking while other people carried out the stuff. Lindsay quite deliberately pulled off this job herself, quite brazenly as the judge remarked, and has been merrily trashing the store for the past few months, trying to make herself look like a victim. The dynamic is quite different, I can see why a judge might think Alexis could be redeemable with a short sentence but might be more dubious about Lindsay's response. Lindsay has already shown that very short jail stints don't even slow her down. That could make a judge feel she needs a much longer time in jail to get the message.

The only thing that might make a difference is how she behaves on community service - if she is magnificently compliant and focused about it, that would impress the judge. But she won't have time to show much of that before her hearing (yet another reason why delaying registration for it was a stupid move).

Same song and dance. I think part of her sentence should be that nobody has to see or hear from her for at least a year!!!!! And if she's sitting in jail so that can happen so be it. We all know she deserves to be sitting in a jail cell.

It'a a sad day in Haterville for mighty Danette has struck out. No contest doesn't mean guilty, it is time for Lindsay to do her 12 days in jail and move on. I think that Lindsay will do 12 days one hour which will count as 13 days and she receives one day credit for the booking day. I guess some haters who were talking about over a year in prison will be disappointed. LINNOCENT!!!!!!!

john smith even at best she does 12 days in jail. she still has 480 hours of community service. 50 hours was hard for me because of work. she is in the courts eyes for years and still screws the pooch. imagine if she had freedom she would be dead or in prison.

So she'll probably do 20% of the jail time, and probably not finish the community service because she never does complete anything assigned to her, and she'll be back in court next year for another probation violation. Sure must be nice to be a rich little white hollywood girl. Justice is a whole different matter for the rest of us peons.
