Lindsay Necklace Case -- No Contest Plea Tomorrow

Lindsay Lohan will officially plead no contest to misdemeanor theft tomorrow -- TMZ has learned -- but Lindsay won't be showing up in court.

Sources connected with Lindsay tell TMZ ... Lindsay wants to show up for the plea, but the cost and craziness associated with a Lindsay Lohan appearance is just too much -- what with extra Sheriff's deputies, court disruption, etc.

So Lindsay's lawyer, Shawn Holley, will appear before Judge Stephanie Sautner to enter the plea.

TMZ broke the story ... Lindsay will plead no contest, and in such cases it's routine a defendant can serve the sentence with an electronic monitoring device at home, rather than doing jail time.

As we first reported ... both Sheriff's Department and the Probation Department sources tell us ... Lindsay would be eligible to serve her 120-day jail sentence with electronic monitoring at home.

Judge Sautner has made it clear ... she's treating Lindsay like any other defendant, so it's likely the judge will allow her the electronic monitoring option.

And, a defendant who serves time at home with an monitoring bracelet gets the same time off for good behavior and jail overcrowding as someone who serves time in the pokey.  And we're told 120 days translates into 14 DAYS.   So 14 days with a bracelet and she'll be off the hook with the necklace!

TMZ will be in court tomorrow.

this is just unphucking believable! Once again, she basically does no time. Why can't the rest of us get a deal like this? Heck, it makes me want to go steal a $2,500 necklace. I'm keeping this attorney's name, cause she's working magic for this skank. This skank is like Teflon Don, nothing sticks and she never does any time. Then you get some stupid judge who says:"you'll be treated like everyone else." Sorry, Judge, but no one else is ever treated this good. Heck, if that was the case, you could let 3/4 of the jail out and reduce the overcrowding now. Why can't the rest of the public be treated as well as Lindsay Skank Lohan? Or better yet, why can't Lindsay Skank Lohan be treated like the rest of the public and do some real time. How is she ever going to learn anything if you don't punish her. That community service is nothing. Heck, I do community service and volunteer everyday, so that isn't punishment. Why doesn't somebody punish this skank???? I wish she'd just o.d. so we'd never have to hear about her again!

I STILL don't understand why she gets special treatment. if I were to do something and get 120 days, I guarantee, I would NOT get to do 14 days at home and neither would anyone else, and yet they say: "you will be treated like anyone else", "you will not be getting any special treatment". That sounds exactly like special treatment to me. It also says that if she got a one year sentence that she would only do 42 days(assuming she was good). Again, the general public would not have the opportunity to do only 42 days for a one year sentence. I wish an OFFICIAL JUDGE could explain her "not so special treatment" to me so that I can get the same if I decide to steal a necklace. Heck, if that's how our justice system is, then no wonder people take risks and rob banks! Our justice system stinks when it comes to skanks like Lindsay Lohan!

I still didn't see anyone prove in court that she stole this necklace. I believe the store acted in a way to increase their business and raise awareness of their name. Why didn't they call the police right when the necklace was stolen? That's what other stores do. Why wait until the next day? I think she needs some serious help, ie treatment. She should take time off of work and concentrate on her health for a year or two.

Not enough jail space????? Build more jails and stop the sweetheart specials for Celebrities and rich connected people. She was on probation and she broke it - enough said do not pass Go, go straight to jail and don't collect the 200 dollars. And when you build these new jails how about taking out the cable tv and airconditioning. Judicial system........ what a joke

The DA and the video proved that Lindsay walked out with the necklace and didn't pay. The store owner denied loaning it to her or allowing her knowingly to leave with it. Between Lindsay's word and the word of the necklace's rightful owner, the owner wins.

You're entitled to believe whatever you want but where's YOUR proof that this was their motive? If anything, the publicity generated for their store was negative with many Lindsay "fans" swearing never to shop there. BTW, the store is already well-known both locally and within the industry.

It's funny. Some people condemn the store for not waiting LONGER before going to the authorities while you claim the opposite. The store just can't win.

However, to answer your question, Lindsay told the store she'd be back the next day. Given her celebrity status, they took her at her word and expecting her to return (with the necklace if it was mistake) the next day. At that point, they'd quietly ask for the necklace back and try to avoid embarrassing her further. It was only when she didn't show that the owner notified the police.

I agree with you. They should've called the police as soon as they realized the necklace was gone but because Lindsay's a celebrity they gave her the benefit of the doubt as well as numerous chances to return the goods without negative publicity.
This is just one of the many, many ways in which celebrities are treated differently. Had it been someone else, the police would have had the thief in handcuffs before the end of the day.

Im just so proud of her. She cant spit and laugh at are judicial system, and get away with it. I love it. You go girl. I hope all celebs can get a free ride. They deserve it. There special. Almost like a god. You can rape young boys, steal a necklace, kill people off the NFL field, beat the hell out of your girlfriend and still looked upon as a STAR. What ... me off is that Lindsay really thinks she can manipulate the justice system when the truth is- the justice system doesn't give a rat's ... whether she lives or dies. She's so busy chasing celebrity, she can't even stop to think that nobody cares really. Not even the people whose job it is to help one fix one's life.
