Lindsay Necklace Case -- No Contest Plea Tomorrow

Lindsay Lohan will officially plead no contest to misdemeanor theft tomorrow -- TMZ has learned -- but Lindsay won't be showing up in court.

Sources connected with Lindsay tell TMZ ... Lindsay wants to show up for the plea, but the cost and craziness associated with a Lindsay Lohan appearance is just too much -- what with extra Sheriff's deputies, court disruption, etc.

So Lindsay's lawyer, Shawn Holley, will appear before Judge Stephanie Sautner to enter the plea.

TMZ broke the story ... Lindsay will plead no contest, and in such cases it's routine a defendant can serve the sentence with an electronic monitoring device at home, rather than doing jail time.

As we first reported ... both Sheriff's Department and the Probation Department sources tell us ... Lindsay would be eligible to serve her 120-day jail sentence with electronic monitoring at home.

Judge Sautner has made it clear ... she's treating Lindsay like any other defendant, so it's likely the judge will allow her the electronic monitoring option.

And, a defendant who serves time at home with an monitoring bracelet gets the same time off for good behavior and jail overcrowding as someone who serves time in the pokey.  And we're told 120 days translates into 14 DAYS.   So 14 days with a bracelet and she'll be off the hook with the necklace!

TMZ will be in court tomorrow.

Well, it doesn't sound like they had plans to cuff her since she's allowed to not show up.

Was a deal brokered and the outcome settled without a public hearing?.

Personally, I'm glad she won't be wasting tax payer dollars on more of this stupidity...but what do you want to bet DADDY DEAR and DUina will be there to "speak" to the press on "her behalf".

Question is, which liar will lie best?.

TMZ comments are wrong. If the defendant chooses to take home confinement, they will serve 90% of their time. If the defendant chooses to go to jail, they will serve 10 - 14% of their time.

Yes unless the Judge specifically excludes the electronic monitoring option like Judge Revel did then the option is available to all non violent misdemeanor offenders if they can afford the costs associated with it.

I think the only exception is when the sentence over 12 months

OK so I dont get this:

1) She doesnt even have to show up to enter her plea
2) She is being allowed to serve her violation at home even though she served her last one in jail.
3) She only has to serve 14 days on house arrest even though getting house arrest is special treatment enought
4) She is not even going to be sentenced to any sort of punishment for stealing the necklace because she violated her probation WTF?????????

5) I THOUGHT SHE WAS INNOCENT?

I cannot imagine that her eligibility to serve her sentence on electronic monitoring has anything to do with pleading No Contest. I have never heard of that in any jurisdiction. It should depend on what she pleads No Contest to and her past offenses. Maybe you mean that if she accepts this plea agreement that the government has agreed to ask for electronic monitoring as a sentence and the judge will agree to the terms of the plea agreement.

Does Lindsay actually have a prior criminal conviction? I thought the prior was for a traffic offense which should not count as a prior criminal conviction and even at that it was a Probation Before Judgment type plea which would not be recorded as a conviction yet. Can you either check into it or explain it better?

I am more convinced than ever that she has a mental illness and needs to be properly diagnosed and medicated. Her progression of behavior and substance abuse are classic symptoms.

For most people, home confinement (with no work release) is a real punishment because they can't get out to work, thus lose the income and, very often, lose a job. For Lohan, it's more like a vacation.
