Lindsay Necklace Case -- No Contest Plea Tomorrow

Lindsay Lohan will officially plead no contest to misdemeanor theft tomorrow -- TMZ has learned -- but Lindsay won't be showing up in court.

Sources connected with Lindsay tell TMZ ... Lindsay wants to show up for the plea, but the cost and craziness associated with a Lindsay Lohan appearance is just too much -- what with extra Sheriff's deputies, court disruption, etc.

So Lindsay's lawyer, Shawn Holley, will appear before Judge Stephanie Sautner to enter the plea.

TMZ broke the story ... Lindsay will plead no contest, and in such cases it's routine a defendant can serve the sentence with an electronic monitoring device at home, rather than doing jail time.

As we first reported ... both Sheriff's Department and the Probation Department sources tell us ... Lindsay would be eligible to serve her 120-day jail sentence with electronic monitoring at home.

Judge Sautner has made it clear ... she's treating Lindsay like any other defendant, so it's likely the judge will allow her the electronic monitoring option.

And, a defendant who serves time at home with an monitoring bracelet gets the same time off for good behavior and jail overcrowding as someone who serves time in the pokey.  And we're told 120 days translates into 14 DAYS.   So 14 days with a bracelet and she'll be off the hook with the necklace!

TMZ will be in court tomorrow.

I thought that people on house arrest got less off for credits.

Also why would someone get off early on house arrest due to jail overcrowding??? Geez no wonder the crime rate is LA is so high, you cant even keep people locke up in thier homes!

Jay havey is wrong. i just looked it up in cali there is no early out for house arrest. and no good behavior time. so i call shana****ns against the source. plus if she has jail time also for the theft she can not run those two at the same time sorry nicole.

All of your info is right on. Very well written. As I said I have seen house arrest do 50% and I have seend work release do 25% but never without probation following. Not sure how CS fits in. She will also be arrested/booked in and livescanned again.

She'll also be monitored for drugs & alcolhol.
Lindsay had more freedom at BF for 90 days and still got in trouble (and that was with babysitters).

Pony the theft has NOTHING to do with substance abuse so WHY would they make her go to rehab again??? Makes no sense and won't happen!! She most likely will get a deferred though.

..............Because the theft occured when she had the privilege of being on probation (rather than in jail) she would go to jail. She violated her rights to that privilege by stealing. Goinf to rehab was in lieu of jail. She gets slapped with two sentences, since she violated.

What you fail to mention that that's the standard time someone without a history would get. Lindsay has quite a history and has ignored the court in the past, as well as violated her parole. The standard sentence for someone like that would include jail time and I'm pretty sure everyone know that the reason she's not showing up is because she's scared of being sent directly to jail again. You really have to wonder why TMZ has been so one sided on this. Regardless, it's only a matter of time before she ends up dead or locked up for something else. If she ever does something outside of the state of CA, she's going to be in for a shock with the way she'll be treated.

One example of a case with a history of drugs and alcohol who re-offended is a lady who had not been in the system for 25 years and the current case 25 years later was not drug or alcol related. The judge in her case looked at what she did 25 years earlier and saw her as someone that needed probation and alcohol and drug counseling. Some of these judges figure it is what leads them to their crime especially in theft cases. This is true across the board. She simply is not off the hook for her drug and alcohol related offenses in the eyes of the court especially since she only just got out of court ordered rehab twice in the last year and then was convicted of a probation violation and has a new case in addition.

The more realistic you are the more you help yourself and honesty goes a long long way. If LL makes friends at DWC they will school her.

She's done 1 hr. orientation and 3 hrs. service at the Women's Center in two weeks since her sentence.

@2 hr/wk, the remaining 476 hrs. of community service should be done by late autumn 2016, her deadline for being on Leno with her Oscar.

Lohans lawyer will plead no-contest. Lohan knows she does not need to be in court.

The only way Lohan will be in court is another Lohan self-publicity stunt. No other reason.

C'mon people, Lohan not getting anymore paps and tabloid publicity is a fate worse than death. As always they move on.
