Witnesses: Hines Ward Didn't Look Drunk to Us

7/10/2011 5:07 AM PDT BY TMZ STAFF

Witnesses at two different Georgia bars tell TMZ ... they spotted Hines Ward just hours before he was arrested for DUI ... and they all say the "DWTS" champ showed no signs of being drunk.

TMZ spoke with employees and patrons at two places -- Oasis Gentleman's Club and Buckhead Bottle Bar & Restaurant.

A witness at Oasis (an establishment where young ladies work to put themselves through nursing school) tells TMZ ... Hines was not drinking heavily, did not want to be bothered, and seemed genuinely "disinterested." The witness said Ward was only there from 9-10:00 PM.

The lovely young lady who answered the phone at Oasis confirmed she saw Ward that night.

And another witness says he saw Ward at the Buckhead Bottle Bar. A waiter there tells TMZ Hines was at the bar for a few hours, but only had one or two drinks. The employee said Hines was super nice, not drunk at all, and did not appear to have any problems walking or talking.

The waiter says Ward left at around 1:30 AM. He was popped for DUI approximately four miles away, an hour later.

Ward maintains he was not impaired by alcohol at the time he was arrested.

Hines has done so much good for so many people. Give him a pass. I believe this is an isolated incident.

Anyone know anything about him and Kym?

About two weeks ago here in Austin, TX, a local radio talk show host & former UT Longhorn football star, Jeff Ward, was popped for DWI after downing 2 bottles of beer over a 5 hour period. Local television news showed the stop (in car video from the cop car) and most of the field sobriety test. Ward was being extremely polite (in his tuxedo) and seemed to pass the test with flying colors but he was still arrested. Four days later the charges were dropped. Seems here in Austin, the police chief has a hard-on for enforcing DWI and almost 40% of those charged with DWI eventually have their cases dropped.

What the?!?

Like others have said, will people stop assuming that being intoxicated only means drunk. Hines and his rep sure seem to be emphasising that he wasn't intoxicated on alcohol rather than simply saying he wasn't intoxicated period.

What is so wrong and unfair is that these cops hang outside of bars just waiting for someone--especially a celeb to come out so they can bust them--doesn't matter whether or not they've been drinking-or whether or not they appear drunk--they just want to make their ticket quota for the shift and this is a real easy way!!! And you wonder why some of us don't like cops!

@tylarone:

You're lame. A Black man drives drunk so we should give him a pass because of all the racism Black men have suffered in the past or present? How about that Black man, Hines, not driving drunk? Maybe that would be a good idea? I don't care if you're purple and polka dotted, you don't get a pass from me to drive drunk. Sorry, your free pass to break the law just because you're Black, Yellow, Red, Green or Purple has been revoked. Obey the law or suffer the consequences. When a green or violet person drives drunk and runs through a red light and kills your family, you won't cry about the prejudice the green or violet people suffer, you'll mourn for the lost lives of your family members. But you're too dumb to realize and admit that. Your loss.

@Diane: People who like to drink too much alcohol and then drive may not like cops. Those who drive without drinking so much alcohol that they would be over the state's BAC limit have nothing to fear from the cops. Since you're worried about the cops on this issue, seems like you're one of those people who like to drive while impaired by alcohol. Hope that if and when you do, that they arrest you before you kill or injure someone else and hope you spend a long time in the hoose gough (prison). Have a nice day!

@Marty, "You'd be surprised how drunk you aren't at .09..."

That is soooo true. I wasn't inebriated at all, passed the sobriety test w/ flying colors and blew a .09. All it takes is literally a few drinks over the course of several hours. Bottom line....drinking & driving is stupid and potentially fatal. I don't even drink anymore. F*ck it.

@hotbitch:

What you said is so true. Kudos to you for realizing it and doing the right thing for your own and everyone else's safety. For some people, it will take nothing less than getting into an accident while drunk driving and injuring or killing someone to realize that it's not a good idea to drive after drinking too much alcohol. If you drink alcohol (more than 2 drinks for example over 2 hours), and you need to get somewhere, take a cab or a bus or a subway or get a lift from a friend. Don't risk your life and those of others or risk arrest. It's really not worth it.

@Sandra:

Not when your state allows you to refuse to take the breathalyzer test at the police station, like Georgia allowed Hines not to take the test there. People suspected of drunk driving because they smell of alcoholic drinks, are red-eyed and committed a traffic infraction shouldn't be allowed to refuse that breath test without the consequences of losing their license to drive and being charged with refusing the test which should be punishable by a fine and imprisonment at the discretion of a judge. Otherwise, drunk drivers are much more likely to get away with it.

What moron wrote this? Oh wait, this is TMZ any one of you morons could`ve wrote this. Appearing intoxicated has no bearing on ones state of sobriety. People that drink and drive need to be caught and jailed. The innocent are always dieing from you morons and they get so little justice. Some of you people are so low rent it`s just unbelievable.

He was so sober that when he had a chance to take the breath test to show how sober he was, he said no. Hines was drunk. Where's that silly smile now?

Just because HE didn't think he was impaired by alcohol at the time of his arrest does not mean he wasn't drunk.

Some people drink 5 or more drinks and just because they can talk without slurring their words or walk a straight line they feel it's okay to drive. WRONG.

OooooNooo!

TMZ says: "refused to take a breathalyzer test."

If he wasn't drunk then he would have taken the test.

Case closed.
