You Can't Sue Me for What I Say

New Edition star Johnny Gill thinks a new lawsuit against him is total BS -- because he thinks people shouldn't be allowed to sue over what gets said on Twitter.

As TMZ first reported, Gill is being sued by a record producer who claims Gill damaged her reputation by claiming (on Twitter) that she leaked one of his songs on the Internet.

But yesterday at LAX, Gill told our photog he thinks people should say what they want on Twitter, because otherwise "the courtrooms would be filled with a bunch of Twitter people complaining about things people say every day ... It's freedom of speech."

We'll see if a court agrees.

Dude ain't too bright if he did as the producer claims, and thinks it's freedom of speech to slander someone on twitter, or anywhere else. If he did slander her, I hope this has been pays out of his nose.

Any defamation whether orally or in writing may be actionable-especially if the offending party knew the statements were not true. And if malice can be established, then the defendant is cooked.

"Freedom of speech" in the 1st Amendment is a limit on the ability of Congress to pass laws about speech, not the freedom to say anything we wish; this freedom is not absolute in civil matters.

Slander is defamation by orally saying something that is false. Libel is defamation in writing. Therefore Twitter is LIBEL not slander you ****. Look up a dictionary before you pretend to be smart.

As long as he is stating his opinion, then it's freedom of speech. And from that one tweet that TMZ posted, it was his opinion. However, you can't accuse somebody as if it's fact and not be sued...although it's kinda hard to distinguish opinion from accusation with a limit of 140 characters.

I'm pretty sure contracts these days prevent defamation. And yes, we have a right to free speech, but that doesn't mean you can go into a theater and yell FIRE!
