Camille Grammer rushed to court Wednesday for an emergency order to keep Kelsey Grammer and his new family out of the home he once purchased with the "Real Housewives of Beverly Hills" star ... TMZ has learned

For some reason, Kelsey wants to move back into the 10,657 sq ft. mansion, even though he just bought another house in the same zip code.

Sources familiar with the situation tell TMZ there is an enormous mortgage on the property -- which is draining both Kelsey and Camille -- and they have been trying in vain to unload the property. They currently have the house listed at $16,000,000, having just lowered it by a million.

We're told Camille fears if Kelsey moves back in, it will be even more difficult to sell -- and according to the divorce settlement, Camille gets half the profit.

The judge did not issue an order Wednesday, but rather set a hearing for next month.

Kelsey's people will not specifically say WHY the actor wants to move back into the Beverly Hills pad -- but Stan Rosenfield, Kelsey's PR guy, only said this, "The only statement that needs to be made is the one made by the judge. Motion was denied."

If Kelsey wanted to move into that particular house, why didn't he just buy out Camille's part of the equity instead of buying another home in that area?

What, he's tired of his new wife already/????. What self respecting woman would want to move into the house that your spouse shared with his ex wife????
If he already has a house why is he being so spiteful and mean and moving back into his old house. Could it mean that he can't afford his "new" house and has no other choice??
Here's a though. Why doesn't he just stop getting married and producing kids and act like the middle aged s***bag bachelor he wants to be. It seems to me that he finds these women and he proclaims undying love for them but as soon as they give birth, he has no furthur use for them. It's called the Madonna/whore complex. Let's face it, he's not cut out to be a monogamous man. I think he's the male version of KK in that he is in love with being in love. When it comes down to the nuts and bolts of being married, he doesn't have the skills to maintain.
If he is so over Camille, let her have the house and they can split the profits on it. Stop screwing her over the profits that she deserves.

Maybe it his lawyer given him that advice for tax purposes. Maybe he wants to short sale the property or modify, etc. If its such a huge mortgage, it could be a financial move

It is unclear why Kelsey wanted to resume residence at the home, considering he and his new family just purchased a home in the same area. The Grammar’s residence is apparently mortgaged substantially, but when sold, Kelsey and Camille will split the profits. The judge in this matter did not rule on Camille’s motion, but set a hearing for next month for a hearing on the matter. In Virginia, judges can award sole possession of the former martial residence to one spouse pendente lite (Latin for “pending litigation”). In the final divorce hearing, all ancillary matters, including division of marital property, will be decided by the judge as well if the parties cannot come to an agreement between themselves.
