Sleeping Pill DUI Case

0207-david-silveria-tmzDriving while under the influence of a sleeping pill isn't just dangerous ... it's against the law ... and now the original drummer for the band Korn will pay the price, after pleading guilty to DUI. 

We broke the story ... David Silveria -- who played with the band from 1993 to 2006 -- was arrested in Huntington Beach, CA back in March after rear-ending another car and allegedly fleeing the scene while under the influence of a sleeping pill.

Silveria admitted he was driving while artificially tired ... and was charged with DUI and hit and run.

Earlier this week, the rocker struck a deal with prosecutors ... in which he pled guilty to the DUI charge ... and in exchange, prosecutors dropped the hit and run charge.

As far as his punishment ... Silveria was sentenced to 3 years of informal probation, a 3-month first offender program, and he must attend a M.A.D.D. victim impact panel.

We reached out to Silveria for comment -- so far, no word back.

Id rather they drop the DUI and prosecute the Hit and Run.

I wonder if he was aware he was even driving. I've taken Ambien and had conversations, written emails and done stuff around the house that I had ZERO recollection of it after I woke up later. Thankfully I've never driven anywhere on it but I've had some awkward email responses from ex's thanks to it.

Some of the sleeping pill stuff are outrageous. My dad, was in the hospital, had a kidney removed. Couldn't sleep/ nurse gave him sleeping pills. He does't recall allot but does recall this: he ripped out his IV, fell to the floor trying to get out of bed, managed to get himself dressed, and took the elevator down to the hospital lobby. Couldn't find his way out of the building, he was going to try to find his car in the parking lot/ security guard urged him to go back to his room. Could have been fatal. We should have sued the hospital, as the nurses didn't realize he was gone until he was trying to find his way back to his room. Think the product was called Ambian???
