Hercy Miller Prosecutors File To Drop Fridge Theft Case

Hercy Miller -- Master P's son -- is one step closer to having his name cleared in his refrigerator theft case ... prosecutors tell TMZ Sports they've filed documents to drop the felony charge he had been facing.

A spokesperson for the Iron County Attorney's Office tells us ... they submitted a motion to dismiss Miller's case in court on Friday afternoon. If a judge ultimately signs off on it, Miller will be in the clear.

A formal ruling on the matter is expected to come down by the end of next week.

3:22 PM PT -- According to CNN ... an NYPD spokesperson says a backpack found in Central Park is being investigated as possibly belonging to the suspect wanted for the murder of UnitedHealthcare CEO Brian Thompson.

As TMZ reported yesterday, the backpack appears to be an Everyday Backpack from Peak Design ... a bag meant for serious photographers but designed for casual use as well.

The manhunt for the suspect who fatally shot UnitedHealthcare CEO Brian Thompson in Manhattan is expanding beyond New York City ... because cops think he fled the Big Apple.

New York City Police Commissioner Jessica Tish told CNN that NYPD investigators have reason to believe the suspect is no longer in town.

As we reported ... police believe the gunman arrived in NYC last month on a bus from Atlanta and shacked up in a hostel, using a fake ID to check in, before Wednesday's shooting outside a Manhattan hotel.

Law enforcement sources tell TMZ ... four intruders wearing masks and gloves made their way onto Tyler's Los Angeles-area property early Wednesday evening, where they were observed by Perry's 24-hour security team.

We're told the intruders were spotted thanks to a thermal imaging camera system, and Tyler's security guards chased the individuals away.

Daniel Penny -- the man who choked Jordan Neely to death on a NYC subway -- has avoided a conviction so far this week after a jury of his peers could not come to a unanimous decision Friday in his trial ... and prosecutors decided to drop the top charge in the case as a result.

The prosecution moved to dismiss the second-degree manslaughter charge after the jury twice told the judge today they could not come to a unanimous verdict.

The judge agreed to drop the charge ... and the jury will reconvene Monday to consider the lesser charge in the case -- criminally negligent homicide. If convicted, he could face up to 4 years in state prison.

We're told there are no surveillance cameras INSIDE the park, but there are some at the entrances and exits of the famous Manhattan oasis. This may surprise many people in a city known for its multitude of cameras on streets and businesses everywhere.

Law enforcement sources tell us the suspected shooter arrived in the Big Apple 10 days before the shooting on November 24 ... taking a Greyhound bus to the Port Authority station in Manhattan.

From there, we're told the suspect checked into a hostel.

In a statement released Thursday, the company defended its decision to reverse the policy as a response to "significant widespread misinformation" ... though, it was notably timed amid the hunt for Thompson's shooter.

ABCBS shared the now-controversial policy was never meant "to not pay for medically necessary anesthesia services" ... rather, the "proposed update to the policy was only designed to clarify the appropriateness of anesthesia consistent with well-established clinical guidelines."

Philip Klein, whose Texas-based security firm Klein Investigations previously provided bodyguards for Thompson in the 2000s, tells TMZ ... he is "shocked and baffled" to see the high-profile CEO didn't have a "detail" (at least 10 security guards) with him while out and about in Manhattan -- given the malevolence the insurance industry often faces.

He also says Thompson should've been wearing a vest in addition to having guards by his side, but adds ... he likely didn't have it on due to personal preference.

Police say the suspect who killed UnitedHealthcare CEO Brian Thompson can't hide forever in NYC ... 'cause security cameras recorded a person believed to be the shooter riding away from the murder scene.

Check out the new video, obtained by ABC News, showing a person -- who cops say is the suspect -- riding down a Manhattan street just minutes after Thompson was shot to death early Wednesday outside a hotel.

It appears the rider's wearing a mask, riding down the street very quickly ... but, cops say this is the person they're looking for -- blending in with the rest of the concrete jungle.

The NYPD has released 2 photos of a man they call a "person of interest" in the murder of UnitedHealthcare CEO Brian Thompson ... and the man bears a striking similarity to the killer.

The photos certainly appear to be the assassin ... the nose of the killer caught on surveillance video looks identical to the man in the new photos.

The new photos reveal almost all of his face ... he is not wearing the mask the assassin wore during the shooting.
