Vampire Weekend -- Cover Model Has Image Issues

7/15/2010 1:20 PM PDT BY TMZ STAFF

Vampire Weekend is being sued for more than $2 million by the hot chick pictured on the cover of their newest album -- because she says an impostor put her John Hancock on the consent form.

The model is Kirsten Kennis -- who claims she took the original photo way back in 1983 -- and had no idea it was being featured on the album "Contra" ... until after the band began to promote it back in November.

In a lawsuit, filed yesterday in L.A. County Superior Court, Kennis claims she thinks it all has to do with a "photographic release" that the band obtained from a photographer named Tod Brody.

Problem is, Kennis claims the signature on the release is a forgery. Kennis blames the band for not verifying the legitimacy of the release -- and is suing VW and the photog for more than $2 mil.

Why would she sue now? This record has been for like 7 months, and it's not like it was under the radar.

Oh that's smart. Sue the band that obviously likes your picture enough to put us it for the COVER OF THEIR ALBUM. Idiocy.

How ridiculous. How could the idiots in VW grab a pic of some girl from 1983 and not contact her about using her unadorned image - which is very bold and intriguing, on the cover of a highly anticipated sophomore album. Did they not think she'd mind, or NOTICE? Dunces... Hope she gets her check. That record is, um, not that good either. Sorry.

She has a case. The band made a record that deserves punishment. It's really horrible... Seriously though. WHY would a band grab a random shot from some photographer - of a person that they don't know - to be placed smack dab on the cover of their highly anticipated sophomore release. It's just plain STUPID. VW needs to be slapped repeatedly. 26 times for the terrible record they made. 89 times for allowing this pic of this girl from 1983(!?) to placed on the cover of their record. Dummies.

Rostam, Ezra, CT, and, Baio should be let off the hook. Oh, Wait! That's the whole band. (exactly) Does Vampire Weekend even have 2 million to give? It's a recession, you can't be spending on every lawsuit that comes your way. Do they all have to lawyer up, and go into court? [I'm confused on this whole "LAW" business.] If so I'd love to see them in suits.

Are you guys kidding? No, just no. If she took the photo then she deserves to get proper recognition and payment for her photograph. None of this "she should be flattered to be on the cover of a bands album" bull****. If the band is going to make money promoting their band with her photograph they she deserves to receive payment. It doesn't matter if she gets it from the band or the guy who forged the signature.

Mitch says she deserves payment from the band - wrong. When she signed a release she gave up rights to the picture. Prove that the signature is forgery and then sue the photog.

before any of this lawsuit comes to fruition, the possibility of a forgery needs to be confirmed or denied. if it's a forgery, she deserves compensation. if not, she gave them the right to use the photo and she needs to deal with it.

If she truly was represented by a New York Modeling Agency and was a high priced model, I'm sure the agency got the release signed. A simple hand writing analysis will take care of the whole thing. She better hope the record company doesn't counter sue her.
