Judgment Day in 'Sister Wives' Polygamy Case

The fate of the polygamist family featured in the TLC show "Sister Wives" is now in the hands of county prosecutors ... TMZ has learned.


The Utah County Attorney has confirmed ... the Lehi Police Department has completed their felony bigamy investigation into Kody Brown and his gigantic family -- and the case has been turned over to the Utah County Attorney ... who will ultimately decide whether or not to charge the family with a crime.

In Utah, bigamy can get you 5 years in prison ... though it's rarely prosecuted.

Kody Brown -- who has 3 wives, a fiancée and 13 children -- claims he was aware of the risk he was taking when he decided to put his family on the TLC reality show ... but insists it was a "risk worth taking."

He's not being investigated for bigamy, he's being investigated for what he is doing, living in a polygamist household. Polygamy is illegal, and so is Bigamy. They're not the same. Having a multiple wives living situation has been against the law in Utah where he lives since the late 1800's, it's illegal in every state. He committing a crime, as are his "wives". Good, I hope they are charged.

Besides, when Islam takes over.. all of us guys will get to have multiple wives.

Utah is a MORMON CHURCH state and that is the only reason he won`t go down for this.It happens all the time but most times the FED steps in and the locals cover it up again and that is the legal circle of go around in utah.There are endless branchs of most any church in america but in utah it is the standard and they also have chicken ranches don`t forget.Grow ups can do what they want to some degree but their kids pay the price for thier actions and these kids will be locked away in utah for the rest of thier lifes by thier parents? lifes and actions.THE KIDS are the real problem not the local adults whom screw like rabbits...those rabbits do grow up screwed up and not adapting to mormal life in america.If I were one of those kids I would sue my parents and get some real parents.Sand hillbillys in mormonland what did they do to the worm when he was there?

The argument is already there to overturn laws that make polygamy a crime and allowing for "domestic partnerships" at the very least (marriages in the states that allow gay marriage). As a matter of fact, it is only a matter of time until someone challenges the current laws using the "right to pursue happiness/civil rights" argument already used to over turn laws on the books preventing gay marriage.

While I agree there may be other "coattail" groups waiting in the wings, the groups must not be breaking other laws. Last time I checked, bestiality and child sexual abuse were crimes in and of themselves. Bad examples. But consenting adult incest is not beyond the realm of possibilities, in this day and age of permanent pregnancy prevention.

There are far worse things out there than polygamist families. I don't know how anyone who condones gay marriage can possibly justify an anti-polygamist position. If you are a pro-gay marriage, anti-polygamy person, well, welcome to the conflict of those who believe gay marriage is immoral but yet can't really explain how allowing it affects anyone outside of the relationship. How does it affect you if this guy has two or more wives? The welfare/health care argument isn't good enough since we give those benefits to domestic partnerships. Granted, it would fundamentally shift benefit policies across the board if enough people joined the practice.

Like I've said's a very slippery slope when you start granting "rights" to all. Personally, I think marriage is a privilege, not a right, and is not constitutionally guaranteed. I figure we will see sooner than later as eventually the Supreme Court cannot keep dodging the issue.

This guy is a self centered, narcissistic jerk! The way he struts around expecting his wives to worship him - what an ego! I find the whole situation sickening and degrading, and I hope he is charged. I don't know why those women would allow themselves to be treated like that. They must not have an ounce of self esteem. What I find funny though, is that in the show's opening monologue Kody says that "love should be multiplied". But since his wives are not allowed to have other husbands I guess that only applies to him.

I think this will be a hard one to decide. On one hand he is willingly breaking the law but in my opinion I think he should not be charged. The women are obviously ok with this and want to live that lifestyle. Why should we get to decide how someone could live their life. If you don't like it, don't watch.

Sodomy was a crime in itself and marriage was between one man and one woman, but look at things now.
There are plenty examples of teachers engaging in sex with kids that come out and say it was consenual after the abuse has turned into so called love. The teacher that had children with the underage boy, went to jail, and later married when he became legal age. Mark my word, they will try to chip away at the age of consent. Children are being prepped for it now through the sexualization of kids in clothing styles, etc. The teen section looks like it should be the misses section. Some elementary kids are having sex and on birth control, with who is the question. Mark my word and see folk try to swindle beastiality and make statements like as long as they can remember they were in love with a cow and was born this way, and so on. Its not as farfetched as you think.

If they arrest this guy,they should arrest every baby daddy out there who knocks up as many women as he wants without paying child support. Half of NY would be in jail if they did this.

At least this guy supports his family and besides - he's only legally married to one.

People can live however they choose, as long as no one is being hurt by their actions. BUT! Let's not put everything that's different on TV! Reality shows have become a way to earn big bucks to support outlandish numbers of children. When they fail (Octomom) it's welfare!
