Lindsay Lohan -- Attempted Retail Robbery Victim!

4/15/2011 9:30 AM PDT BY TMZ STAFF

Lindsay Lohan faces grand theft felony charges for a necklace that we found out was marked up 300%!!!

TMZ has learned the necklace designer sold Kamofie & Co. the piece for $850 -- that price tag does not qualify for felony grand theft, which requires a value of $950 or more.

Kamofie was trying to sell the necklace to Lindsay for $2,500 bucks.

As we first reported, we're told Lindsay's lawyer, Shawn Holley, will argue the D.A. should only be allowed to charge her client with a misdemeanor because of the value of the necklace.

But even if Holley loses that argument, Kamofie's owner -- who we're told will be testifying at Lindsay's preliminary hearing -- is going to have a PR problem for the mark-up and for selling the surveillance video and shopping a book deal.

The loss to the store is only $850 though. That store can turn around and buy another similar one from another designer for $850 and be on its' way again.

There's a definite argument there for Lindsay even if the retail price Kamofie is claiming is ridiculously high.

Jim in Cali

I think this is a joke charge but its hard to feel sorry for Lindsay. She should be at an acting studio improving her craft in the middle of the day, not shopping for jewelry.

That is the common mark-up for jewelry. It is not "keystoned" (100% mark up), but jewelry is anywhere from 300% marked up to 500%, or more.

Those 50% off gold jewelry sales that department stores run frequently are huge scams. I worked in retail for years. The wholesale vs. retail on jewelry is astonishing.

Earth to whoever wrote this is ALWAYS marked up 300%.

How the hell do you think ANYONE in retails makes money.

It's not just's art work, clothes, FOOD.

Sheesh, have you been living in a cave?

This changes nothing...the prosecutor will have an expert witness testify that it is an industry wide standard.

So I guess I can go into Dior...steal a lovely dress...and when I get arrested bring in a bolt of fabric and tell them

"NO! Your honor that Dior dress can be made for $300.00 and they were selling it for $2000.00...THAT'S NOT FAIR! I only want to pay $300.00

ahahahahahahaha...yea, give that a try

Sparced, the cost to the store is much more than $850. How long did they have the necklace in inventory? How much are they paying in rent, insurance, utilities, security, etc? How many times did their salesperson show this necklace and try to sell it and how much are they paying the salesperson for her work? Even before they got the necklace into the store the buyer spent time finding the necklace, negotiating the price, etc. All this costs the jewelry store money which they deserve to get back.
So let's say the necklace is not worth $2500 ok, it's overpriced, but I have no doubt it is worth over $1000. The jewelry store paid $850 for it, and they know the value of jewelry, so they also knew they could sell it for well over $1000 or they would never have even bothered.
But this is all irrelevant. She did not steal an $850 necklace from the designer, she stole a $2500 necklace from a store. ALLEGEDLY.
I really hope this self entitled bitch goes to jail.

TMZ how dumb are you? Of course they marked it up because how else could they make money. If they bought it for $850, then they are going to charge more than that in order to make a profit.

Do you not understand how making a profit works? Do you not understand the difference between wholesale and retail? Every retail store charges more than wholesale because if they aren't going to make a profit then why sell it?

Who wrote this piece? It must have been that smart surfer dude.

thats the case with any item you buy at any store.lets say you go to walmart and buy a pack of snickers bars for 1.50 guess what wal mart only paid maybe .50 cent a pack.but in the end lindsay will get off free because in the united states celeb + trial = celeb walks free.

I can't decide who I'm sicker of. Lindsay and her "not official" bull**** or TMZ recycling the same carnards to stir the pot on this one.

Thats B.S. If the designer price is $850, OF COURSE the store will mark it up to make a profit. EVERYTHING in retail stores are priced to profit! Thats a ridiculous claim!!! That would mean whoever stole something from a store should only be charged for the wholesale, not retail cost of the item? Thats nuts. Ain't gonna fly.

FINALLY this ridiculous case and felony charge is exposed for what it is.
Go Shawn
been the same case the whole time..she stole a necklace that was priced at 2500.00 thus she got a felony charge.what arent you seeing?? by your logic i can go to best buy and steal an expensive tv and i shouldnt get charged for it just because it isnt worth what they ask.fact is she wouldnt have went for that necklace if it had 700.00 marked on it she stole it because it was high priced.

She was shopping in a RETAIL store, NOT buying it directly from the designer, so she should be charged according to the RETAIL price. GET WITH IT, TMZ. If a designer spent $100 bucks making a dress, and it RETAILED for $300, that is called MARKETING. Whoever is writing this story needs to TAKE SOME MARKETING CLASSES....C'mon Harvey, send some of these kids to school!
