Lindsay Lohan -- Attempted Retail Robbery Victim!

Lindsay Lohan faces grand theft felony charges for a necklace that we found out was marked up 300%!!!

TMZ has learned the necklace designer sold Kamofie & Co. the piece for $850 -- that price tag does not qualify for felony grand theft, which requires a value of $950 or more.

Kamofie was trying to sell the necklace to Lindsay for $2,500 bucks.

As we first reported, we're told Lindsay's lawyer, Shawn Holley, will argue the D.A. should only be allowed to charge her client with a misdemeanor because of the value of the necklace.

But even if Holley loses that argument, Kamofie's owner -- who we're told will be testifying at Lindsay's preliminary hearing -- is going to have a PR problem for the mark-up and for selling the surveillance video and shopping a book deal.

What a ridiculous post. What do you mean there is no bond she is out on 40k bail and for the probation violation the DA wants 6 months at the hearing

Anyway here is the facts:
When this case was first filed Kamofie appeared to be a discreet business run by down to earth people whose lives had been disrupted by these allegations. Even although they were letting the media into their store to film and issuing press releases.

2 months later
Recieved worlwide publicty and a spokesperson even gave a comment to Forbes stating the store was very busy.
Hired a Publicist
Created a necklacevideo site that contains several articles about Lindsay and her twitter feed.
Sold the tape to a tv show the week before Lindsay was set to plead or go to trial
The tape is now on PPV on their necklacevideo site
Attempted to get a book and movie deal
Auctioning the necklace for charity (of course after the case is concluded which will ensure there name is still out there)

How do you think stores are able to have sales on jewelry at 60% off? It's because they charge 300% (or more) than they paid for it in the first place. Sheesh you guys ... how could you not know that? No court will look at the wholesale cost instead of the retail so this is a non-story.

The jewelry store owner effort to capitalize on the alleged theft is completely irrelevant. He owns the security tape; he can sell it. That has nothing to do with what the tape either shows or doesn't show. If it shows Lindsay walking out wearing the necklace without paying for it, and in the absence of her inability to prove the store gave her permission, not to mention her never returning the necklace until the store reported it, her goose is cooked.

@ilovegossip sorry, the legitimate sites, the cnn's, msnbc's and the like cite TMZ and radaronline, there's a merging of information and way of presenting, especially the "entertainment" areas of their sites.

You missed my point and you're rehashing stuff about Lindsay like many others here. She has made mistakes, she's floundering. Now what? What good does it do to say over and over this and that? The truth is, gossip sites and even mainstream publications are profiting off of her misdeeds--that is a bad reflection on those doing it, not Lindsay. People are looking for a new Lindsay Lohan in Miley Cyrus. What is that about? Calling young women trainwrecks and putting pressure on them certainly doesn't help people like Miley Cyrus, Demi Lovato, Taylor Momsen, girls that don't act like perceived "nuns" (Dakota Fanning or Selena Gomez) and dare to show a "daring" or sexual nature or may experiment with things at times.

I'm tired of the Lindsay is the devil talk. It's not useful and it goes nowhere. Do people want to see Lindsay do well or not? She's gone to jail. What good has that done? She's done rehab. Maybe it is time for a fresh, more-effective approach to viewing her and others that have talent and opportunities to turn things around but continue to trip over themselves.

Ya know, one would think that after all the Lindsay has been through...after all the breaks she has been given - that she'd learn a thing or two, and maybe try to change her lifestyle for the better...

But what does she do instead??

* She continues to hang out at bars (which is NOT a good place for recovering alcoholics/addicts to be at).

* She continues to bully people around when she doesn't get her way.

* She continues to be a HAZARD on the road, as she still exhibits RECKLESS behavior behind the wheel of a car (ie, getting caught driving at a FELONY speed recently--30 MILES OVER the speed limit in a residential neighborhood!!!)

* She continues to break the law, whenever she sees fit.

* She continues to lie and SCAM people...outta their merchandise.

AND

* Her attitude remains the same: snotty/bratty, low-class, rude/obnoxious, mean-spirited, and cares only about herself!

In Conclusion: Lindsay Lohan is a PROVEN menace to society!!!

The reports about her constantly crying with the exception of the first few days when she was adjusting are total BS. Lindsay can handle jail and after she has served her time and wins at trial she is completely free. Sure Betty Ford was to avoid jail but that only had positive effects(admitting her problem, getting help etc). Most people at Betty Ford only do the 30 day inpatient program but Lindsay was ordered to complete the 90 day program to avoid jail. She accepted the Judge's decision because a sober house beats jail but i don't think she fears it like she did before July.

I understood that $20 to Cheryl was like a gold mine. She didn’t have a penny on her. And suddenly the entire world has picked up the Mirror’s “story” about Cheryl Presser saying Lindsay was screaming, crying, on lockdown etc. and under 24-hour security watch.

Repeat: Cheryl was nowhere near Lindsay and knew NOTHING. But suddenly, with $20 in her pocket she was revealing all kinds of ridiculous information. I saw with my own eyes the money exchange hands. Now the Mirror is making a fortune peddling this so-called inside information about Lindsay’s self-mutilation, screaming fits, crying jags and all around hysteria, inmates cursing at her. I’m here to tell you it’s patently untrue.

I also know that if ANY inmates had said the things they supposedly screamed out to Lindsay or made any threats they would be in serious lockdown themselves and treated pretty harshly by the deputies and rightly so. Anything that constitutes a threat MUST be taken seriously by the jail. How can it not be? And after spending several days over the course of several weeks interviewing released inmates from Lynwood, trust me these women aren’t going to do ANYTHING to jeopardize their time in the slammer. It’s a rough, rough, place. These women aren’t stupid.

HOW CAN THIS STAND UP IN COURT??? Anyone ELSE that steals from higher end stores gets charged for the amount the item is PRICED at...Not how much some retailer think it's WORTH.

Michael Lohan spent his jail sentence in Nassau County Jail, while Gotti spent his time in state prison

Feel free to call the New York Post and ask them to research this Lohan Lie, and make it public, that Michael Lohan never knew Gotti in prison

Good Morning Delmar, Although I usually like reading your posts, I am a bit confused by your last one. Jail has done Lindsay no good and rehab has done Lindsay no good so now it is time for the fresh start approach? That makes no sense to me. I am all for fresh starts. Each closure to a bad chapter is an opportunity for a fresh start. Until court is done, one way or another I see no way for the fresh start theory. I have an early day today, so I am out the door now. I will look for your response when I get home. Have a good day all, even you Bash.
