Lindsay Necklace Case -- No Contest Plea Tomorrow

Lindsay Lohan will officially plead no contest to misdemeanor theft tomorrow -- TMZ has learned -- but Lindsay won't be showing up in court.

Sources connected with Lindsay tell TMZ ... Lindsay wants to show up for the plea, but the cost and craziness associated with a Lindsay Lohan appearance is just too much -- what with extra Sheriff's deputies, court disruption, etc.

So Lindsay's lawyer, Shawn Holley, will appear before Judge Stephanie Sautner to enter the plea.

TMZ broke the story ... Lindsay will plead no contest, and in such cases it's routine a defendant can serve the sentence with an electronic monitoring device at home, rather than doing jail time.

As we first reported ... both Sheriff's Department and the Probation Department sources tell us ... Lindsay would be eligible to serve her 120-day jail sentence with electronic monitoring at home.

Judge Sautner has made it clear ... she's treating Lindsay like any other defendant, so it's likely the judge will allow her the electronic monitoring option.

And, a defendant who serves time at home with an monitoring bracelet gets the same time off for good behavior and jail overcrowding as someone who serves time in the pokey.  And we're told 120 days translates into 14 DAYS.   So 14 days with a bracelet and she'll be off the hook with the necklace!

TMZ will be in court tomorrow.

I think house arrest is around $20 grand a year so she will pay something at least. This is why it would be preferable to the county. Oh and also she will have to pay reparation. Does not matter that the necklace was returned...she will have to pay that money to the victim with the no contest plea

If she was admitting guilt she would be pleading guilty. She is pleading no contest with presumably no further punishment as part of the plea deal as she was already punished for a VOP due to this incident. She is just disposing of the case

What is so ridiculous is that she says she won't be there to enter the plea herself because it costs too much money to cover the circus that is Lindsay Lohan.

Why didn't she think about that FIRST before she let it go this far? She's only saying that because she doesn't want everyone to see her putting in a plea that essentially says she's guilty.

Must suck to be spouting out your innocence over and over again only to come out of it saying Hey I'm pretty much guilty but i won't flat out admit to it.

Shawn Holly, Lohans attorney, will simply enter a plea of no-contest. About 10 minutes. Done. What the judge decides is the discreation of the judge. Agree or disagree.

Lohan is pissed because she's not going to get another concreate carpet walk. No publicity. A fate worse than death.

Not to worry, Lohan as always, will still make sure the paps knows her every move.

I wonder if SCH will enter a no contest plea from LL with the understanding that the judge will do a deferred prosecution or deferred adjudication. Meaning that the case will be dropped if she does a probationary period (including rehab again????) without new theft charges.
Could happen. SCH is noted for getting her clients off. LL's being a bit more difficult to handle, but if it keeps her out of the system and the judge sees any hope in Lindsay reforming herself, who knows?
But I would think that the plea would have to be entered with LL there in court if it was either a guilty or no contest plea with a disposition to take place then.

Wasn't the 120 days was for the probation violation? She is just now pleading GUILTY to her crime, so it stands to reason she has not yet been sentenced for the actual theft she committed.
