Conrad Murray

Appeals Manslaughter Conviction

12/2/2011 3:28 PM PST BY TMZ STAFF

1002_cm_EX_appeal
Dr. Conrad Murray has just filed an appeal, challenging his conviction for involuntary manslaughter in the death of Michael Jackson ... TMZ has learned.

Murray filed the document in pro per -- which means he's representing himself instead of using a lawyer.

On the portion of the document where a lawyer will usually state his or her firm's contact information -- Murray lists "Men's Central Jail" ... and includes his booking number.

While he is representing himself, Murray is still communicating with one of the lawyers who repped him in the manslaughter trial, Nareg Gourjian.

Gourjian tells TMZ ... "This case presents a gold mine of issues for any appellate lawyer.  Dr. Murray is confident that the Court of Appeal will vindicate him."

His lawyers were so bad- he might actually do better on his own, but then again, he might get what he actually deserves.

It would have only been big news if he decided not to appeal.

Conrad Murray is appealing? Apparently he is to strippers, but not so much to regular women.

Oh this should be good. Unless he's going to come forward with the truth or some big revelation, he's just going to end up ticking off the judge. The prosecutors will chew him up and spit him out. Fool. Wasting more time and money.

In pro per? I guess he's out of dough. But the good news is he is at least can spend some time in the jail library. Which is probably a cell with law books and a toilet. Oh well. Less noise. Maybe.

If there was really a good chance the appeal would work he'd have a lawyer.

The Court of Appeal will not consider new evidence, hear witnesses, or retry cases. The Court of Appeal decides issues of law and not issues of fact. Issues commonly considered by the Court of Appeal include incorrect application of a law, improper jury instructions, and insufficient evidence to support the verdict. Only written and oral arguments are considered by the Court of Appeal. It typically takes 8 to 12 months for an initial appeal to be heard. Appellate Courts do not hear new evidence-they rely on the written trial record.
