Ruby Rose is coming up for air after claiming Katy Perry sexually assaulted her ... she just surfaced for the first time since sparking a police investigation.
The "Orange Is the New Black" and "Batwoman" star was spotted in public on Wednesday, dipping into an office building in Beverly Hills.
Photogs peppered Ruby with questions about her allegations as she parked her car and headed inside ... but she didn't really seem to be in the mood to talk about Katy or the alleged incident 16 years ago.
Katy's denied the allegations, which Ruby posted online last month, but she's now under a police investigation in Australia. Ruby claims Katy sexually assaulted her in 2010 at a nightclub in Melbourne.

Jacqueline Harris, a rep for the Office of Public Prosecution in Victoria,Australia,tells us ... "There is no statute of limitations on prosecuting indictable (serious) crimes in Victoria." Harris went on ... "The law at the time the alleged offence was committed applies to criminal proceedings and sentencing for historical offences."
Ruby Rose's recent barrage of social media posts isn't the first time she's talked about the night Katy Perry allegedly sexually assaulted her ... she wrote about it in a 2011 essay -- but said at the time nothing bad happened that night.
Back in 2011, the actress wrote an essay for News.com.au -- an Australian publication -- which seemingly referenced the same night she's now saying Perry "rubbed her disgusting vagina on my face."
The outlet says Rose wrote at the time that she lost her "dignity" one night while out with Perry ... deciding to drink just 30 days into sobriety.

As a result, Ruby wrote on Threads she's no longer allowed to speak about the case after the actress filed a police report with her allegations against Katy, who categorially denies the incident.

The "Dark Horse" singer's response comes just hours after Ruby made a series of sexual assault claims in a flurry of social media posts.
