Richie Has Prior DUI

Mandatory Jail on the Line

Nicole Richie Nicole Richie could be adding stripes to her wardrobe in the very near future.

TMZ has found court documents which reveal that Richie pled no contest four years ago to driving under the influence. Under California law, if Richie is convicted of DUI as a result of Monday's arrest, the judge must impose a jail sentence.

The law requires a mandatory sentence of five consecutive days in county jail as well as a one year license suspension for anyone twice-convicted of DUI. In addition, Richie would be ordered to attend an alcohol education program for a year-and-a-half, even if the second conviction is not alcohol-related.

As TMZ first reported, Richie admitted to CHP officers that she had taken Vicodin and smoked pot before driving the wrong way on a Burbank freeway. A field sobriety test revealed she was not under the influence of alcohol.

Cop: "What have you eaten today?"
Nicole: "French Fries"

TMZ has obtained the police documents in the 2002 case. In the arrest report it reveals that Richie told cops all she had eaten that day were french fries. As for what she drank that day -- "1 shot vodka."

She blew a .12. and a .13 in two separate tests. In California, .08 is considered legally intoxicated. Richie was stopped in her Toyota Corolla after a UCLA police officer observed her blowing a red light and driving over a speed bump at more than 50 miles an hour in an area with a 15 mph speed limit. Richie flunked the field sobriety test -- her eyes were watery and bloodshot, and she could not keep her balance.

Richie was given three years probation for her 2002 DUI conviction and had her license suspended for one year. Six months later, Richie was arrested for possession of heroin and for driving with a suspended license.

She'll worm her way out of doing any jail time for her second DUI somehow. I guess it doesn't matter to her that her drug addiction could have caused her to kill some poor unsuspecting normal person on the freeway that night. A 17 year old kid was already killed this week because of celebrity arrogance and drunk driving. It's becoming a serious epidemic. How come clubs like Hyde don't have their liquor licenses yanked for serving to underage patrons???

I'm an addiction expert and can see that readers "get" this a bit more than do the journalists. However, there are myths perpetrated on all sides.

For even an 85-pounder to get to a .12 BAL, over three drinks (1.5 ounces 80-proof liquor) is required over the course of an hour. So her "shot" was at least a triple. But minimization is not only typical of addicts, it's expected.

The fact that she cannot see her own problem is also normal. Addicts process the drug(s) differently than non-addicts. Their innate tolerance is far higher and they experience bio-chemical feedback telling them, "you're doing fine, baby!" In addition, they do not quickly feel the nausea, headache or sleepiness that tell non-addicts to stop! at low concentrations of the drug(s) in the system.

If here dad and "friends" really love her, they will offer the uncompromising tough love (a phrase I coined in my book, Drunks, Drugs & Debits) she so desperately needs. This includes jail time and coerced abstinence. An ankle bracelet along with a several-year loss of driving privileges would be appropriate.

She may well earn top story in my online http://www.addictionreport.com next month. This month the starring role was taken by O.J. and "runners-up" included Lindsay Lohan. Unfortunately, I'm never at a loss for stories when it comes to alcohol and other-drug addiction.

Dummies, please learn to read. They gave the info on her previous DUI, in 2002, where she was driving her Corolla. If I remember correctly, she was bigger back then, not 85 lbs, as she is today. If you are going to bash her, get your facts right first. As for the situation, who cares, I'm just glad she didn't injure anyone, and she needs some sort of addiction counseling.

Nicole's a sad soul, you can see it in her eyes and is obviously crying out for help. Poeple who have never been in a situation where life seems to be too much to handle have no idea what it's really like. Just because she has money doesn't make her happy; and in the spotlight I would imagine it's a little more difficult to escape pressure from everyday life. So you start looking at alternatives for escaping. Our society and penal system is so terrible they would think it's easier to give somebody jailtime than actually help with what's really going on through therapy and support groups; and maybe then you'll see a sober person. Its easy for people to say "Oh spoiled little rich girl" when that's probably not the case at all, maybe it's more about "I've never met my real parents and my womanizing adopted father who was not around that much when I was growing up, didn't shelter me from bad experiences because he was into them just the same." Furthermore, I think it's sick that people such as you readers dwell on the lives of celebrities and love to read your gossip about them when all most of them do is have a job that pays well; They are celebrities because you made them that way. Would you like to be publicly critisized for everything you do as a housewife, or a mailman, probably not, so why do they. Why not focus on real world problems instead of reading about a girl who is having a tough time with life because that's what people who have issues do, they need an outlet and unfortunately Nicole chose a bad one, but she is probably still a good person.

She was driving the wrong way on the highway... she very well could have killed someone or WORSE severely injured them and they would have to live with pain and suffering thier whole life! If you are going to use any kind of substance, GET A CAB, or take someone who is sober to drive you. She should receive jail and a huge fine. This is not some whimsical little event, have some consideration for others, DONT DRIVE under the influence!! My mother was run over by someone just like her, and she lived, but suffers daily from the pain and brain damage caused by a selfish human being just like her! And the legal system did nothing to the girl that hit my mother! Where is the justice in that! Make her pay dearly so that she thinks twice before doing it again! Make an example out of her for the young sad people that actually look up to her!

Mandatory jail time??? There is no such thing for celebs!!! If there was she would still be in prison for her heroin charge instead of out driving around drunk. And Boy George would have gone to prison for his coke conviction instead of sweeping up garbage.
Mandatory sentencing laws only apply to regular people. Robert Downey Jr did finally do some time after numerous convictions, but got parole on the earliest date and even when he quickly got busted again and flunked his drug test his probation wasn't revoked.

Celebs have their own set of rules, or lack of them. They are exempt from the laws that normal people have to abide by.

She wont serve any time . If she was a Middle class working soldier who got back from Iraq and jay walked she would have a greater chance of serving time than a rich celebrety who has prosecutors and judges star struck.

There are two laws in America one for celebreties which means they for the most part do what they want while judges kiss their butt and other set of laws for the average idiots who sadly are loyal to this country.

Does anyone know what happened with Paris's DUI? Last I heard was they postponed it til the beginning of Dec. because she was promoting her CD (ROFL) Now suddenly there is no mention of it?
