Dr. Murray

Lawyers Up

for Wrongful Death Suit

4/13/2010 10:00 AM PDT BY TMZ STAFF

Conrad MurrayDr. Conrad Murray is already planning his legal strategy in a Michael Jackson wrongful death case ... TMZ has learned.

Dr. Murray, we're told, has already hired a civil lawyer, Charles Peckham, who handles medical board cases and wrongful death lawsuits.

We've learned Peckham has already been in touch with Dr. Murray's malpractice insurance carrier, and it turns out to be a tricky situation.

Sources connected with Dr. Murray's defense tell TMZ Dr. Murray had a malpractice policy issued in Texas that covered his medical practices in Texas and Nevada.

Here's the rub.  Dr. Murray did not have a medical practice in California, which is a prerequisite for his malpractice coverage.  So Dr. Murray's position is that he first saw  Michael Jackson as a Nevada patient and what he did for him in L.A. was merely an extension of the Nevada treatment.

We've learned the malpractice policy would only cover civil litigation, not criminal.  In the event the doctor is sued for wrongful death -- and Joe Jackson promises that will happen soon -- Murray expects the policy would cover attorney's fees and any judgment.

One source told TMZ, "We fully expect the insurance company would cover such costs."

There are enough reasons for me to believe that he is alive, it is difficult to describe in a few words / phrases.
TMZ knows more, that is something that is certain. I will first have to ask permission to the hoax film makers, if I can post their link here.

and today www.thisisalsoit.com redirects to .. TMZ!
Just watch and listen carefully.

OK... the hoaxers think MJ is alive. Therefore, Dr. Murray can NOT be found guilty of the crime.

As for the insurance... the hoaxers said MJ was "healthy" at time of death, so why would Dr. Murray be "treating" him for anything?

In fact, what was he "treating" him for in NV? Insomnia? Hardly a task for a cardiologist.

MJ the Junkie is DEAD people. There is no way a cast of thousands could be "in on it" and not blow this wide open. You couldn't possibly get THAT many people to lie and risk their own futures for a mere junkie.

Stop playing math games with dates. Stop reading more than there is in a photo. Stop playing his songs backwards for hidden messages and stop idolizinig someone who didn't give a damn about anyone but himself (evidenced by his DEATH from DRUGS). If he loved his kids, he wouldn't have been doing the drugs. Period.

When a body is tired enough, it WILL sleep. He was just too impatient.

samper...everyone is entitled to an opinion. I agree with your points about the Hoax..and why it doesn't make sense....But to say that Michael didn't give a damn about anybody but himself, is a little of the mark
He gave millions to charity....MILLIONS!!!! He opened his home, his haven to sick children and families, some of whom accused him of the most hideous of crimes. I don't believe that he didn't give a damn about himself , or his kids.

The man just wanted a good nights sleep. When a body is tired enough, yes it will sleep, but perhaps the body, the engine, needs to be awake at certain times, so it can't just wait to sleep at any old time.
There is no question that Michaels choice of sleeping aid was a huge mistake..****, it cost him his life, But I don't for a second believe that it crossed his mind that it would leave his children orphaned. He had a problem...people with addictions can't see straight to make the right decisions. That's when an Ethical Doctor should have stepped in and put up the red flag. to say "if you loved your kids you wouldn't be taking the drugs in the first place". Maybe the doctors treating Michael should have notified Child services. There needed to be a voice of reason...and if you believe that Michael Jackson was a junkie, then clearly the voice of reason wasn't going to be his.

Question here guys:

If Conrad was not licensed to practice in the state of California,(if I understood correctly, he was not) was it then legal for the pharmacy to sell him the Propofol to start with? Or did the vials even come from a California pharmacy? Has there been any vials of the drug found outside of California? like in the storage unit Murray was said to have or in his Vegas and Houston offices?
And if a California pharmacy did in fact permit him to buy this from them, would the pharmacy have to pay up instead of Murray's insurance? Or both pharmacy and Murray can be sued?

Also, if Murray had been planning to administer the drug in the UK during the tour for a year, (as we are to believe Mike hired Conrad for this sole purpose)where would he have gotten it from? Would they really let them carry it over there? I wonder how they planned to do this. He would not have been licensed in the UK to have purchased this, right?

Murray and his attorneys are gearing up for a "blame the victim" defense. Get ready for Michael Jackson to be put on trial again. Now watch again as Michael's name to be drawn through the mud once again. I guess 2005 wasn't enough. Since 1993, what have we witnessed? The biased opinion of the media. The jury pool has already been tainted.
When is it enough? Now you will watch again as Michael gets put on trial again.

OK THIS IS SAD...this is really really sad... he was/is NOT a junkie...
either u believe he's dead or alive the fact is that he's NOT a junkie... damn ppl are u blind... do u believe everything ppl shove down ur throat? dammit!
look at the evidence!
where are the puncture marks on his arms? there are recent pics of him showing his arms and there are NO such marks...
how could he pass a full examination saying that he was ENTIRELY healthy if he was a junkie?
to be honest i feel that u are afraid to actually look at the evidence cuz u are 2 damn stuborn to realize that u've been believing a LIE for so long... tsk tsk tsk

and yes BarbieJean those are excellent questions..
sth tells me that u wont be getting any answers cuz ppl refuse to accept that this whole case is a BIG LIE that makes absolutely no sense...

oh and lee lee... u are talking about the conspiracy part of the hoax... that's the one that doesnt make sense in many ways... i do not entirely agree with that part of it so i never actually present it as proof..i stick with FACTS...
try to do the same...

Conrad Murray was charged with involuntary manslaughter in relation to the death of Michael Jackson. I am not an attorney but I can read, comprehend and I can certainly comment professionally on the matter of 'reasonable care'.

The legal definition of involuntary manslaughter is as follows: an unintentional killing that occurs as the result of improper use of reasonable care or skill while performing a legal act, or while committing an act that is unlawful but not felonious.

There seems to be two fundamental requirements for involuntary manslaughter.

• Was there a death/killing while under the care of another?
• Did the caregiver utilize proper and reasonable care/skill?

Michael died while under the direct care of Conrad Murray; little controversy there.

The second question of 'did the caregiver utilize proper and reasonable care/skill' requires a bit more investigation.

What is proper and reasonable care/skill for a physician to administer the medication Propofol?

Propofol can be a tricky medication because it may behave differently in every patient. What by dosing guidelines for weight may be considered to be a small dose may induce profound sedation in some people with little to no warning. Proper monitoring and rescue equipment must be readily available and the caregiver must be proficient in their use.

Unlike other medication, there is not anti-dote or antagonist medication for Propofol to reverse its actions. As with many medications, if the physician desires to reverse the effects of the medication another drug can be administered to accomplish this task; thus providing a back up and an additional measure of safety. No such drug currently exists to reverse Propofol.

Below you will find a short blurb included to give this discussion a bit more perspective:

STATEMENT ON SAFE USE OF PROPOFOL
Committee of Origin: Ambulatory Surgical Care
(Approved by the ASA House of Delegates on October 27, 2004, and amended on
October 21, 2009)

• The practitioner administering propofol for sedation/anesthesia should, at a minimum, have the education and training to identify and manage the airway and cardiovascular changes which occur in a patient who enters a state of general anesthesia, as well as the ability to assist in the management of complications.
The practitioner monitoring the patient should be present throughout the procedure and be completely dedicated to that task. • During the administration of propofol, patients should be monitored without interruption to assess level of consciousness, and to identify early signs of hypotension, bradycardia, apnea, airway obstruction and/or oxygen desaturation. Ventilation, oxygen saturation, heart rate and blood pressure should be monitored at regular and frequent intervals.

There are literally hundreds of medical articles written on safety issues related to the proper use of Propofol. As the literature an experience emphasizes, Propofol is not a drug to be taken or administered casually.

I have also reviewed the package insert provided by the maker of Propofol/Diprivan,
AstraZenca. This information that accompanies every package of Propofol does not
list the treatment of insomnia as an approved indication for use of the drug; nor
does is state that Propofol is appropriate for use outside of a highly monitored
hospital or surgical facility.

Propofol is not a drug that can be left unsecured where it may be used inadvertently
or improperly. If a patient comes in possession of Propofol it was either not properly
secured or the patient broke into a locked medication box or pharmacy to steal it.

Did Conrad Murray:

• Receive proper training for the induction on general anesthesia?
• Have proper rescue equipment available and maintain proficiency in its' proper use?
• Utilize proper monitoring equipment?
• Maintain constant supervision of the patient at all times and stay dedicated to the
• task (Did not leave to speak on the phone or take rest room breaks)?
• Properly secure the drug Propofol?
• Administer Propofol for an approved condition/indication?

Conrad Murray will be granted the opportunity to have his day in court and have his guilt or innocence determined by a jury of his peers. If only the facts are to be considered this trial shouldn't take very long.

*SIGH* Michael Jackson is alive, duh.
Everyone who believs MJ is dead asks us believers 1 question, Where is the proof, but we the believers ask you MANY questions that you will NEVER be able to answer.

1. Why did the 911 caller's information show up that he was in Sunset something, California at a hotel? If the 911 Caller was in a hotel, then he wasn't with Michael Jackson. So if the 911 caller wasn't WITH MJ, then neither was the doctor, because the 911 caller asked the doctor if he had seen what happened.

That is already ENOUGH to make me believe MJ is alive 1OO%.

2. Why did Randy Phillips say that Frank Dileo was the person who called 911 stating that Michael Jackson was dead or not breathing? How could Frank have known that if he was having lunch at 11:30 in a HOTEL?

3. Frank Dileo claimed that a "fan" had called him when he was having "early lunch" and said that there was an ambulance in front of Michael Jackson's house. How was the ambulance already there, if it hadnt got there, or left until AFTER 12 pm?

4. All of this stuff dragging on about Conrad Murray is soooo ridiculous. WHY is this STILL dragging on after a WHOLE year? Why are their NEW things that KEEP ON coming up?

Those are just 4 questions, but there are MILLIONS.

The video below has many parts to it, if you watch that and do not come back a believer, perhaps you need to ask God for a better wisdom because there is NO way you can not believe after watching this.
