Adam Lambert -- Accused of Battery

TMZ has learned ... the Miami Beach Police Department is now in the middle of a violent incident involving "American Idol" runner-up Adam Lambert ... after the alleged victim filed a police report.


Law enforcement sources tell us the paparazzo seen grappling with Lambert on the beach yesterday walked into a Miami Beach police station around 10:30 PM last night and filed a report ... accusing the singer of misdemeanor battery.

According to the police report, obtained by TMZ, the victim claims Adam grabbed his backpack "where the camera was placed" ... and "wrestled [the photog] to the ground forcefully."


One big problem -- in photos that were taken of the incident, the camera appears to be in the photog's hand ... not in his bag.

The police report also notes that the photog didn't sustain any "bruises or lacerations."

Cops tell detectives will decide if the case is worth turning over to the State's Attorney -- who will decide whether to prosecute Lambert.  If convicted, Lambert could face up to one year in jail and a $1,000 fine.

After yesterday's clash -- Lambert went right to his Twitter account and posted, "I lost my temper for a sec but wow it felt great lol MIAMI!!!"

UPDATE: Lambert just tweeted, "Battery? Nope. I attempted to grab a camera, no punches were thrown and no one was on the ground.... It was literally harmless. If embarrassment is a crime- thats all I'm guilty of. "

I don't like Paps either. But that doesn't give me the right to
impose violent acts upon them. They are breaking no law when taking pictures of the public domain. If you don't like the law, change it. I,for one, cannot understand why it is legal to take pictures of celebrities, etc at night in a moving vehicle. The flash going off causes temporary blindness and poses a serious threat to the "target" and passengers. Why do you think so many celebs wear dark glasses at night(in a vehicle or not)?

clearly that outfit was an attempt by Lambert to enjoy a day @ the beach w/ friends without drawing attention to himself.

and clearly the paparazzi overstepped boundaries in an attempt to provoke just this type of reaction.

and clearly TMZ was more than somewhat involved by posting yellow journalism headlines that aren't reflected by the carefully selected shots chosen to post.

and clearly the judge in this case should fine the photographer for making a BS claim when he incited the incident in the 1st place.

it is probably too much to hope that sooner or later laws will be passed to rein in this type of harassment of people who merely entertain for a living when they go about their day-to-day lives.

These petty and malicious camera pooparazzi need to get rounded up and tossed out of a plane several thousand of feet in the air without parachutes! I'm no Adam Lambert fan, but seriously! These losers don't deserve to be protected by the law. In fact, it should be the other way around. People should just start tazing these dirtbags as soon as they pull out their cameras. Or as soon as they see one of these maggots that are known to be pooparazzi.

If not for Adam's post, I might have believed from the photo that the two of them were jokingly grappling, as other celebrities have done with the papz in the past (photos and film courtesy of TMZ itself). If celebrities are to accept the fact that they are public figures and therefore entitled to less privacy, then the leeches that profit from the practice of invading their privacy should accept the fact that they are going to get their a**es whooped occasionally because of it.

Bottom line, if they aren't on the red carpet, promoting a recent project, or doing an interview, leave them alone!

What is Adumb complaining about??? The pictures look like he was enjoying grabbing the photog and are we sure Adumb was grabbing for the camera and not something else that would be lower and attached to the man? Furthermore, why go to take pics of that loser--he's yesterday's news anyway!!!!
