ESCAPES Escape Charge

Model, actress, escape artist Estella Warren will NOT be charged for slipping out of her handcuffs and attempting to flee when she was arrested for DUI Monday night thanks to a MAJOR technicality ... TMZ has learned.

Law enforcement sources tell TMZ ... officials will not go forward with the felony escape charge against Warren because she hadn't actually been booked into the system when she made a break for it ... therefore she technically didn't commit felony escape.

As TMZ first reported, Warren was arrested Monday night after she allegedly hit a few parked cars with her Prius, left the scene, got arrested for DUI, kicked a police officer, and then bolted from the police station.

Warren is still facing charges for assault, hit and run and DUI.

Exactly.

There are numerous other charges - some felonies, some not - that they could - and SHOULD - charge her with instead. It's ILLEGAL to flee or otherwise evade the police whether or not the suspect has been booked.

Unless they drop any charges relating to her escape attempt as part of a plea bargain due to her state of mind, they should tack on whatever other charges are applicable instead. Otherwise, many others will take the risk and attempt to escape rather than go quietly to jail.

I can't wait for the civil suits from the damaged-car owners.

Ok fine. Technicality. But she CAN be charged with resisting arrest, which should NOT be PLED down by whatever slippery defense lawyer she hires to worm her way out of her own mess.

Yes, to all of the above except she will get a much lighter sentence than she deserves because she is a celebrity in California. 2 weeks house arrest with 3 lashes with an al dente wet noodle?

Not charging her with anything because of her escaping custody---yes, she was "in custody" and "under arrest" even if she hadn't yet been "booked"---will encourage more celebrities to attempt to escape custody prior to being booked. After all, they have nothing to lose. For example, a celebrity who's stopped for a DUI and escapes before being booked, can lie low until his/her BAC or "drugs in system" diminish then he/she can return to a police station and claim he/she wasn't "under the influence" while operating a motor vehicle.

Thousands of drunk/stoned celebrities will soon be running down city streets in California. LOL

On another note, those have got to be the worst looking collagen-injected lips I've ever seen on a celebrity, worse than Lisa Rinna.

What a bitch! I bet she charmed those dumbass police officers into loosening her cuffs for her so they wouldn't hurt her delicate wrists. The girl's a damn THUG and that's exactly what she deserves to be treated as! Why wasn't she charged with assault on a police officer or resisting arrest? I saw a girl charged with resisting arrest just because she wouldn't stand up when a police officer was trying to take her off the bus we were on! I SO wish that I could be the judge in Estella's case because I'd show her absolutely NO mercy. Anyone who drinks and drives deserves to have the book thrown at them for endangering the lives of everyone on the road, but then this little bitch also decided to try to be clever and make a break for it, thinking that she could get away with it altogether. She's getting away with FAR too much here as it is, and John, I agree with you 100%... the only "technicality" here that matters is the fact that she's a celebrity, and yes, different rules DO apply to them, otherwise Lindsay would actually be in jail, not suntanning on her rooftop dressed to the nines and posing for cutesy photo ops while the other prisoners are stuck in REAL jails and don't get to enjoy sunshine, fresh air, or even their choice of clothing. I sure wish I could be a celebrity, though, so I could beat the crap out of police and get away with it like Estella did, though!
