Usher's ex-wife Tameka Raymond is freaking out that testing the singer for drugs will soon be useless -- because the more time that passes, the more time Usher has to cleanse his system of illicit substances.

In case you haven't been following -- Tameka demanded Usher take a drug test recently because she thinks the singer is popping pills and who-knows-what-else around their kids.

Usher refused on grounds Tameka's demands were "frivolous and unfounded" and only intended to “harass and embarrass” the singer. But now, Tameka's lawyers are taking her case back to the judge in the ex-couple's custody war, pleading with the court to force Usher to take the test despite his refusal.

And according to the docs, Tameka wants the court to make it snappy -- claiming, any further delay will allow Usher to "cleanse" any evidence of drugs from his system.

Kris Humphries will not get any money by fighting Kim Kardashian's attempt to divorce him -- but if he really wants to fight, there is something he can do to try and score millions from KK.

Sources directly connected with both Kris and Kim tell TMZ ... there is no point in challenging the prenup -- it's iron-clad and both sides know it. Fact is, if Kris gets his way and has the marriage annulled based on fraud, that would mean there was never a marriage and as a result he would have NO CLAIM to any of Kim's earnings during their 72 days of bliss because no marriage would have existed.

We've poked around and asked some experts what Kris might be able to do to score some cash, if he really wanted to do that. The only plausible scenario is if Kris files a claim against Kim for intentional infliction of emotional distress based on fraud. If he could prove Kim used him as a disposable groom for her reality show -- he could get monetary damages.

So, you ask, what would his monetary damages be? Well how 'bout this? If Kris sucks during the lockout shortened BBall season and gets cut from the Nets -- which is a possibility -- he could blame the distractions on his disastrous marriage and try to sock Kim for the money he'd be out. Kris pulls in $3.2 mil a year.

Kris Humphries has a plan A and B to end his relationship with Kim Kardashian, but neither involves divorce.

Sources directly connected to Kris tell us ... the BBaller has deep-seated feelings -- rooted in religion -- against divorce. He's filed for an annulment because it wipes the slate clean by erasing the marriage.

If the judge refuses to grant an annulment, we've learned Kris will then ask for a legal separation that will extend indefinitely. He feels even though an indefinite separation would preclude him from marrying again, it's preferable to divorce.

The legal experts we've spoken with say ... unless Kris can prove with "clear and convincing evidence" Kim defrauded him into marrying her ... the judge will almost certainly grant her divorce petition.

In California and most states, it only takes one to UN-tango.

One year after terminating their marriage ... Avril Lavigne and ex-husband Deryck Whibley came together for an expensive Italian meal at Madeo in Beverly Hills last night.

Avril's new man -- Brody Jenner -- was MIA at the meal, but Avril did bring another female friend ... probably because one-on-ones with exes can get awkward.

TMZ has just obtained the annulment documents Kris Humphries filed in response to Kim Kardashian's divorce petition.

As you can see, Kris is seeking an annulment based on fraud.

Dan Cortese -- former MTV Rock N' Jock host and current sometimes actor -- has filed for divorce from his wife Dawn ... TMZ has learned.

Dan filed last week in L.A. Superior Court. The couple got hitched back in '94, and they have two children.

According to the LA Times, they put their Malibu house on the market back in June.

Kim Kardashian is telling friends ... she's incredulous over Kris Humphries' claim that she used him as a disposable groom just to get a pop on her reality show.

Kim is bragging -- and on this one she has a right to brag -- she and her mom are marketing geniuses, so why would she set herself up to be skewered in the media by dumping her husband after only 72 days? Kim acknowledges the split has been rough on her image and she would never have intentionally self-destructed.

And, Kim says, if this were really a wedding truly made for TV, she would have made it "way better," telling friends, "I'm no dummy. The divorce would have been just as dramatic and dragged out as the wedding."

Sources very close to Kris Humphries tell TMZ ... Kris is gunning for an annulment based on fraud because he feels "he was just slotted in the plot line of Kim Kardashian's latest headline and newest business venture."

We're told Kris believes Kim never intended to stay married to him, but needed a groom to fuel ratings for her show. One source says, "Once they were finished taping, she just didn't need a groom anymore."

Kris is telling people he feels like a pawn in the game.

And, we're told, Kris is outraged by people who think he was in on the wedding scam -- according to one friend, "He would have never flown in his childhood pastor to marry them and involve his church."

Finally, Kris feels Kim's own statement that she posted on her blog is a smoking gun ... specifically, "I felt like I was on a fast roller coaster and couldn't get off when now I know I probably should have. I got caught up in the hoopla and the filming of the TV show."

Bottom line -- the divorce/annulment war is on.

Seems Kris has other things on his mind too -- he was spotted yesterday at the airport in Washington, DC with his mother. They were in town to attend a children's health conference ... "Building A Healthier Future Conference." We're told Kris is very active in the cause.

Kim Kardashian is telling close friends today ... she NEVER defrauded Kris Humphries into marrying her.

Sources very close to Kim tell us ... Kim loved Kris and the marriage was legit, but just fell apart in short order.

As for Kris filing for an annulment on grounds Kim defrauded him, she says the two of them actually discussed annulling the marriage before she filed for divorce, but they were advised there were no legitimate grounds for an annulment. Under California law, someone can annul a marriage if there's proof of impotency, incest, bigamy, unsound mind, force or fraud.

In fact, Kim is saying she wanted an annulment and filed for divorce only after being told it was her only legal option.

TMZ has learned ... Kris Humphries just filed for an annulment against Kim Kardashian, on grounds Kim defrauded him into marrying her.

Sources close to Kris tell TMZ ... Kris was not in on the alleged fraud, meaning he did not stage the marriage for Kim's reality show. We're told Kris wanted this to be a genuine marriage, but Kim was never really on board.

Kim has already filed for divorce -- but according to the docs, obtained by TMZ -- Kris wants Kim to pay his attorney's fees.

We broke the story the couple has a prenup, but according to the documents Kris claims there are "community and quasi-community assets." Sources connected with Kim claim there's no community property.

The short story here -- there's going to be a fight, because Kris thinks Kim did him in.

Just weeks before his third wedding anniversary, Puddle of Mudd singer Wes Scantlin has filed for divorce from his smokin' hot model wife ... TMZ has learned.

Scantlin filed divorce docs in L.A. County Superior Court Tuesday ... seeking to end his marriage to model/host Jessica Nicole Scantlin. The two married back in 2008.

Scantlin had previously referred to Jessica as "my little muse" -- claiming she inspired a bunch of his songs.

Calls to Scantlin have not been returned.

Usher's ex-wife wants to take away his kids ... claiming the singer has repeatedly blown off his legal obligations as a co-parent ... and even worse -- he CLOSED her Saks 5th Avenue credit card ... this according to court docs obtained by TMZ.

Tameka Raymond -- who had 2 kids with Usher during their brief 2 year marriage -- filed court papers in Georgia ... asking a judge to strip Usher of joint physical custody of their children ASAP.

According to the docs, Tameka claims Usher has repeatedly FAILED to obtain her permission to travel outside the state with the kids ... which he's legally obligated to do.

But there's more ... a lot more.

Tameka also claims Usher is required and has failed to:
-- get her approval before hiring nannies
-- give her first shot to watch the kids when he's away for more than 8 hours
-- allow her to take the kids for 2-weeks in the summer of 2011
-- let her have custody of the kids during Christmas break 2010

Tameka also claims Usher closed her Saks 5th Avenue credit card -- which he specifically said he wouldn't do -- and now she can no longer take advantage of the "special benefits" the card offers.

According to the docs, Usher also promised to pay $5k per month so Tameka could hire her own nanny for the kids -- but he hasn't paid in months, and now owes $34,000 worth of payments.

Tameka also claims there has been a "substantial change in [Usher's] income" since they got divorced -- and because of his success, she should get even more money for child support.

A hearing on the matter is scheduled for Wednesday. Stay tuned ...

Only in Hollywood can someone who slept with a married man claim they feel "lied to" -- but that's what Brittney Jones, Ashton Kutcher's alleged mistress, told our photog yesterday.

As TMZ first reported, Jones -- whose alleged tryst with Kutcher in 2010 was heavily denied by his camp -- says she felt vindicated when Demi Moore finally pulled the plug on her marriage to Ashton.

Jones said she hasn't spoken to Ashton lately but she wishes him and Demi the best.

Ashton Kutcher's alleged mistress -- the FIRST alleged mistress -- claims she feels "vindicated" by Demi Moore's divorce statement ... telling TMZ she hopes people will finally believe her story about sleeping with Ashton.

TMZ spoke with Brittney Jones -- who claimed she got busy with Kutcher in 2010 after meeting the guy at a bowling alley. Jones' credibility was called into question when she capitalized on her sudden fame by releasing a sex tape .... which did NOT feature Ashton.

Ashton's lawyer released a statement at the time Brittney was in the headlines, insinuating her story was a lie ... but not entirely denying

Now, Jones tells TMZ ... "Although divorce is often sad I do feel somewhat vindicated."

She adds, "For so long people have thought that I was dishonest or just making up my passionate nights with Ashton, when in fact I was being used."

"Ashton told me that both he and Demi had an 'open relationship' and that he was not in fact cheating. Now I can tell all the facts about how Ashton really was, and hopefully people will believe my side of the story."

Demi Moore will divorce Ashton Kutcher, her husband of 6 years ... and she's strongly suggesting it's because of the cheating scandal.

Demi says, "as a woman, a mother and a wife, there are certain values and vows that I hold sacred, and it is in this spirit that I have chosen to move forward with my life."

Ashton just tweeted, "I will forever cherish the time I spent with Demi. Marriage is one of the most difficult things in the world and unfortunately sometimes they fail" -- though it's unclear if this message was approved by his Twitter team.

Demi and Ashton made headlines in September after a 22-year-old woman named Sara Leal claimed she had unprotected sex with him in San Diego.

Leal claimed Ashton told her he was "separated" from Demi at the time of the alleged affair.

Eddie Griffin just can't decide if he wants to be a married man, because he got hitched in September, filed for divorce in October, and reconciled a few days ago.

Eddie and Nia Rivers filed a joint divorce petition in Las Vegas -- the same city where they tied the knot -- on October 29th, citing the go-to "irreconcilable differences."

Now people close to the couple tell us ... they're giving it one more college try, and have put the divorce on hold.

BTW, they got married impulsively on September 8th at a walk-in Vegas chapel.
