Cops Claim of

Drag Racing Doesn't Hold Water

0124-justin-bieber-drivingMiami Beach cops claim Justin Bieber was drag racing at the time of his arrest Thursday ... but the facts seem to show the allegation is MADE UP ... because we've learned they were actually UNDER THE SPEED LIMIT in the middle of the so-called drag race.

According to the police report ... cops spotted Justin and his buddy Khalil drag racing at around 4 AM.

The police report says ... an officer observed the 2 vehicles reaching speeds between 55 and 60 MPH.

Now the problems.  

Cops say they noticed the "drag race" on the 2600 block of Pine Tree Drive.  Cops were traveling in the opposite direction so they made a U turn and pursued the cars for 15 blocks.

Mind you ... Justin was driving one of the fastest race cars around -- a Lamborghini Gallardo LP550-2 Spyder.  Khalil was driving a Ferrari 16M.  Cops claim 2 SUVs in Justin's entourage actually blocked off traffic to give the 2 a clear path.  

So how could a 15-block drag race in those cars reach speeds of ONLY 60 MPH?

Fact is ... THEY DIDN'T REACH 60.  IN FACT THEY DIDN'T REACH 50THEY DIDN'T EVEN
REACH 40.


TMZ has learned ... the place where Justin and Khalil rented the cars attached a GPS device that also tracks speed. 

The GPS clocked both cars at 27 MPH at the 3500 block of Pine Tree Drive ... smack in the middle of the so-called "drag race."

There's only one time they ever broke 50 MPH and that was long before the pursuit started.  When Justin and Khalil left the club, one car was briefly clocked at 52 MPH and the other 47 MPH. Both drivers slowed down pretty quick and 5 blocks before cops noticed them they were going 34 MPH in a 30 MPH zone.   Blocks later, they were steady at 27 MPH.

 So it seems cops goosed the facts to justify the stop.

And that's not the only problem with the police report.  TMZ broke the story ... Justin's blood alcohol level was .014 -- a barely measurable amount.  Yet cops claim Justin reeked of alcohol both at the scene and at the police department.

GPS is perfect? It has been proven time and time again that if the basis for innocent or guilty lies in the hands of technology being 100% accurate, technology loses. It is far from perfect, EZPASS proves it time and time again........But looking at this from a REALISTIC point of view: This kid did not rent a Lamborghini to do 27mph. He does act retarded at times but, he isnt that retarded to pay an insane rental fee to drive miss daisy. Lamborghini's are known for their power and speed and he 110% positively broke laws in it. Guilty!!!!! Screw your GPS cover up!

So which account do we believe? If TMZ contests the police reports regarding both the blood alcohol level and the driving behavior, they need to provide credible do***entation. Nobody TRUSTS the news media. We need physical evidence.

There would have been no problem if he had used the right to remain silent when he knew that he had a clear advantage! Somebody in his legal team must have warned him that it was only a matter of time before he would get in some trouble and informed him of his rights. Not that it is going to happen anything, legally, but his image is crumbling!

Bieber haters are just as annoying as Beliebers...Get a life people. Anyway, I think Justin needed a wake up call since he got away with so much before. However, if the Miami cops fabricated some things just because he's Justin Bieber, that's just wrong.

It's not about him " getting off " or even being above the law. I'm from Miami, born and raised, and it's the most corrupt part of the country to live in. The fact that the police report doesn't ring true is just a day in the life when you're in Miami. Not surprised at all. The fact that so many people are craving for this kid's downfall IS surprising....and disgusting.

So many commenters here demanding proof and screaming conspiracy plots, some even believe TMZ is part of it! Why so much hatred and I'll-will towards this kid? Despite being a dumb kid who sometimes actually acts like a dumb kid (with money), I don't know too many celebs who had done as much as he's done for charity and dying children. I believe he was drinking, don't believe he was drunk. Don't believe he was drag racing either. And 65mph is actually the speed you'll witness on residential streets in MIA. So this update from TMZ does not surprise me in the least.

Whoever posted this article is an idiot and didn't do their research on the Florida laws regarding drag racing/street racing.

Whether or not one was racing has nothing to do with the speeds reached. You can still be charged and convicted of street racing even if the max speed you reached was 30 miles per hour.

Read the definition of the Florida law, the Luis Rivera Ortega Street Racing Act.

From the Florida statute's definitions:

“Race” means the use of one or more motor vehicles in competition, arising from a challenge to demonstrate superiority of a motor vehicle or driver and the acceptance or competitive response to that challenge, either through a prior arrangement or in immediate response, in which the competitor attempts to outgain or outdistance another motor vehicle, to prevent another motor vehicle from passing, to arrive at a given destination ahead of another motor vehicle or motor vehicles, or to test the physical stamina or endurance of drivers over long-distance driving routes. A race may be prearranged or may occur through a competitive response to conduct on the part of one or more drivers which, under the totality of the cir***stances, can reasonably be interpreted as a challenge to race.

Drag race:
Drag race means the operation of two or more motor vehicles from a point side by side at accelerating speeds in a competitive attempt to outdistance each other, or the operation of one or more motor vehicles over a common selected course, from the same point to the same point, for the purpose of comparing the relative speeds or power of acceleration of such motor vehicle or motor vehicles within a certain distance or time limit.

Before you say the cops didn't do their jobs correctly, maybe you should do yours, and know what you're talking about. Google is free.

Does the speed change the fact that he had been drinking while underage before driving? That he admitted he had been smoking pot before driving? That he had no valid license? That the rental agreement for the car didn't even allow someone under age to drive it? that they illegally blocked off the street? That the speed limit on that RESIDENTIAL street was well below even 50 so he was speeding and because of his alcohol and drug use endangering himself and, more importantly, everyone else in the area? No. IF true, it changes none of that.

Stop trying to defend the indefensible.
